DECLARATION
of 4 June 2025
amending Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended
The Ministry of Transport provides, pursuant to Section 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 130 / 2025 Coll., Act No. 230 / 2014 Coll., Act No. 249 / 2014 Coll., Act No. 261 / 2021 Coll., Act No. 199 / 2017 Coll., Act No. 193 / 2018 Coll., Act No. 337 / 2020 Coll., Act No. 220 / 2021 Coll.
Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No. 154 / 2003 Coll., Decree No. 177 / 2004 Coll., Decree No. 194 / 2006 Coll., Decree No. 27 / 2012 Coll., Decree No. 243 / 2012 Coll., Decree No. 1 / 2014 Coll., Decree No. 9 / 2015 Coll., Decree No. 43 / 2015 Coll., Decree No. 75 / 2016 Coll., Decree No. 456 / 2017 Coll., and Decree No. 370 / 2023 Coll., are amended as follows:
1. The following Sections 12a to 12c are inserted after Section 12:
Details of delivery via the delivery point
(1) When applying for the issue of a driving licence through an issue point, the applicant shall choose the place of issue from the offer contained in the user interface established by the Ministry of Transport. The selected output point cannot be changed.
(2) The applicant shall be informed of the time at which the driving licence may be withdrawn at the place of issue and of the manner and conditions in which the driving licence may be withdrawn at the point of issue. The applicant shall also be informed if, for operational reasons, this period or the place of issue is subsequently changed.
(3) If the applicant does not collect his driving licence from the place of issue at the time when it was possible to do so, he shall be informed of his transfer to the competent municipal authority of the municipality with extended scope. The applicant shall be informed of the possibility of taking over the licence at the competent municipal authority of the municipality with extended scope.
(4) The information referred to in paragraphs 2 and 3 shall be sent to the applicant for the contact details which he has selected when submitting the application in the user interface established by the Ministry of Transport.
(5) Paragraphs 1 to 4 shall also apply to the delivery of the driver card.
Joint delivery of the driving licence and driver card through the dispensing point
If the driver card is to be issued together with the driving licence and is to be delivered via the place of issue, the two documents shall be delivered together.
Time range for selecting the start date of the licence
The date of the start of validity of the driving licence may be selected from the offer contained in the user interface established by the Ministry of Transport when applying for a driving licence, and may not be later than the date on which:
(a) three months after the application for a driving licence has been submitted; or
(b) the driving licence of which the applicant for a driving licence is the holder expires. ';
2. In Article 13, the following paragraph 4 is added:
"(4) If the applicant for a driving licence does not take over the driving licence at the municipal authority of the municipality with extended scope until the end of its period of validity, the procedure laid down in Paragraph 14 (3) shall apply. ';
3. Article 15 shall be deleted, including the title.
4. In Article 17, the following paragraph 5 is inserted after paragraph 4:
"(5) When applying for a driving licence, applying for a driving licence or applying for a driver's professional competence decision through a user interface established by the Ministry of Transport, such applications shall not be entered in the driver's file; the driver registration card shall include an indication that the application has been submitted via the user interface established by the Ministry of Transport. ';
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
5. Paragraph 17 (7) is deleted.
6. Annex 1, including the title, shall read:
"Annex No 1
Model driving licence
"
7. In Annex 5, Part II. The national codes are replaced by "§ 83 (5) '.
8. Annexes 9 and 10 are deleted.
Efficacy
This Decree shall take effect on 1 July 2025.
