amending Decree No. 36 / 2006 Coll., on the verification of the conformity of a copy or a copy with the instrument and on the verification of the authenticity of the signature, as amended
The Ministry of the Interior provides pursuant to Article 21 of Act No. 21 / 2006 Coll., on the Verification of the Compliance of a Copy or Copy with the Charter and on the Verification of the Authenticity of Signature and on the Amendment of Certain Laws (Verification Act), as amended by Act No. 279 / 2019 Coll. and Act No. 261 / 2021 Coll.:

1. In the first sentence of Article 3 (1), the words "on the instrument on which the signature is legalized," shall be deleted.
2. The heading of Section 5 reads: "Marking the verification clause on the list."
3. After Article 5, the following Sections 5a and 5b are inserted:
„§ 5a
Format and formalities of the document in electronic form for which legalisation may be carried out
(1) An electronic document signed by an electronic signature to be legalized (hereinafter referred to as an electronic signature document) must be in PDF / A format and must not exceed 50 MB. In the case of use of PDF / A format in PDF / A-3 and above, the electronic signature document shall not contain a document in a data format which is not an output data format under the legislation governing the management of the file service or a document containing additional documents.
(2) The electronic signature document shall not contain a malicious code which is capable of causing damage to the information system through which the exercise of the public administration contact points (hereinafter referred to as the "information system ') or the software of the public authority contact point is ensured.
(3) The electronic signature in the electronic signature document must be visible unless it is a guaranteed electronic signature based on an electronic signature certificate.
(4) Where an electronic signature document is signed by a guaranteed electronic signature based on an electronic signature certificate, the integrity of that document shall not be infringed.
§ 5b
Procedure for implementing legalisation on a document in electronic form
(1) An electronic signature document complying with the requirements of Section 5a shall be accepted by the Office through the data storage of the electronic application of the information system in a way that allows remote access (hereinafter referred to as "data storage").
(2) The electronic signature document shall be stored in the data repository for the purpose of legalization for a period of 30 days.
(3) On a document with an electronic signature which meets the requirements of § 5a, the validator shall legalize by attaching a verification clause. The connection of the verification clause shall be carried out by the certifying person using the information system by attaching a document in electronic form containing the verification clause and an imprint of the document on which the electronic signature is legalized. The document containing the verification clause shall be signed by the certifying person by his qualified electronic signature and stamped by a qualified electronic time stamp.
(4) Document containing the verification clause of the Authority after the legalisation of the applicant according to its choice
(a) send it to its data box; or
(b) transmit via the data repository; the document containing the verification clause shall be stored in the data repository for a period of 30 days from the date on which the legalisation was carried out. ';
4. In Annex No 1, in the part "Pardubice Region ', point (h), the word" Janovka' is inserted after the word "Chornice '.
5. In Annex No 1, in the part "Pardubice Region ', point (l), the word" Janovka' is deleted.
6. In Annex 3, the words "- the electronic signature on the electronic document shall be inserted after the words" recognised on the instrument itself * '.
7. In Annex 3, the words "* - Qualified electronic signature of the verifier and the qualified electronic time stamp * 'shall be inserted after the words" Copy of the official stamp and signature of the certifying person'.
8. In Annex 4, the words "- the electronic signature on the electronic document shall be inserted after the words" has recognised the signature on the document itself * '.
9. In Annex 4, the words "* - Qualified electronic signature of the certifying person and the qualified electronic time stamp * 'shall be added after the words" Copy of the official stamp and signature of the certifying person'.
10. In Annex 8, the title of column 7 in the right part reads: "The signature on the document has been recognised as own '.
11. In Annex 8, the title of column 9 reads: "Indication of the type of document which is visible or on which the signature is legalized '.
Čl. II
Transitional provision
The verification books kept on 1 July 2022 may be used until 31 December 2023 provided that the amendments referred to in Article I (10) and (11) of this Decree are indicated.
Čl. III
Efficacy
This Decree shall take effect on 1 July 2022.
