COMMUNICATION
Ministry of Foreign Affairs
The Ministry of Foreign Affairs announces that on 19 January 1996 a European Agreement on major inland waterways of international importance (AGN) was adopted in Geneva.
On behalf of the Czech Republic, the Agreement was signed in Helsinki on 23 June 1997. The instrument of approval of the Agreement by the Czech Republic was deposited with the Secretary-General of the United Nations, depositary of the Agreement, on 8 August 1997.
The Agreement entered into force on 26 July 1999 on the basis of Article 8 (2) and entered into force on that date for the Czech Republic.
The Czech draft of the Agreement is announced at the same time.
EUROPEAN AGREEMENT
on major inland waterways of international importance (AGN)
Contracting Parties,
bearing in mind the need to facilitate and develop international transport on inland waterways in Europe,
bearing in mind that the international transport of goods will increase as a result of the growth of international trade,
underlining the important role of inland waterway transport, which, compared with other modes of transport, has economic and environmental advantages and offers sufficient capacity in infrastructure and fleet and is therefore able to reduce social costs and negative environmental impacts of inland transport as a whole,
Convincing that, in order to improve the efficiency of international inland waterway transport in Europe and its interest to consumers, a legal framework should be established to coordinate plans for the development and construction of an international network of inland waterways based on agreed infrastructure and operating conditions,
agree as follows:
Designation of the network
The Contracting Parties shall adopt the provisions of this Agreement as a coordinated plan for the development and construction of a network of inland waterways, hereinafter referred to as the "network of inland waterways of international importance 'or the" network of waterways E' which they intend to implement within their respective programmes. The E-network shall comprise inland waterways and ports of international importance listed in Annexes I and II to this Agreement.
Technical and operational characteristics of the network
The Inland waterway network of international importance referred to in Article 1 shall be adapted to the characteristics set out in Annex III to this Agreement or shall be brought into line with the provisions of this Annex during future modernisation work.
Annexes
The Annexes to this Agreement shall form an integral part of the Agreement.
Designation of the depositary
The Secretary-General of the United Nations shall be the depositary of this Agreement.
Signature
1. This Agreement shall be open for signature in Geneva at the United Nations Headquarters for States which are members of the United Nations Economic Commission for Europe or may participate in the work of the Commission with an advisory status in accordance with paragraphs 8 and 11 of the Commission's Rules of Procedure, from 1 October 1996 to 30 September 1997.
2. Such signatures shall be subject to ratification, acceptance or approval.
Ratification, acceptance or approval
This Agreement shall be subject to ratification, acceptance or approval in accordance with Article 5 (2).
2. Ratification, acceptance or approval shall take place by the deposit of an instrument to the Secretary-General of the United Nations.
Access
1. This Agreement shall be open to access to any State referred to in Article 5 (1) from 1 October 1996.
2. Access shall be effected by deposit with the Secretary-General of the United Nations.
Entry into force
1. This Agreement shall enter into force 90 days after the date on which the Governments of the five States have deposited instruments of ratification, acceptance, approval or accession, provided that one or more inland waterways of inland waterways network of international importance, without interruption of the territories of at least three States which have deposited such instruments.
2. If this condition is not met, the Agreement shall enter into force 90 days after the date of deposit of the instrument of ratification, acceptance, approval or accession, thereby fulfilling that condition.
3. For each State which deposits the instrument of ratification, acceptance, approval or accession after the 90-day period referred to in paragraphs 1 and 2 of this Article, the Agreement shall enter into force 90 days after the date of deposit of the instrument.
Restrictions on the implementation of the Agreement
1. Nothing in this Agreement shall be construed as a barrier to the adoption, in accordance with the provisions of the United Nations Charter, of measures limited to cases of extreme emergency which it considers necessary to ensure its internal or external security.
2. Such measures, which must be of a temporary nature, shall be notified without delay to the depositary, indicating their nature.
Dispute settlement
1. Any dispute between two or more Contracting Parties which relates to the interpretation or implementation of this Agreement and which the Parties to the dispute cannot resolve by negotiation or other means shall, at the request of one of the Contracting Parties between which the dispute has arisen, be brought to arbitration and handed over to one or more arbitrators chosen by mutual consent of the parties to the dispute. If the Parties to the dispute do not agree on the selection of the arbitrator or arbitrators within three months of the date of the request for arbitration, either Party may request the Secretary-General of the United Nations to appoint one arbitrator to whom the dispute shall be referred for decision.
2. The opinion of the arbitrator or arbitrators appointed in accordance with paragraph 1 of this Article shall be binding on the Parties in dispute.
Reservations
Any State may, at the time of signature of this Agreement or at the time of deposit of the instrument of ratification, acceptance, approval or accession, make a declaration that it does not feel bound by Article 10 of this Agreement.
Procedure for amending the Agreement
1. This Agreement may be amended in accordance with the procedure laid down in this Article, with the exceptions provided for in Articles 13 and 14.
2. At the request of either Party, any proposal to amend this Agreement shall be discussed by the main working group on inland waterway transport of the United Nations Economic Commission for Europe.
3. If the amendment is adopted by a two-thirds majority of the Contracting Parties present and voting, it shall be circulated by the Secretary-General of the United Nations to all Contracting Parties for adoption.
4. Any proposed amendment, notified in accordance with paragraph 3 of this Article, shall enter into force for all Contracting Parties three months after the expiry of the 12 months following the date of its notification, provided that, within the 12 months referred to above, a State which is a Contracting Party has not notified the Secretary-General of the United Nations of its objection to the proposed amendment.
5. Where an objection to the proposed amendment has been notified pursuant to paragraph 4 of this Article, the amendment shall not be deemed to have been accepted and shall not enter into force.
Procedure for amending Annexes I and II
1. Annexes I and II to this Agreement may be amended in accordance with the procedure referred to in this Article.
2. At the request of either Party, any proposal to amend Annexes I and II shall be discussed by the main working group on inland waterway transport of the United Nations Economic Commission for Europe.
3. If the amendment is adopted by a majority of the Contracting Parties present and voting, it shall be circulated by the Secretary-General of the United Nations directly to interested parties for adoption. For the purposes of this Article, a Contracting Party shall be considered to be directly concerned if, in the case of the integration of a new inland waterway or port of international importance or if they are modified, the inland waterway is carried out in its territory or if the port under consideration is situated in that territory.
4. Any proposed amendment, notified in accordance with paragraphs 2 and 3 of this Article, shall be deemed to have been accepted if, within six months of its notification by the depositary, none of the directly interested Contracting Parties has communicated its objections to the proposed amendment to the Secretary-General of the United Nations.
5. Any such amendment adopted shall be notified by the Secretary-General of the United Nations to all Contracting Parties and shall enter into force three months after the date of its notification by the depositary.
6. Where an objection to the proposed amendment has been notified pursuant to paragraph 4 of this Article, the amendment shall not be deemed to have been accepted and shall not enter into force.
7. The Secretariat of the European Economic Commission shall immediately inform the Depositaries of the Contracting Parties directly concerned by the proposed amendment.
Procedure for amending Annex III
1. Annex III to this Agreement may be amended in accordance with the procedure referred to in this Article.
2. At the request of either Party, each proposal to amend Annex III shall be discussed by the main working group on inland waterway transport of the United Nations Economic Commission for Europe.
3. If the amendment is adopted by a majority of the Contracting Parties present and voting, it shall be circulated by the Secretary-General of the United Nations directly to interested parties for adoption.
4. Any proposed amendment notified in accordance with paragraph 3 of this Article shall be deemed to have been accepted if, within six months of its notification, one fifth or more of the Contracting Parties have not notified the Secretary-General of the United Nations of their objections to the proposed amendment.
5. Any amendment adopted in accordance with paragraph 4 of this Article shall be notified by the Secretary-General of the United Nations to all Contracting Parties and shall enter into force three months after the date of its notification to all Contracting Parties, except those which have already notified the Secretary-General of the United Nations of their objections to the proposed amendment within six months of its notification in accordance with paragraph 4 of this Article.
6. Where one fifth or more Contracting Parties have notified their objections to the proposed amendment in accordance with paragraph 4 of this Article, the amendment shall not be deemed to have been accepted and shall not enter into force.
Termination
1. Each Contracting Party may terminate this Agreement by written notification to the Secretary-General of the United Nations.
2. The denunciation shall take effect one year after the date of receipt of that notification by the Secretary-General.
Termination
If, after the entry into force of this Agreement, the number of Contracting Parties is less than five in any period of twelve consecutive months, the Agreement shall expire 12 months after the date on which the fifth State ceased to be a Contracting Party.
Notification and communication of the depositary
In addition to the notifications and communications provided for in this Agreement, the Secretary-General of the United Nations, as depositary, will perform functions under Part VII of the Vienna Convention on the Law of Treaties, negotiated in Vienna on 23 May 1969.
Authentic texts
The original of this Agreement, the texts of which are equally authentic in the English, Russian and French languages, shall be deposited with the Secretary-General of the United Nations.
They have signed this Agreement in evidence of the undersigned and duly authorised to do so.

Annex I
INLAND WATER TRAVEL FOR INTERNATIONAL MARKS
Numbering of inland waterways of international importance
1. All inland waterways of international importance (E waterways) are marked with "E 'followed by two, four or six digits.
2. The main main parts of the water network E have two-digit numbers and their turnovers and second-line turnovers ("turnovers') have four-digit or six-digit numbers.
3. The main water ports, approximately north-south, providing access to maritime ports and connecting one sea area with another have numbers 10, 20, 30, 40 and 50 rising from west to east.
4. The main water magistrates, approximately west-easterly, which cross at least three main magistrates referred to in point 3, have numbers 60, 70, 80 and 90 increasing from north to south.
5. The other main waterways have two-digit numbers between the numbers of the two main municipalities referred to in point 3 or 4 between which they are located.
6. In the case of turbochargers (or turbochargers), the first two or four digits indicate the relevant higher part of the waterway network, and the two subsequent numbers refer to the serial numbers of the particular turbochargers allocated from the beginning to the end of the higher part as described in the table below. Even numbers are used to indicate right-hand and odd turns for left-hand ones.

TECHNICAL AND OPERATING PARAMETERS OF INLAND AQUATIC CEST INTERNATIONAL NOTE
(a) Technical parameters of E waterways
Main technical parameters of waterways E is intended in principle to correspond to the classification of European inland waterways listed in Table 1.
For classifying different waterways E the parameters of Classes IV - VII shall be used according to the following principles:
(i) The waterway class is determined by the horizontal dimensions of the self-propelled ships, boats and pressure assemblies and, in particular, the main standard dimensions, which are the width or the largest transverse dimensions.
(ii) Only waterways which meet at least the essential requirements of Class IV (minimum dimensions of vessels 85 m x 9,5 m) may be considered as E waterways. Dive limitation (less than 2,5 m) and minimum underpass height (less than 5,25 m) are permitted as an exception only in relation to existing waterways.
(iii) When modernising Class IV waterways (as well as small regional waterways), it is recommended to comply with parameters of at least Class Va.
(iv) New waterways E shall correspond to at least the parameters of Class Vb. In this context, it is necessary to ensure the transparency of vessels with submersion of at least 2.8 m.
(v) For the modernisation of existing waterways and for the construction of new waterways, it is always necessary to follow higher values of the dimensions of vessels or assemblies.
(vi) In order to increase the efficiency of container shipments, it is necessary to ensure the maximum possible underpass height in accordance with Note 4 to Table 1.5)
(vii) Inland waterways, which are expected to have an intensive transport of containers and semi-trailers (Ro-Ro system), shall at least comply with the Vb class conditions. In view of the future development of container dimensions and the easy transport of semi-trailers, an increase of 7 - 10% of the width of 11,40 m of vessels for navigation exclusively on inland waterways of class Va and higher classes may also be taken into account.
(viii) On waterways with fluctuating depths of water, the value of the recommended dive refers to a dive, exceeding an average of 240 days per year (or for 60% of the navigation period). Where possible and economically justified, it is necessary to ensure the value of the recommended bridge underpass height (5,25, 7,00 or 9,10 m) at the highest navigational level.
(ix) The same parameters of the class, draught and underpass heights of bridges shall be provided on the whole water path or at least on important sufficiently long sections.
(x) Where possible, it is necessary to ensure that the parameters of adjacent inland waterways are identical or analogous.
(xi) The maximum dive (4,50 m) and the minimum underpass height of bridges (9,10 m) shall be ensured on all sections of the network which directly follow the coastal routes.
(xii) The minimum underpass height of 7,00 m must be ensured on waterways which connect important sea ports to inland areas and which can be successfully used for container and sea transport.
(xiii) Offshore routes listed in the above Annex I ensure the integrity of the entire network of European inland waterways E and its use is envisaged within the meaning of this Agreement for the navigation of vessels of the type "river-sea 'whose dimensions should, as far as possible and economically appropriate, meet the requirements for motor lorries suitable for navigation on inland waterways of classes Va and VIb.
In order to ensure the applicability of the waterway for container transport, the waterway must comply with the following minimum requirements:
- inland waterway vessels with a width of 11,40 m and a length of around 110 m shall allow the transport of containers in three or more layers above them;
- otherwise pressure assemblies of a maximum length of 185 m shall be allowed to sail, with such assemblies allowing the transport of containers in two layers above each other.

Notes to Table 1
1) The first value is given according to the current situation, the second taking into account future changes and, in some cases, the current situation.
2) Taking into account the safe distance, which is about 30 cm between the top point of the structure of the ship or its load and the bottom edge of the bridge structure.
(3) Taking into account the expected future development of the transport of semi-trailers, container shipments and shipments of "river-sea."
(4) The following values are accepted for the transport of containers:
5,25 m - for ships carrying containers in two layers,
7,00 m - for ships carrying containers in three layers,
9,10 m - for ships carrying containers in four layers,
50% of the containers may be empty, otherwise the ship must be packed.
5) Some of the existing waterways may be classified in the IVth class due to the maximum permissible length of the vessel and of the marine formations, although their maximum width is 11,40 m and the maximum dive is 4,00 m.
6) The dive data for a particular waterway must be determined taking into account local conditions.
7) On certain sections of the VII. class waterways, more than one boat may be used. In this case, horizontal dimensions may exceed the values given in the table.
(b) Operating parameters of waterways E
For reliable international transport on waterways E shall correspond to the following main operating parameters:
(i) The voyage must be ensured throughout the entire voyage period, except for breaks listed below.
(ii) The length of the navigation period may be less than 365 days in areas with unfavourable climatic conditions, where it is not possible to provide the fairway free from ice during the winter period and where there is a need for interruption of the voyage. In such cases, the dates of the beginning and end of the interruption shall be fixed. The length of breaks made conditional on natural influences such as frost, high water conditions, etc., shall be minimised by means of appropriate technical and organisational measures.
(iii) The length of the breaks during the navigation period necessary for the regular technical maintenance of lock rooms and other hydrotechnical equipment shall be limited to a minimum. Users of waterways on which technical maintenance work is planned shall be informed of the time limits and duration of the expected breaks. In the event of unexpected disturbances in locks and other hydrotechnical objects or in other cases of force majeure, the length of breaks shall be limited to the maximum by taking the necessary measures to remedy the situation.
(iv) No breaks in low water periods are allowed. In doing so, a reasonable limitation of the permissible immersion values on waterways with changing water states is allowed. Nevertheless, a minimum dive of 1,20 m shall be ensured throughout the period and the value of the recommended or normal dive shall be assured or higher within 240 days of the year. In the areas referred to in sub-point (ii) above, a minimum dive of 1,20 m shall be ensured at 60% of the average navigation period.
(v) The operating hours of lock rooms, mobile bridges and other infrastructure facilities shall be such as to ensure, in the event of economic efficiency, continuous navigation 24 hours on working days. Exceptions to organisational and / or technical causes may be allowed in individual cases. The reasonable time of navigation must also be ensured on holidays and on days of leave.
(c) Technical and operational characteristics of ports E
The E-network includes a system of inland ports of international importance. Each port of E shall comply with the following technical and operational criteria:
(i) It shall be located on the E waterway.
(ii) It shall allow for the handling of ships or pressurised assemblies used on this E waterway in accordance with its class.
(iii) It must be connected to major roads and railway lines (it is desirable that they belong to the network of international roads and railway lines referred to in the European Agreement on Main Road with International Operation (AGR), the European Agreement on Main Railway International Magistrates (AGC) and the European Agreement on the most important routes of international combined transport and related objects (AGTC).
(iv) Its total capacity shall be at least 0,5 million tonnes of goods per year.
(v) It must offer appropriate conditions for the development of the port industrial zone.
(vi) They must ensure handling of standard containers (except ports specialising in bulk handling).
(vii) It shall be equipped with all the equipment necessary for carrying out normal international transport operations.
(viii) In order to ensure environmental protection, facilities for receiving waste generated on board vessels must be located in ports of international importance.
INLAND WATER TRAVEL FOR INTERNATIONAL MARKS
The subsequent maps referred to by inland waterways are set out in accordance with Annex I to the Europe Agreement on main inland waterways of international importance (AGN) of 19 January 1996.
These maps are not part of the AGN Agreement and represent only a geographical illustration of the E waterway network from a documentary point of view.
The labels used in these maps do not imply communication by the United Nations Secretariat of any opinion on the legal status of the country, territory, city or region, or their governments or changes in their borders.
