GOVERNMENT REGULATION
of 21 July 2014
amending Government Regulation No 478 / 2009 Coll., laying down certain conditions for granting aid for fruit and vegetables and fruit, vegetable and banana products to children in educational establishments
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Čl. I
Government Regulation No 478 / 2009 Coll., laying down certain conditions for granting aid for fruit and vegetables and products of fruit, vegetables and bananas to children in educational establishments, is amended as follows:
1. in Articles 1, 3 (3) and 3 (9), 4 (2) and (3) and 5 (2), the words "the European Communities" shall be replaced by the words "the European Union."
2. In Section 1, the words "first to fifth years of primary education 3) (hereinafter referred to as" school ") 'are replaced by the words" first grade primary schools, including children from primary education 3) (hereinafter referred to as "first grade') '.
3. footnotes 1 and 2 shall read:
"(1) Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922 / 72, (EEC) No 234 / 79, (EC) No 1037 / 2001 and (EC) No 1234 / 2007, as amended. Commission Regulation (EC) No 288 / 2009 of 7 April 2009 laying down detailed rules for the application of Council Regulation (EC) No 1234 / 2007 as regards Community aid for the supply of fruit and vegetables and fruit, vegetable and banana products to children in educational establishments under the School Fruit Scheme, as amended.
(2) Parts IX to XI of Annex I to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council. ';
4. Paragraph 2 (1), including footnote 4, reads as follows:
"(1) Aid shall be granted for the following products:
(a) fresh fruit and vegetables and, where appropriate, packaged fresh fruit and vegetables listed in Part IX of Annex I to the directly applicable European Union Regulation establishing a common organisation of the markets in agricultural products4), provided that they do not contain the ingredients listed in Annex V to the directly applicable European Union Regulation establishing a common organisation of the markets in agricultural products4), and
(b) packed fruit and vegetable juices and fruit purée, provided that they do not contain the ingredients listed in Annex V directly applicable to the European Union Regulation establishing a common market organisation (4) with agricultural products or preservatives.

footnote 5 is deleted.
5. In Article 2 (2), the words "and fruit purée 'shall be inserted after the word" juice' and the words "basic 'shall be inserted after the word" each'.
6. In Article 2 (3), the words "and fruit purée 'shall be inserted after the words" and vegetables';
7. In Article 2, paragraphs 4 and 5 are added, including footnotes 16 and 17:
"(4) The proportion of products originating in countries outside the European Union during the relevant school year may not exceed 10% of the total number of products delivered to primary schools with which the applicant has concluded product delivery contracts (16).
(5) The aid shall be granted, in addition to the products referred to in paragraph 1, to the extent provided for in the directly applicable European Union17 Regulation, for the following accompanying measures:
(a) excursions to agricultural, horticultural and production, distribution, processing or sale of fruit and vegetables;
(b) expert lectures, educational events and information campaigns on products supplied under the School Fruit and Vegetables Scheme, on healthy eating habits, on environmental protection, on the production, distribution and consumption of fruit and vegetables, with the exception of the establishment and operation of Internet presentations,
(c) fruit and vegetable tasting and fruit and vegetable products;
(d) organising school competitions promoting fruit and vegetable consumption;
(e) participation in health days in primary schools linked to the promotion of fruit and vegetable consumption; or
(f) support for school land equipment, in particular the acquisition of tools, composters or seedlings related to the activities of pupils on school land.

8. In footnote 6, the words "and 8 'are deleted.
9. In Article 3 (3), the word "basic 'shall be inserted after the word" each'.
10. in Article 3 (5), the words "approved applicant" shall be replaced by the words "approved applicant" (hereinafter referred to as "approved applicant") and the words "school registration to the applicant" shall be replaced by "primary school registration to the approved applicant."
11. in Article 3 (6), the words "basic" shall be inserted after the words "first to fifth years" and the words "basic" shall be inserted after the words "declaration."
12. in the first sentence of Article 3 (7), the word "basic" shall be inserted after the word "in."
13. in the second sentence of Article 3 (7), the words "products or accompanying measures" shall be inserted after the words "products"; the words "or accompanying measures" and "9" shall be replaced by "up to 10."
14. in Paragraph 3 (8):
"(8) The provisional monthly limit on products per pupil shall be calculated until the limit referred to in paragraph 9 has been established as a proportion of the total aid for the Czech Republic minus the related costs including the cost of accompanying measures (9) and the total number of children aged 6 to 10 years in the Czech Republic, as specified in the directly applicable European Union7), divided by 10. The Fund shall notify each approved applicant in writing, no later than 1 September of the calendar year concerned, of the minimum number of deliveries of the products for the month of the school year concerned, in accordance with the amount of funding allocated for the school year concerned. ';
15. in Paragraph 3 (9), the words "on products" shall be inserted after the word "limit," the words "on products," the words "first to fifth years of all schools" shall be replaced by the words "first stage of all primary schools" and the words "costs" shall be inserted after the word "including the costs of accompanying measures."
16. In Article 3, the following paragraphs 10 and 11 are inserted after paragraph 9:
"(10) By 1 September of the calendar year concerned, the Fund shall notify each approved applicant in writing of the limit for accompanying measures per pupil for the school year concerned. In setting the limit for accompanying measures, the Fund shall be based on a proportion of not more than 15% of the total aid fixed for the Czech Republic under the directly applicable European Union8) for the relevant school year and the total number of children aged 6 to 10 years in the Czech Republic referred to in the directly applicable European Union7).
(11) The approved applicant shall, by 31 October of the relevant calendar year of the Fund, deliver a plan of accompanying measures with a quantification of the financial intensity and cost of the individual accompanying measures for the school year concerned. By 31 December of the calendar year concerned, the Fund shall notify the approved applicant whether the proposed accompanying measures are eligible for aid. ';
Paragraph 10 shall become paragraph 12.
17. In Section 4, the words "on products' are added.
18. in Article 4 (1) and (2), Article 4 (3) of the introductory part of the provision, Article 4 (3) (b) and Article 4 (4) of the introductory part of the provision, the words "on products" shall be inserted after the word "aid."
19. the word "basic" shall be inserted after the word "into" in. "
20. in Article 4 (3) (a), the words' paper or 'shall be deleted;
21. in Article 4 (3) (b), the words "first to fifth years" shall be replaced by the words "first degree" and the words "paper or" shall be deleted;
22. in Article 4 (4) (c), the word "basic" shall be inserted after the word "notification."
23. The following Section 4a is inserted after Section 4:
„§ 4a
Application for aid for accompanying measures
(1) The authorised applicant shall submit to the Fund an application for support for accompanying measures for a calendar year on a form issued by the Fund within the time limit set by the directly applicable European Union Regulation (11).
(a) from 1 September to 31 December;
(b) from 1 January to 31 March; or
(c) from 1 April to 30 June.
(2) The approved applicant shall accompany the application for aid for accompanying measures
(a) confirmation of the primary school of the accompanying measures carried out, indicating the number of pupils of the first degree who participated in the accompanying measures;
(b) an inventory of the invoices relating to the accompanying measures carried out during the relevant period referred to in paragraph 1 and a copy of the invoices describing the accompanying measure carried out, paid by the approved applicant on the date on which the application for aid was submitted in accordance with the limit laid down in Article 3 (10);
(c) a copy of the statement of work and documents relating to the wage and other costs of the approved applicant relating to the accompanying measure carried out; and
(d) a copy of the bank account statement referred to in Article 3 (4) (b) proving the payment of the invoices for the accompanying measures referred to in (b). ";
24. In footnote 14, "Annex III 'is replaced by" Article 14 and Annex III';
25. in Article 5 (2), the words "basic" shall be inserted after "each" and the words "and vegetables" shall be inserted after the words "basic."

Efficacy
This Regulation shall enter into force on 1 August 2014.
