Decree of the Ministry of Health and of the Ministry of Agriculture, Forestry and Water, which issue basic conditions for the supply of pharmaceutical products, medical technology products, veterinary biopreparations and certain laboratory preparations

on the issue of basic conditions for the supply of pharmaceutical products, medical technology products, veterinary bio-preparations and certain laboratory preparations
The Ministry of Health and the Ministry of Agriculture, Forestry and Water Management, in agreement with the central authorities involved, and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides for Article 392 of Economic Code No. 109 / 1964 Coll. ("the law '):
Preliminary provisions
§ 1
Scope
This decree regulates deliveries
(a) pharmaceutical and medical products listed in Annex 1;
(b) veterinary biopreparations and laboratory preparations for veterinary, human and other purposes;
However, it shall not apply to supplies for export and from imports.
Supply of products
§ 2
Conclusion of economic contracts
(k § 152 et seq.)
(1) The contracts for the supply of veterinary and laboratory products for veterinary, human and other purposes shall be concluded for annual periods, unless otherwise agreed by the organisation. Supplies of other products shall be covered by contracts for the preparation of supplies for quarterly periods.
(2) The collector shall submit to the supplier a draft contract (order), broken down, where appropriate, into quarters, in the case of veterinary biopreparations and laboratory products no later than 45 days, in the case of glasses, free optics glasses, glasses frames no later than 75 days and in the case of other products no later than 60 days before the beginning of the period in which they are to be started.
§ 3
Quantity
(to Section 175 of the Act)
The quantities of products delivered may deviate from the quantities agreed in the contract for galenic products and immunological products human by ± 10%, for medicinal drugs, vitamin and antibiotic supplements, for vitamin concentrates and for glasses by ± 5%.
§ 4
Minimum dispatch quantity
(to Section 176 of the Act)
The minimum quantities of products are set out in Annex 2.
§ 5
Delivery periods
(k § 187 of the Act)
(1) Monthly deliveries of dental preparations in the quarter may be made only if they exceed 300 packages of one type and shade. Deliveries not reaching 300 packages of one species and shades shall be spread evenly over 2 months and deliveries not reaching 100 packages of one species and shall be delivered once a quarter.
(2) For the supply of vitamin and antibiotic supplements and vitamin concentrates, the supplier is obliged to complete 50% of the monthly supply by the 15th day of each month. Product range is required by the end of each month. For deliveries of up to 7 tonnes, delivery periods may not exceed 30 days for the same consignee.
(3) In the case of supplies of veterinary biopreparations and laboratory preparations whose shelf life is less than 2 months, the organisation is required to negotiate delivery periods with an accuracy of at least 15 days.
(4) If, due to the thermal conditions (frost or heat), a concern about destruction or deterioration of products during transport is justified, the supplier shall draw the attention of the customer and propose a new delivery period. If this cannot be done, organisations shall agree on an appropriate method of transport or other protection of the products supplied.
§ 6
Verification of filling
(to Article 197 of the Law)
(1) If there is no agreement on the complaint within 15 days of receipt of the complaint to the supplier, the customer shall keep one sample taken during the verification of the transaction and send the other samples together with a copy of the registration immediately for an assessment:
(a) for mass-produced medicinal products - the State Institute for Drug Control,
(b) veterinary biopreparations - the Central State Veterinary Institute,
(c) for vitamin and antibiotic supplements and vitamin concentrates - the central control and testing institute for agriculture.
(2) The report is binding on both organisations and applies to the whole sampled lot. If the complaint was justified, the costs associated with the publication of the report shall be borne by the supplier.
(3) If the customer requests a new impeccable performance, he shall return the products of defective quality to the supplier no later than 60 days from the date on which he received the report on the recognition of the claim. If the supplier does not accept the complaint, the customer is obliged to return the products to him no later than 60 days after the date on which the opinion of the State Institute for Drug Control was published in the Disorder Reports issued by the Ministry of Health; if they are veterinary biopreparations, vitamin and antibiotic supplements and vitamin concentrates, the buyer shall return them to the supplier no later than 60 days from the date on which the opinion of the Central State Veterinary Institute or, where appropriate, the Central Control and Examination Institute was received.
§ 7
Guarantee period
(Articles 135 and 198 of the Law)
The warranty period lays down technical standards.
Efficacy
§ 8
This Decree shall take effect on 1 July 1964.
