implementing certain provisions of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings, as amended
The Ministry of Finance (hereinafter referred to as "the Ministry") provides, pursuant to § 11 paragraph 7, § 13 paragraph 9 and § 15 paragraph 9 of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings, as amended by Act No. 83 / 1995 Coll., Act No. 423 / 2003 Coll., Act No. 292 / 2005 Coll., Act No. 161 / 2006 Coll., Act No. 104 / 2006 Coll., Act No. 258 / 2011 Coll., Act No. 298 / 2009 Coll., Act No. 353 / 2009 Coll., Act No. 303 / 2013 Coll., Act No. 64 / 2014 Coll., Act No. 119 / 2011 Coll., Act No. 263 / 2011 Coll., Act No. 263 / 2011 Coll., Act No. 353 / 2011 Coll.
Subject matter
This decree provides:
(a) conditions for the operation of the information system;
(b) the technical details of the submission of an application by the building savings bank for an annual advance on State aid for building savings (hereinafter referred to as "the application"), including the arrangements for ensuring that it is corrected or supplemented;
(c) the technical details of the submission of information on the State aid for the construction savings ("the State aid recovered") recovered, and
(d) the technical details of the submission of the application by the building savings bank to change the data relating to participants registered in the information system.
Conditions for the operation of the information system
(Paragraph 15 (9) of the Law)
(1) The information system database records the participants in accordance with § 9a (2), § 11 (7) and § 13 (9) of the Act.
(2) The building savings bank and the Ministry transmit data on participants in the data file containing the data phrases and in the accompanying data file containing the accompanying data; the structure, format and conditions of transmission of the data file and the accompanying data file are specified in the operational documentation of the information system.
Technical details of the submission of the application, including how it is corrected or supplemented
(Paragraph 11 (7) of the Law)
(1) The request or correction thereof is submitted by the building savings bank by means of electronic data transmission in two data files. The first dataset contains participants' data, the second dataset is accompanying and contains the total required advances in state aid for the building savings and the bank account number of the building savings bank.
(2) The completion of the application shall be carried out by the building savings bank by means of electronic data transmission in a data file containing data on participants.
(3) The description of the data theorems and accompanying data for the transmission of data to the building saver and the transmission of the processing result by the Ministry is given in the operational documentation of the information system.
Technical details of the submission of information on the State aid recovered from the building savings bank
(Paragraph 13 (9) of the Law)
(1) The building savings bank returns the State aid for the building savings provided for in § 13 (3) and (4) of the Act to an account published by the Ministry in a way that allows remote access.
(2) In return for State aid for construction savings, the building savings bank provides the Ministry with information on the State aid recovered. The information on the State aid recovered, indicating the participants' data, shall be provided by the building savings bank by means of electronic data transmission in two data files. The first dataset contains participants' data, the second dataset is accompanying and contains information concerning the State aid recovered.
(3) The description of the data theorems and accompanying data for the transmission of data to the building saver and the transmission of the processing result by the Ministry is given in the operational documentation of the information system.
Technical details of the application of the building savings bank to change the registered data of participants
(Paragraph 13 (9) of the Law)
(1) An application for a change to the registered data of participants is submitted by the building savings bank by electronic means. The data file shall contain details of the participants and shall be transmitted as part of the information on the State aid recovered pursuant to Section 4 (2) of this Decree.
(2) The description of the data theorems for the transmission of data to the building saver and the transmission of the processing result by the Ministry is given in the operational documentation of the information system.
Repeal
They shall be deleted:
1. Decree No. 236 / 2005 Coll., implementing certain provisions of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and on Adding the Act of the Czech National Council No. 586 / 1992 Coll., on Income Taxes, as amended by Act No. 35 / 1993 Coll.
2. Decree No. 142 / 2009 Coll., amending Decree No. 236 / 2005 Coll., implementing certain provisions of Act No. 96 / 1993 Coll., on Construction Savings and State Support of Construction Savings and on Addition of the Act of the Czech National Council No. 586 / 1992 Coll., on Income Taxes, as amended by Act No. 35 / 1993 Coll.
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.
