DECLARATION
of 20 May 2025
amending Decree No 64 / 2005 Coll., on the registration of accidents at children, pupils and students, as amended by Decree No 57 / 2010 Coll.
The Ministry of Education, Youth and Sports provides, pursuant to § 29 (3) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act):
Decree No. 64 / 2005 Coll., on the registration of accidents at children, pupils and students, as amended by Decree No. 57 / 2010 Coll., is amended as follows:
1. Paragraph 1 (1) reads as follows:
"(1) All accidents involving children, pupils and students (hereinafter referred to as" accidents') occurring in the activities referred to in Paragraph 29 (2) of the Education Act shall be recorded in the list of accidents at the latest by the end of the teaching day following the date on which the legal person operating the school or school establishment (hereinafter referred to as "school or educational establishment ') becomes aware of the accident. Where the period referred to in the first sentence expires when a multi-day event takes place outside the place where the education or provision of school services is carried out, entered in the register of schools and educational establishments, the period shall be extended until the end of the teaching day following the end of the event.';
2. In Article 1 (2) (f), the word "signature 'is replaced by the words" name, if any, and surname'.
3. in Article 2 (1) (a), the words "school or school establishment" shall be replaced by the words "teaching" and, at the end of the letter, the words "or" shall be deleted. "
4. In Article 2, at the end of paragraph 1, the dot is replaced by "or 'and the following point (c) is added:
"(c) an accident likely to give rise to a claim for compensation for the pain or compensation for the inconvenience of social application caused by that accident and not referred to in (a) or (b)."
5. In Article 2, paragraphs 3 and 4 are deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 3 and 4.
6. In Article 3 (4), the words "and 4 'are deleted.
7. In Paragraph 4 (1), the text "paragraph 4 'is replaced by" (c)'.
8. In Paragraph 4 (2), "6 'is replaced by" 4'.
9. in Article 4 (4) and (5):
"(4) The record of the accident updated in accordance with § 2 (4) shall be sent by the school or school establishment no later than the fifth day of the following month after updating the Czech School Inspection Centre.
(5) The record of the accident and update of the accident record is transmitted electronically to the Czech School Inspection Office via the Czech School Inspection Information System. The entry or update of the entry referred to in the first sentence shall contain the information set out in the Annex to this Order, except for signatures. ';
Efficacy
This Decree shall take effect on 1 September 2025, with the exception of Articles I (10) and II, which shall take effect on 1 September 2026.
