DECLARATION
of 8 January 2009
on the content and scope of the qualification for the exercise of physical security and private detective services
According to Section 73a (2) of Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended by Act No. 274 / 2008 Coll., ("the Act '):
Subject matter
This decree regulates
(a) conditions for obtaining professional competence
1. the operation of the licensed business of the surveillance of property and persons and the licensed business of the service of private detectives,
2. an employee of an entrepreneur engaged in the licensed business of the surveillance of property and persons or the licensed business of the service of private detectives,
natural persons after whom the law requires a certificate of professional qualifications for the relevant work,
(b) the method of carrying out the proficiency test to obtain the professional qualification of the person performing the surveillance activities of property and persons or persons performing the activities of private detectives (hereinafter referred to as "the test"); and
(c) the content content of the test.
Conditions for obtaining professional competence
A condition for obtaining professional competence
(a) the operation of the licensed business of the surveillance of property and persons or the licensed business of the service of private detectives; or
(b) the performance of surveillance activities on property and persons or the performance of the activities of private detectives;
for the person referred to in § 1 (a), the test shall be carried out.
Performance of the test
(1) The examination is carried out by an authorized person meeting the conditions under another legislation governing the recognition of further educationresults (1), which is also accredited by the Ministry of Education, Youth and Sports under the Employment Act (2) (hereinafter referred to as the "Authorised Person").
(2) The provisions of another legislation governing the recognition of the results of further education1) shall apply mutatis mutandis to the conduct of the examination, unless otherwise specified.
(3) The test is composed in Czech before the three-member examination committee.
(4) A member of the Examination Board may not be a member of a person who is an employee, a statutory body or a member of a statutory body of the same entrepreneur as the applicant, or an entrepreneur who is the employer of the applicant or for whom the applicant carries out an activity of surveillance of property and persons or of the service of private detectives.
Application for test
(1) The test application shall contain the following information from the applicant:
(a) the name and, where applicable, the names and surnames,
(b) the date of birth;
(c) the address of the place of stay;
(d) the activity for which the performance or operation of the test is sought.
(2) The applicant shall submit the application to the authorised person.
(3) With the applicant's written consent, the application may also be submitted by an entrepreneur operating a licensed business of security of property and persons or by a licensed business of the service of private detectives.
Test content
The content of the test is set out in the qualification and evaluation standards developed under another legislation (1) published in the National Qualifications System.
(a) for the part-qualification of the guard, where the activity of the business or the pursuit of the surveillance activities of assets and persons is carried out; or
(b) for the sub-qualification of a detective associate, when it comes to the pursuit of a business or activity of private detectives.
Further details on the certificate of professional qualifications
(1) An authorised person shall issue a certificate of professional qualification to the applicant who has benefited from the examination, which shall include, in addition to the particulars referred to in another legislation3) the following particulars:
(a) the registration number of the certificate;
(b) the name of the activity corresponding to the subject of the business for which the certificate of professional qualifications is issued.
(2) Certificate of professional qualifications means for the purpose of demonstrating the professional qualification of the applicant for the concession or the responsible representative for the licensed trade
(a) the surveillance of the property and persons certified for the part-qualification of the guard;
(b) the services of private detectives certified for the sub-qualification of Detective Associate,
which is not more than 5 years old, has been issued by an authorised person and fulfils the requirements laid down in paragraph 1.
(3) The certificate of professional qualifications shall be considered for the purpose of demonstrating the professional qualifications of the person referred to in Section 1 (a) (2) for the licensed trade
(a) the surveillance of the property and persons certified for the part-qualification of the guard;
(b) the services of private detectives certified for the sub-qualification of Detective Associate,
which is not more than 10 years old, has been issued by an authorised person and fulfils the requirements laid down in paragraph 1.
Efficacy
This decree shall take effect on the day of its publication.
