DECLARATION
of 31 July 2018
amending Decree No 105 / 2008 Coll., on the legal and financial requirements of pupils in military secondary schools, as amended
According to Section 166 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Decree No. 105 / 2008 Coll., on the legal and financial requirements of pupils of military secondary schools, as amended by Decree No. 198 / 2010 Coll. and Decree No. 165 / 2014 Coll., is amended as follows:
1. In Paragraph 2 (1), the last sentence is deleted.
2. In Paragraph 2, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) In the cases provided for in § 3 (3) (b) and (c) and § 4 (2), the Ministry of Defence shall pay the pupil the full amount of the financial value of the diet.
(3) No provision shall be made for a student who does not pay the share of the payment of meals referred to in paragraph 1. "
Paragraph 2 shall become paragraph 4.
3. Paragraph 3 (3), including footnote 11, reads:
"(3) The course is not provided to the student at the time of his absence for teaching at school or school facilities, except for the period for which:
(a) the pupil takes practical classes to which he was sent by the school in the course of his or her education;
(b) the student participates in actions in which he is granted the carriage or reimbursement of travel expenses referred to in Article 15; or
(c) the pupil is provided with health care (11) in the berth part of the crew medical facility of the military health service provider.
11) Paragraph 6 (1) of Decree No. 156 / 2015 Coll., on the conditions for the provision of health services by military providers, on the fields of outpatient care for which an occupational soldier may exercise the freedom to choose a health service provider and on the conditions for the organisation of the performance of tasks of military faculty hospitals (on the conditions for the provision of health services by military providers). "
4. footnote 7 is deleted.
5. In Paragraph 4 (2), the word "service 'is replaced by" service or' and the words "or military rescue service 'are deleted.
6. In Section 4, the following paragraph 4 is added:
"(4) Where a student is conducting practical training with a military service, food supplements B to F shall also be provided for the diet provided for in paragraph 3, according to the complexity of the practical training carried out, under the legislation governing the provision of free meals, equipment and transport equipment and the provision of accommodation for soldiers from the profession (12); the conditions for the provision of food supplements B to F laid down by legislation in accordance with the part of the sentence before the semicolon shall apply mutatis mutandis to the pupil.
12) Decree No. 266 / 1999 Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended. "
7. In Article 5 (1), the second sentence is replaced by the following: "The student who has paid the share of the diet referred to in Article 2 (1) shall be paid in cash for the individual meals to be issued, equal to 60% of the financial value of the allowance for the student referred to in Article 6 (1); at the same time as the allowance for the money, the student shall also be reimbursed in respect of the share of the diet paid by him."
8. in Article 5, the following paragraph 2 is inserted after paragraph 1:
"(2) A pupil who has been entitled to the provision of meals under § 2 (2) but who has not been able to deliver individual meals shall be paid a cash refund equal to 100% of the financial value of the child's allowance under § 6 (1)."
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
9. In the first sentence of Paragraph 11, the words "(b) and 'shall be inserted after the words" (b)'.
Efficacy
This Decision shall enter into force on 1 September 2018.
