of 6 March 2002
laying down technical requirements for selected construction products
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Laws, as amended by Act No. 71 / 2000 Coll., ("the Act ') to implement Sections 11a, 12 and 13 of the Act:
Basic provisions
(1) For the purposes of this Regulation:
(a) a construction product, each product or assembly intended for permanent incorporation into buildings, provided that their characteristics may affect at least one of the essential requirements for the structures listed in Annex 1 to this Regulation, (hereinafter referred to as "the product,") where the permanent incorporation of the product into the construction is such that the removal or replacement of the product permanently changes the construction characteristics, the removal or replacement of the product being construction work;
(b) the intended use of the product by the use specified by the manufacturer or importer, which relates to the role the product has in meeting the essential requirements for the construction works listed in Annex 1 to this Regulation;
(c) construction work, including assembly work, the purpose of which is to implement the construction, its modification or maintenance work, which may affect the characteristics of the construction,
(d) a production control system for permanent internal production control carried out by the manufacturer at the manufacturing site, under which all data, requirements and measures must be systematically documented in the form of written procedures and instructions; the documentation must ensure a clear definition of production security in the area concerned and allow the achievement and maintenance of the required product characteristics and the effectiveness of the production control system in which the product in question is manufactured,
(e) inspection of products on importation by the importer of the documented system of buying, taking over, handling, storage and delivery of products, including keeping records;
(f) a piece of production of the method of manufacture in which the product is manufactured on the basis of a contractual relationship for a particular customer, intended for use in a one-off manner defined by the customer's individual requirement; it is in particular the craft production of products which are not expected to repeat the production of a type of the same product based on industrial production methods,
(g) an initial examination of the type of complete set of tests or other technical findings carried out when assessing the conformity of product samples representative of the product type according to Czech technical standards, other technical standards or technical documents of international or, where appropriate, foreign organisations or other technical documents containing more detailed technical requirements for this Regulation, pursuant to Article 4a (1) of the Act (hereinafter referred to as "the specified standards") or construction technical certificates;
(h) an assembly of a product placed on the market by one manufacturer, consisting of at least two separate components to be assembled for incorporation into the construction.
(2) The specified products under Paragraph 12 (1) (a) of the Act are construction products listed in Annex 2 to this Regulation, with the exception of products for which all the corresponding essential requirements under this Regulation are included in the essential requirements for conformity assessment under a special regulatory provision (1), including products intended as part of those products.
(3) This Regulation shall not apply to products whose assessment and verification of constancy of performance is laid down in the directly applicable European Union regulation on construction products (1a).
(4) The requirements for the production control system are set out in Annex 3 to this Regulation.
(5) The manufacturer's tasks set out in this Regulation with the exception of those of operating a production control system may be performed by an authorised representative [Paragraph 2 (f) of the Act].
(1) The manufacturer or importer shall carry out or ensure, for specified products, conformity assessment with the essential requirements ("conformity assessment") with regard to their suitability for the intended use, the conformity assessment procedure laid down for each product in Annex 2 to this Regulation.
(2) Where a manufacturer or importer intends to place a product on the market, where the requirements for that product are not fully covered by the specified standards, or where such standards or technical regulations do not specify the essential requirements applicable to the products in question for the intended use of the product on the construction site, or where the manufacturer or importer does not intend to comply with the specified standards, the manufacturer or importer shall ensure the technical identification of the characteristics of the product authorised by the person referred to in Article 3. On the basis of these technical findings, the authorised person shall issue a construction technical certificate to the manufacturer, importer or association of manufacturers or importers defining the technical characteristics of the products in relation to the essential requirements for construction according to the role to be played in the construction.
(3) On the basis of conformity assessment, the manufacturer or importer shall issue a declaration of conformity pursuant to Article 13 and attach a Czech mark of conformity to the product; the manufacturer or importer does not need to attach a Czech mark of conformity in the case of conformity assessment in the case of unit production pursuant to Section 9. The model of the Czech conformity mark is set out in Annex 4 to this Regulation.
(4) The Czech mark of conformity shall be affixed visibly, legibly and indelibly to the product. Where this is not possible or justified due to the nature of the product, it shall be attached to the packaging or accompanying documentation.
(5) If the Czech conformity mark is increased or reduced, the relative proportions between its individual elements shall be respected. The height of the Czech conformity mark shall not be less than 10 mm.
Construction technical certificate
(1) For the technical identification of the characteristics of a product by an authorised person, carried out in the cases referred to in Section 2 (2), the manufacturer or importer shall provide the authorised person with the necessary supporting documents or, where appropriate, samples of the product or the results of previous verification tests and sample assessments. At the same time, the manufacturer or importer shall submit a written declaration that he has not commissioned another authorised person to carry out the technical findings of the characteristics of the product.
(2) Authorised person shall:
(a) an assessment of the supporting documents submitted by the manufacturer or importer, in particular for the identification of the product and for the identification of those characteristics to be subject to conformity assessment;
(b) the definition of the technical characteristics of the product which relate to the essential requirements and the definition of their levels in relation to the intended use of the product in construction, in terms of other technical regulations, 2) Czech technical standards, technical documents (Section 3 (2) of the Act) or technical standards of international or foreign organisations, where appropriate on the basis of scientific and technical knowledge and practical knowledge;
(c) verification tests of samples of the product and their evaluation where necessary to define the technical characteristics of the product and their levels.
(3) On the basis of those technical findings or tests, the authorised person shall issue a construction technical certificate with a limited duration of up to 5 years. It may extend that period.
(4) The construction technical certificate shall contain:
(a) identification details of the manufacturer, importer or association of manufacturers or importers (name and surname, permanent residence, place of business and identification number of the natural person or name or, where applicable, business name, registered office and legal entity identification number);
(b) identification and description of the product;
(c) the definition of the method of use of the product in the construction site, including any restrictions;
(d) an overview of the supporting documents submitted by the manufacturer or importer;
(e) an overview of the technical regulations and technical standards and technical documents used, where applicable, of the sources of scientific and technical knowledge used, as well as information on practical knowledge, if used;
(f) data on the technical characteristics of the product, their levels and the methods of detection;
(g) specifying the requirements for product assessment and for the assessment of the production management system;
(h) details of the period of validity of the construction technical certificate.
(5) The construction technical certificate may be used for conformity assessment only for as long as the legislation, technical standards or technical documents used in the construction technical certificate do not change in terms of the facts referred to in paragraph 2 (b). (b) or other essential elements with regard to the conformity assessment under which the construction technical certificate has been issued. The construction technical certificate shall not be used as evidence of conformity assessment.
Technical documentation
(1) The manufacturer or importer shall obtain technical documentation for conformity assessment.
(2) The technical documentation must be made up to such an extent as to permit conformity assessment of the product with the technical requirements contained in the specified standards or technical regulations or in the construction technical certificate; the technical documentation necessary for the correct understanding of the function of the product in the construction in relation to the essential requirements and which implies the intended use of the product in the construction, in cases where it is provided to an authorized person, in the Czech language or in a language agreed with the authorized person.
(3) The technical documentation, taking into account the nature of the product, contains:
(a) a detailed description of the product and the definition of its use in construction;
(b) for imported products, identification details of their producer;
(c) a reference to the specified standards, technical regulations or construction technical certificates to be used for conformity assessment before placing the product on the market;
(d) design and production drawings of the product and, where appropriate, other documentation specifying the characteristics of the product in relation to its use, the technological process for its production and construction use, the technical characteristics of the product relating to the essential requirements;
(e) descriptions and explanations necessary to understand the drawings and functions of the product, instructions for use in the construction and, where appropriate, warnings; warning of danger or restriction of use and instructions for safe use must be in the Czech language,
(f) the results of the design and design calculations and the results of any tests carried out;
(g) test reports or certificates, where applicable, if they were issued before the conformity assessment pursuant to Sections 5 to 9.
Conformity assessment procedures
Certification
(1) The manufacturer or importer shall provide the authorised person for product certification
(a) their identification data (name and surname, permanent residence, place of business and the identification number of the natural person or name or, where appropriate, business name, registered office and legal person's identification number), for imported products also the manufacturer and the place of manufacture,
(b) the technical documentation referred to in Article 4;
(c) samples of the product,
(d) a description of the production control system operated and, where applicable, of the method of control of the products by the importer;
and ensure that the authorised person has regular supervision of the proper functioning of the production control system or of the proper functioning of product control with the importer at least once every 12 months.
(2) The authorised person shall carry out the product certification by:
(a) examine the supporting documents submitted by the manufacturer or importer and assess whether they comply with the requirements of this Regulation;
(b) carry out an initial test of the product type on the sample provided by the manufacturer or importer on the basis of the choice made and verify that the product complies with the requirements laid down in the specified standards, technical regulations or construction technical certificates relating to the essential requirements;
(c) carry out an initial examination at the manufacturing site and an assessment of the production control system, whether it conforms to the relevant technical documentation referred to in paragraph 1 (d) and whether the production control system ensures that products placed on the market comply with the requirements laid down in the designated standards, technical regulations or construction technical certificates and that they correspond to the technical documentation referred to in Article 4 (3); unless the importer provides for an assessment of the production control system by an authorized person of the foreign manufacturer, the importer shall be the subject of an assessment of the method of control of the products.
(3) If the sample complies with the requirements laid down in the specified standards, technical regulations or construction technical certificates related to the essential requirements and the manufacturer ensures the proper functioning of the production control system, or the importer ensures proper control of the products, the authorised person shall issue a product certificate and transmit it to the manufacturer or importer. This certificate and, where relevant, the protocol, where it is an integral part of the certificate, shall contain the conclusions of the detection, verification, test results, the basic description and, where appropriate, the representation of the certified product necessary for its identification.
(4) The authorised person shall supervise at least once every 12 months the proper operation of the production control system with the manufacturer, take samples of the products at the manufacturing site, carry out their tests and assess whether the characteristics of the product comply with the specified standards, technical regulations or construction technical certificates. The authorised person shall issue a report on the assessment of supervision and shall transmit it to the manufacturer. If the authorised person finds deficiencies in the functioning of the production control system with the manufacturer or in the characteristics of the product, he shall be entitled to revoke or amend the certificate issued to him.
(5) In the case of an importer, the authorised person shall, at least once every 12 months, supervise the proper functioning of the control of the products, test the samples of the product and assess whether the characteristics of the product comply with the specified standards, technical regulations or construction technical certificates. The authorised person shall issue a report on the assessment of compliance with the requirements, which he shall transmit to the importer. Where an authorised person identifies deficiencies, it shall be entitled to revoke or amend the certificate issued to him.
Certification without supervision tests
(1) Paragraph 5 (1) to (3) shall apply mutatis mutandis to certification without supervision tests.
(2) The authorised person shall supervise the proper functioning of the production control system of the manufacturer at least once every 12 months. The authorised person shall issue a report on the assessment of supervision and shall transmit it to the manufacturer. If the authorised person finds that the production control system required is functioning or that the product characteristics required are not functioning, he shall be entitled to revoke or amend the certificate issued to him.
(3) The authorised person shall, at least once every 12 months, supervise the proper functioning of the control of products with the importer. The authorised person shall issue a report on the assessment of supervision and shall transmit it to the importer. Where an authorised person identifies deficiencies, it shall be entitled to revoke or amend the certificate issued to him.
Assessment of the production control system
(1) Manufacturer or importer for assessment of the production control system
(a) carry out or have carried out initial tests of the product type on the sample and evaluate whether the product type complies with the requirements laid down by the specified standards, technical regulations or construction technical certificate and shall provide proof thereof;
(b) provide the technical documentation referred to in Article 4;
(c) ensure that all products which it places on the market comply with the requirements laid down in the designated standards, technical regulations or construction technical certificates and comply with the technical documentation referred to in Article 4 (3);
(d) ensure, for an authorised person, an assessment by the manufacturer of the production control system operated in accordance with paragraph 2; for that purpose it shall provide the necessary supporting documents describing the production control system operated;
(e) ensure that the authorised person oversees the proper functioning of the production control system at least once every 12 months.
(2) Authorised person
(a) carry out an initial examination at the place of manufacture and an assessment of the production control system, whether it complies with the relevant technical documentation referred to in paragraph 1 (d) and whether the production control system ensures that products placed on the market comply with the requirements laid down in the designated standards, technical regulations or construction technical certificate, with the technical documentation referred to in Article 4 (3) and with the document issued in accordance with paragraph 1 (a);
(b) where the production control system ensures that products placed on the market comply with the requirements of (a), it shall issue a certificate thereof;
(c) carry out at least once every 12 months supervision of the proper functioning of the production control system. An authorised person shall issue a report on the assessment of supervision, which shall be transmitted by the manufacturer and, where appropriate, by the importer. Where an authorised person identifies deficiencies, it shall be entitled to revoke or amend the certificate issued to him or her,
(3) Where an importer does not provide an authorised person with the possibility of carrying out an initial verification at the manufacturing site or an assessment of the production control system with the manufacturer, the conformity assessment shall be carried out in accordance with the procedure laid down in Section 5.
Verification of conformity
(1) Manufacturer or importer to verify the conformity of products
(a) ensure that the authorised person carries out an initial test of the product type on the sample;
(b) provide the technical documentation referred to in Article 4;
(c) ensure that the production or inspection system at import ensures that all products which it places on the market comply with the requirements laid down in the designated standards, technical regulations or construction technical certificates and comply with the technical documentation referred to in Article 4 (3); the importer ensures to an appropriate extent the control of the imported products.
(2) The authorised person shall carry out initial tests of the product type on the sample and shall assess whether the product type complies with the specified standards, technical regulations or construction technical certificates. It shall issue a report on the results of the tests and their assessment, indicating the period of validity.
Conformity assessment by the manufacturer
(1) Manufacturer or importer for conformity assessment of products
(a) carry out or have carried out initial tests of the product type on the sample and assess whether the product type complies with the specified standards, technical regulations or construction technical certificates; evidence of the results of the tests and their assessment,
(b) provide the technical documentation referred to in Article 4;
(c) ensure that the production or inspection system at import ensures that all products which it places on the market comply with the requirements laid down in the designated standards, technical regulations or construction technical certificates and comply with the technical documentation referred to in Article 4 (3); the importer ensures to an appropriate extent the control of the imported products.
(2) In the event that the importer does not ensure compliance with all the provisions of paragraph 1, verification of conformity shall be carried out in accordance with Section 7.
Conformity assessment for unit production
The manufacturer may, in order to assess the conformity of products manufactured by pieces, instead of the conformity assessment procedures set out in Annex 2 to this Regulation, provide for conformity assessment, unless specified standards or construction technical certificates provide otherwise, by the following procedure:
(a) for products placed on the market in accordance with the specified standards, assess whether the product complies with those standards due to its intended use in construction and provide evidence of such assessment;
(b) for products the characteristics of which do not comply with the specified standards, or where such standards or technical regulations do not specify the essential requirements for the intended use of the product in the construction site, the authorised person shall provide an assessment of the technical documentation for the intended use of the product. The authorised person shall, on the basis of an assessment of the technical documentation, issue a building technical certificate in accordance with Article 3, adapted for the piece production, so that the conformity assessment under this construction technical certificate covers only product execution which allows its intended use to arise at least acceptable risk in relation to the intended use of the product. The manufacturer shall subsequently assess whether the characteristics of the manufactured product correspond to those specified in the construction technical certificate.
At the request of the manufacturer or importer, conformity assessment procedures under § 5a to 8 may be replaced by the conformity assessment procedure under § 5.
The evidence of the conformity assessment procedure used pursuant to Section 13 (7) of the Act is the technical documentation and documents drawn up in the assessment of conformity, including the declaration of conformity.
Declaration of conformity
(1) A declaration of conformity, which is a document within the meaning of Article 13 (2) of the Act, is drawn up by the manufacturer or importer in the Czech language and made available to users of construction products in paper form or on a website. The declaration of conformity shall be marked with a unique, unmistakable identifier within the meaning of point (b), which allows the product to be clearly identified. The declaration of conformity shall also contain the following particulars:
(a) identification details of the manufacturer or importer issuing the certificate of conformity (first name and last name, permanent residence, place of business and identification number of the natural person or name or, where appropriate, business name, registered office and legal entity identification number),
(b) product identification details (e.g. name, type, mark, description of design), the name and address of the manufacturer and the place of manufacture of the imported products;
(c) a description and determination of the product (manufacturer or importer, as appropriate, designated for the purpose of construction use);
(d) an indication of the method of conformity assessment used; identification of test evidence and conformity assessment,
(e) the reference to the specified standards, technical regulations or construction technical certificates used in the conformity assessment;
(f) a complete set of declared technical characteristics of the product which may affect at least one of the essential requirements for the construction works listed in Annex 1 to this Regulation; These characteristics shall be indicated within the range of the initial type test and shall be expressed by class, level, limit value or description so that the construction can be properly designed and carried out;
(g) details of the authorised person, if he has issued a construction technical certificate or has participated in the conformity assessment, the information on that person (name or business name, where applicable, seat, identification number of the authorised person) and the registration number and date of issue of his or her finding (construction technical certificate, test report, reports, or certificates, as appropriate) of the product concerned or assessment of the production management system;
(h) a confirmation by the manufacturer or importer that the product meets the declared characteristics of the product, meeting the essential requirements of this Regulation and, where applicable, the requirements of other technical regulations, that the product is safe under normal conditions or, where appropriate, by the manufacturer or importer of the intended use, and that he has taken measures to ensure that all products placed on the market comply permanently with the technical documentation and the essential requirements;
(i) the date and place of issue of the certificate of conformity; the name and function of the responsible person of the manufacturer or importer and its signature.
(2) Where there is a change in the facts on which the certificate of conformity has been issued to a product which is to continue to be placed on the market after that change and where such changes may affect the characteristics of the product in terms of essential requirements, the manufacturer or importer shall issue a new declaration of conformity. Other changes to the facts on which the certificate of conformity was issued shall be indicated in the addendum to the certificate of conformity.
(1) A product manufactured in another Member State of the European Union, another State constituting the European Economic Area or Turkey shall be considered as complying, on a case-by-case basis, with the requirements of this Regulation where it complies with the tests and findings which, according to the methods in force in the Czech Republic or recognised as equivalent, have been carried out by an approved body in the State of the manufacturer.
(2) This Government Regulation may be used for the purpose of verifying the characteristics of the product which are laid down for use in the construction of specific legislation4); in such a case, the importer's tasks under Sections 2 to 8, 10 and 13 may also be performed by a distributor or an authorised representative.
(3) Where the distributor or authorised representative is referred to in paragraph 2, they shall be subject to the obligations of the importer.
Transitional provisions
(1) For the products listed in Annex 2 to this Regulation, unless otherwise specified, the procedures laid down in the present Regulation may be applied within 1 year of the date of entry into force of this Regulation instead of the conformity assessment procedures indicated for each product in Annex 2 to this Regulation.
(2) Products listed in Annex No 2 to this Regulation which, before the date of entry into force of this Regulation, were not subject to conformity assessment procedures under Government Regulation No 178 / 1997 Coll., laying down technical requirements for construction products, as amended by Government Regulation No 81 / 1999 Coll., may, instead of the requirements laid down in this Regulation, satisfy, for a period of 1 year from the date of entry into force of this Regulation, the requirements for their characteristics as laid down in the present Regulations.
(3) The conformity assessment carried out pursuant to Government Regulation No 178 / 1997 Coll., laying down technical requirements for construction products, as amended by Government Regulation No 81 / 1999 Coll., is deemed to be a conformity assessment under this Regulation, unless there is a change in the facts in which the conformity assessment was carried out, in particular a change in the characteristics of the product or to the technical requirements or conformity assessment procedure set out therein.
(4) Documents issued under Government Regulation 178 / 1997 Coll., laying down technical requirements for construction products, as amended by Government Regulation 81 / 1999 Coll., can be used as evidence for conformity assessment under this Regulation. Where such documents are limited in time, they shall be valid for the period specified therein, unless at that time the facts in which they were issued have changed.
(5) Persons entrusted with conformity assessment activities under Government Regulation 178 / 1997 Coll., laying down technical requirements for construction products, as amended by Government Regulation 81 / 1999 Coll., shall be deemed to be authorised persons under this Regulation if they apply for new authorisation within 45 days of the date of entry into force of this Regulation.
(6) Paragraph 11 of the Protocol to the Europe Agreement establishing an association between the Czech Republic, of the one part, and the European Communities and their Member States, of the other part, on conformity assessment and acceptance of industrial products in the Collection of International Treaties does not apply to products originating in the Czech Republic or in the European Union.
Repeal
They shall be deleted:
1. Government Decree No. 178 / 1997 Coll., laying down technical requirements for construction products.
2. Government Regulation No. 81 / 1999 Coll., amending Government Regulation No. 178 / 1997 Coll., laying down technical requirements for construction products.
Efficacy
(1) This Regulation shall enter into force on the day of its publication.
(2) Paragraph 11 expires on the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union.

Annex No. 1 to Decree No. 163 / 2002 Coll.
ESSENTIAL REQUIREMENTS
The products must be suitable for constructions so that they are (as a whole and individual parts), while respecting the economy appropriate for the intended use of the buildings, while meeting the essential requirements for constructions laid down in the directly applicable European Union1 Regulation, governing the conditions for the marketing of construction products.
These essential requirements shall be met during normal maintenance for an economically reasonable service life, provided that the effects of the normally foreseeable effects on the buildings are applied. The product shall maintain the technical characteristics during its economically reasonable service life, as long as the performance indicators of the construction are maintained at a level compatible with the performance of the above construction requirements.
