GOVERNMENT REGULATION
of 28 April 2008
amending Government Regulation No 154 / 2005 Coll., laying down the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended by Government Regulation No 288 / 2007 Coll.
According to Article 150 (1) of the Act No. 127 / 2005 Coll., on electronic communications and on the amendment of certain related laws (the Act on electronic communications), the Government mandates the implementation of § 24 (5) of the Act on electronic communications and Article II (3) of Act No. 304 / 2007 Coll., amending certain laws in connection with the completion of the transition of terrestrial analogue television to terrestrial digital television:
The Annex to Government Regulation No 154 / 2005 Coll., establishing the amount and method of calculation of fees for the use of radio frequencies and numbers, as amended by Government Regulation No 288 / 2007 Coll., is amended as follows:
1. In Item 1 Part C including footnotes 1 to 3:
C.1. Broadcasting

C = S4 × V2 × K11
where is
C charge for the use of one radio frequency
Note:
In short-wave radio bands, using one radio frequency means the right to use any of the radio frequencies used under an individual radio frequency authorisation.
S4 Rate per radio frequency
S4 = 1 Kč
V Average effective radiated power at the frequency used in dBW at a value rounded to the nearest lower integer. It shall be determined as 1 / 36 of the sum of the permitted radiated power in directions of ten angular degrees starting with zero. For the average effective radiated power is V = 5. In short-wave radio bands V is equal to the output power of the transmitter in dBW.
K11 Type of transmission coefficient:
K11 = 10 Digital radio broadcasting on radio frequencies up to and including 30 MHz
K11 = 15 AM radio transmission
K11 = 30 FM radio transmission
K11 = 30 Digital radio transmission on radio frequencies above 30 MHz
C.2. Television

S4 = 1 Kč

K11 Television broadcasting coefficient
K11 = 50
P1 Coefficient of the type of television broadcasting
P1 = 1 Analog television broadcasting, unless otherwise specified.
P1 = 5 Digital television, unless otherwise specified.
Determination of the P1 coefficient for analogue television broadcasting
If the holder of the radio frequency utilisation authorisation in the geographical area (1) on the date specified in the Government Regulation on the technical road2)
(a) has not turned off the high power transmitter (3), there is a coefficient P1 = 30 in this territorial area;
(b) it has not turned off analogue terrestrial television, in this geographical area the coefficient P1 = 100.
Determination of the P1 coefficient for digital television broadcasting
Until the date of the shutdown of the terrestrial analogue television broadcasting provided for in the Government Decree on the technical transition plan, the coefficient P1 = 1 in the area concerned.
Determination of the fee for digital television broadcasting via a single frequency network
In the case of the dissemination of digital television by a transmitter with maximum effective radiated power (ERPmax) of less than 27 dBW, which is used within a single frequency network, it is always C = 420 CZK.
Note:
For MWS systems (multimedia wireless systems) in the categories MMDS (multi-point multi-channel distribution system), MVDS (multi-channel video distribution system), or LMDS (local multi-point distribution system) in the operational configuration of a point-to-point, provided that radio operation in the system is only one-way, charges shall be charged according to the category of radio service, even if part of the service provided is a single-way data transmission. '
2. in Clause 2, paragraph F.2. read:
"F.2. Fee for access code to virtual non-public telephone networks and virtual non-public communications networks

This Regulation shall enter into force on 15 May 2008.
