Government regulation on the performance of proficiency tests under the munitions law

of 21 May 2025
on the performance of proficiency tests under the Ammo Act
The Government hereby orders pursuant to Paragraph 20 (4) of Act No. 91 / 2024 Coll., on ammunition ("the Act '):
§ 1
Subject matter
This Regulation provides for:
(a) the extent of the applicant's minimum expertise on the issue of higher munitions authorisation;
(b) the scope of the applicant's minimum professional knowledge, competence and skills for the issue of a permit for carrying out a pyrotechnic survey;
(c) the criteria for assessing the results of the applicant for the issue of an ammunition certificate in the proficiency test;
(d) a model application for the applicant's proficiency test for the issue of an ammunition authorisation; and
(e) the test schedule for the applicant's proficiency test for the issue of an ammunition authorisation.
§ 2
Scope of the applicant's minimum expertise
Minimum professional knowledge shall be verified during the examination of the applicant's competence for the issue of a munitions authorisation
(a) regulations governing the treatment of ammunition, the treatment of an inactive munitions object and the performance of the administration on the section governed by the law;
(b) legislation governing foreign trade in military material to the extent that such legislation applies to the cross-border movement, import, export and transit of ammunition;
(c) the provisions of criminal law to the extent that those provisions apply to the unauthorised handling of ammunition;
(d) legislation governing the prevention of major accidents to the extent that those provisions apply to the handling and operation of ammunition storage;
(e) legislation governing the international carriage of dangerous goods by road to the extent that those provisions apply to the transboundary movement, import, export and transit of ammunition and explosives;
(f) legislation governing the handling of explosives within the scope of knowledge of the definition of the concept of explosives, the rules governing the authorisation of the handling of explosives and the safety of the work of explosives and in the explosive environment;
(g) arms management legislation with regard to weapons intended for the shooting, testing or destruction of ammunition and ammunition, in particular with regard to the definition of the concept of ammunition against the concept of ammunition;
(h) ammunition and ammunition design and their breakdown by purpose and use;
(i) the technical definition of explosives and their breakdown by purpose and use;
(j) technical context, risk analysis and security measures;
1. storage of ammunition, ammunition and explosives; and
2. shooting, firing and destruction of ammunition; and
(k) the provision of first aid in the range of cardiopulmonary resuscitation, airway security, bleeding cessation, including the application of strangles and local hemostats, treatment of burns, treatment of fractures and use of bandages techniques and the provision of first aid when unconscious.
§ 3
Written test
(1) The written test of the applicant for a higher munitions authorisation is composed of 50 test questions,
(a) 10 questions are used to verify the knowledge referred to in Article 2 (a);
(b) 4 questions are used to verify knowledge under § 2 (b) to (d);
(c) 4 questions are used to verify knowledge under § 2 (e) and (f);
(d) 4 questions are used to verify knowledge under § 2 (g);
(e) 25 questions are used to verify knowledge under § 2 (h) to (j); and
(f) 3 questions are used to verify knowledge under § 2 (k).
(2) The written test of the applicant for the issue of an ammunition permit to conduct a pyrotechnic survey shall consist of 50 test questions, of which:
(a) 17 questions are used to verify the knowledge referred to in Article 2 (a);
(b) 30 questions are used to verify knowledge under § 2 (h) to (k); and
(c) 3 questions are used to verify knowledge under § 2 (f).
(3) The written test shall be performed by selecting 1 correct response from 3 possible answers for each test question and shall take a maximum of 60 minutes.
§ 4
Oral interview
(1) The oral interview of the applicant for the issue of a higher munitions authorisation is aimed at verifying the knowledge referred to in Section 2.
(2) The oral interview of the applicant for a permit to conduct a pyrotechnic survey shall be aimed at verifying the knowledge referred to in § 2 (a), (c) and (h) to (k).
Criteria for evaluating the results of the applicant for the issue of an ammunition certificate in the proficiency test
§ 5
(1) The applicant for the issue of a higher munitions authorisation is assessed as "benefit" if he correctly answers at least 47 test questions from the written test and subsequently proves knowledge of the oral interview.
(2) In the theoretical part of the test, the applicant for the issue of an ammunition permit for carrying out a pyrotechnic survey shall be assessed as "benefit 'if he correctly answers at least 47 test questions from the written test and subsequently demonstrates knowledge during the oral interview.
(3) If, in the theoretical part of the test, the applicant for the issue of an ammunition permit for carrying out a pyrotechnic survey is assessed by "failed ', the practical part of the test is no longer carried out and the applicant is assessed overall by" failed'.
§ 6
(1) In the practical part of the test, the applicant for the issue of a munitions authorisation for carrying out a pyrotechnic survey shall be assessed as "beneficial 'if he demonstrates the knowledge, abilities and skills referred to in Section 20 (2) of the Act.
(2) The Test Panel shall assess, in the practical part of the examination of the applicant for the issue of an ammunition permit for carrying out a pyrotechnic survey, the degree of "non-profit" if, in the practical part of the test:
(a) fails to demonstrate to a sufficient extent the acts provided for in Article 20 (2) of the Act;
(b) it infringes the principles for the safe handling of ammunition and explosives to such an extent as to jeopardise the safety of persons in practice; or
(c) repeatedly, despite warnings, infringes the principles of safe handling of ammunition and explosives.
§ 7
Overall assessment of the result of the applicant for the issue of an ammunition authorisation for carrying out a pyrotechnic survey in the proficiency test
(1) The overall assessment of the result of the applicant for the issue of an ammunition permit for carrying out a pyrotechnic survey in the proficiency test consists of an evaluation of the theoretical part and the practical part of the test.
(2) Applicants for the issue of a munitions authorisation for the conduct of a pyrotechnic survey are assessed by the test panel by "benefit" if they have achieved "benefit" from both parts of the proficiency test.
§ 8
Model application for the applicant's proficiency test for the issue of a munitions authorisation
The model of the application for the applicant's proficiency test for the issue of the ammunition authorisation is set out in the Annex to this Regulation.
§ 9
Test schedule for the applicant's proficiency test for the issue of an ammunition authorisation
(1) The applicant's proficiency test for the issue of an ammunition authorisation shall be carried out on the site indicated by the Ministry in the invitation for the test. In the case of an applicant's proficiency test for the issue of a munitions authorisation for carrying out a pyrotechnic survey, the test is usually carried out on a permanent tear pit established by the Czech Police.
(2) Before the start of the proficiency test, the applicant shall verify the identity of the test panel for the issue of the ammunition approval.
(3) During the examination of the applicant's professional competence for the issue of a munitions authorisation, it shall be prohibited to use illicit equipment, to leave the place of its conduct or to interfere with its proper conduct.
(4) In an oral interview, the applicant for the issue of a permit shall answer questions asked by the Examination Board without prior preparation.
(5) The practical part of the applicant's proficiency test for the issue of an ammunition permit for carrying out a pyrotechnic survey shall be carried out on the same day as the theoretical part of the proficiency test, unless serious reasons prevent it.
(6) The practical part of the applicant's proficiency test for the issue of an ammunition permit for carrying out a pyrotechnic survey may only be held before a test panel by one applicant at a time.
(7) In the case of infringement of the rules referred to in paragraph 3 and in the cases referred to in Article 6 (2) (b) or (c), the test panel shall immediately terminate the test and the applicant for the issue of the munitions authorisation shall be assessed as "failed '.
(8) In the practical part of the applicant's proficiency test for the issue of a munitions approval for carrying out a pyrotechnic survey, the applicant may use his detection technique approved by the Test Panel or the detection technique provided for the requirements of the Police of the Czech Republic proficiency test.
§ 10
Efficacy
This Regulation shall take effect on 1 January 2026.
