on the method of establishing specific technical conditions for the purposes of the Public Procurement Act
According to Section 159 (3) of Act No. 137 / 2006 Coll., on Public Procurement, as amended by Act No. 179 / 2010 Coll., ("the Act '), the Ministry of Local Development provides for the implementation of Section 46a of the Act:
Subject matter
This Decree regulates the method of establishing specific technical conditions which take into account the energy and environmental operational impacts of supply contracts for vehicles of categories N1, N2, N3, M1, M2 and M31).
Method for establishing specific technical conditions
(1) The contracting authority shall specify in the procurement documents specific technical conditions by reference to the emission limits in EURO exhaust gases. The vehicle shall comply with at least the EURO emission limits set out in Annex 1 to this Regulation unless the contracting authority provides for a requirement to comply with a higher EURO emission limit standard.
(2) Furthermore, in the case of the supply of N1 and M1 vehicles, the contracting authority shall specify in the specification the maximum fuel consumption (2) for the combined operation (3). The maximum fuel consumption in the case of motor gasoline and diesel fuel determined by the contracting authority shall not exceed the values set out in Annex 2 to this Decree.
Special purpose vehicles and multi-vehicle vehicles
The maximum values set out in Annex 2 to this Decree shall not apply in the case of public supply contracts for vehicles of categories N1 and M1 where they are:
(a) special purpose vehicles (4); or
(b) multi-cephalic vehicles for which at least one alternative fuel is liquefied petroleum gases (LPG), compressed natural gas (CNG), mixed motor fuel containing at least 50% of the biocomponent or clean biofuel.
Transitional provision
This Order shall not apply to procurement procedures initiated before the date of entry into force of this Order.
Efficacy
This Decree shall take effect on the 15th day following its publication.

Council Directive 80 / 1268 / EEC of 16 December 1980 on carbon dioxide emissions and fuel consumption of motor vehicles, as amended by Commission Directive 1999 / 100 / EC and Directive 2004 / 3 / EC of the European Parliament and of the Council.
4) Annex No 1 to Decree No 341 / 2002 Coll., on the approval of technical competence and on technical conditions for the operation of vehicles on the road, as amended.
