DECLARATION
of 20 May 2025
amending Decree No. 210 / 2012 Coll., implementing certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended
The Ministry of Industry and Trade, in agreement with the Ministry of Foreign Affairs, the Ministry of Defence and the Ministry of Interior, provides, pursuant to Section 33 of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended by Act No. 220 / 2009 Coll., Act No. 248 / 2011 Coll. and Act No. 383 / 2022 Coll., ("the Act ') for the implementation of Section 5 (3) of the Act:
Decree No. 210 / 2012 Coll., on the implementation of certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended by Decree No. 85 / 2014 Coll., Decree No. 48 / 2015 Coll., Decree No. 308 / 2016 Coll., Decree No. 171 / 2017 Coll., Decree No. 31 / 2018 Coll., Decree No. 159 / 2019 Coll., Decree No. 346 / 2021 Coll., Decree No. 46 / 2023 Coll. and Decree No. 104 / 2024 Coll., are amended as follows:
1. footnote 1 shall read:
"(1) Directive 2009 / 43 / EC of the European Parliament and of the Council simplifying the conditions for transfers of defence-related products within the Community, as amended by Commission Delegated Directive (EU) 2025 / 290."
2. In Annex 1 to SVMe 1, Note 1 (d), Technical Note, the words "Impaired firearm 'are' are replaced by the words" For the purposes of Note (d), point SVMe 1 is, 'such'.
3. In Annex 1, SVMe 8, Technical Notes
"Technical notes:
1. For the purposes of point SVMe 8, except for point SVMe 8 (c) 11 or SVMe 8 (c) 12., the term mixture shall mean a composition consisting of two or more substances, at least one of which is listed in sub-points SVMe 8.
2. Any substance listed in sub-points SVMe 8 shall be subject to this list, even if used for non-indicated uses. For example, TAGN triaminoguanidinitrate is used primarily as an explosive but can also be used as a fuel or an oxygenant.
3. For the purposes of point SVMe 8, particle size means the mean particle diameter determined on the basis of mass or volume. International standards or equivalent national standards shall apply when taking samples and determining particle size. '

2. Powder, reactive materials' is made, for example, by a process of high energy ball grinding.
3. Forms, reactive materials' are made for example by selective laser sintering. '

5. In Annex No 1 to the SVMe 8, the following Notes 1 and 2 are inserted at the beginning of the Mark:
"Note 1: Any substance listed in the SVMe 8 sub-items is subject to this list, even if it is used for non-indicated applications (for example, TAGN triaminoguanidinitrate is used primarily as an explosive but can also be used as a fuel or an oxygenant).
Note 2: Point SVMe 8 (a) applies to explosive cocrystals'.
Technical Note:
For the purpose of the note in point SVMe 8 (a), the explosive cocrystal is a solid material consisting of a regular three-dimensional arrangement of two or more explosive molecules of explosives, at least one of which is listed in point SVMe 8 (a). ';
Notes 1 to 16 shall be renumbered Notes 3 to 18.
6. In Annex 1, SVMe 8, the following Note 12 is inserted after Note 11:
"Note 12: Point SVMe 8 (d) (3) does not apply to iodide fluoride (CAS 7783-66-6). ';
To date Notes 12 to 18 are renumbered Notes 13 to 19.
7. In Annex 1, SVMe 8, Note 18 is deleted.
Current Note 19 is renumbered Note 18.
8. In Annex 1 to the SVMe 9, the reference "Link: Guidance and navigation equipment see point SVMe 11. 'is replaced by reference 1" Link 1: Guidance and navigation equipment see point SVMe 11.' and the following references 2 and 3 are added:
"Reference 2: Nuclear propulsion systems see SVMe 9 (h).
Reference 3: See also SVMe 1, SVMe 2 and SVMe 4. '
9. in Annex 1 to the SVMe 9 (a) (2) (c), the Technical Notes shall be deleted;
10. in Annex 1, SVMe 9 (a) (2) (c), the heading "Technical Notes:" is replaced by "Technical Note:," Technical Note 1 is replaced by Technical Note 1 "1. For the purposes of point SVMe 9 (a) (2) (c), rinsing or washing system 'means a system capable of spraying the external superstructures and decks of a vessel simultaneously.', Technical Note 2 is deleted and the marking of Technical Note 1 is deleted.
11. in Annex 1, SVMe 9 (a), the following Technical Note is added:
"Technical Note:
For the purposes of point SVMe 9 (a) (2), the protection of CBRN 'means a separate internal space containing e.g. pressurisation, insulation of ventilation systems, limited ventilation outputs with CBRN filters and limited crew entrances containing the decontamination chamber.';
12. in Annex 1, SVMe 9 (b) (4), the technical note shall be:
"Technical Note:
For the purposes of point SVMe 9 (b) (AIP), the propulsion system shall operate without access to atmospheric oxygen for a longer period than the batteries would otherwise allow. ';
13. In Annex 1, SVMe 9, the following Note 2 is inserted after Note 1:
"Note 2: Point SVMe 9 (b) (4) does not apply to nuclear power. ';
Notes 2 and 3 shall be renumbered Notes 3 and 4.
14. in Annex No 1 SVME 9 Note 3 is deleted.
15. In Annex 1, SVMe 9, the following Note 4 is inserted after Note 3:
"Note 4: Point SVMe 9 (f) does not apply to normal propulsion shafts and hydrodynamic hull penetrators with control bar. ';
Note 4 is renumbered Note 5.
16. In Annex 1, SVMe 14, the Technical Note is deleted.
17. In Annex No 1 SVMe 14, the following note 3 is inserted after Note 2:
"Note 3: The term, specialised military training equipment 'includes, for example, military types of attack trainers, combat flight trainers, radar survey trainers, artillery training devices, anti-submarine wartime trainers, flight simulators (including pilot or astronaut training trainers), radar trainers, navigation trainers, missile launch trainers, target visualization equipment, unmanned" aircraft "trainers, unmanned" aircraft "trainers, mobile training units and ground flying training equipment.';
18. In Annex No 1 SVMe 15, the words "and 6A002 (b) 'are replaced by the words", 6A002 (b) and 6A003 (b)'.
19. in Annex 1, SVMe 17 (e) (3), the words "electromagnetic pulse environment" are replaced by the words "environment, electromagnetic pulse";
20. in Annex No 1 SVMe 17 (e) (3) The technical note "Electromagnetic pulse 'is replaced by" For the purposes of point SVMe 17 (e) (3), electromagnetic pulse'.
21. In Annex 1, SVMe 18 (a) and (b):
"(a), Production 'equipment specially designed or modified for, manufacture' of items specified in the EU Common Military List and specially designed components therefor;
(b) Equipment for environmental testing specially designed for the certification, qualification or testing of items listed in the EU Common Military List and specially designed equipment therefor, not specified elsewhere. ';
22. In Annex No 1, in the Definitions of terms used in this list, the entry:
"SVMe 9, 19" Laser "
A device that produces both spatial and time-coherent light by amplification of stimulated radiation emissions. '
is replaced by:
"SVMe 9, 13, 17, 19" Laser "
A device that produces both spatial and time-coherent light by amplification of stimulated radiation emissions. ';
Efficacy
This Decree shall take effect on 5 June 2025.
