THE LAW
of 15 May 2009
amending Act No. 107 / 2006 Coll., on unilateral increases in rent from the apartment and amending Act No. 40 / 1964 Coll., Civil Code, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 107 / 2006 Coll., on unilateral increase of rent from the apartment and amending Act No. 40 / 1964 Coll., Civil Code, as amended, is amended as follows:
1. the words "in the cases referred to in the second sentence of Paragraph 3 (1), first on 1 January 2012," shall be added at the end of the text in point (c).
2. In the end of paragraph 1, the sentence "For apartments in the capital city of Prague, in the municipalities of the Central Bohemian Region with population on 1 January 2009 higher than 9999 and in the cities of České Budějovice, Pilsen, Karlovy Vary, Liberec, Hradec Kralove, Pardubice, Jihlava, Brno, Olomouc and Zlín, ends the period when a unilateral increase in rent can be applied by the lessor on 31 December 2012."
3. In Article 3, at the end of paragraph 5, the sentence "In the notice by the lessor of a unilateral increase in rent for the year in which the target value of the monthly rent can be reached under this law, it is sufficient to justify the amount of the rent at the target value of the monthly rent for 1 m2 of floor space."
4. In Section 4, at the end of the text in point (c), the words "except where the publication of maximum monthly rent increases is no longer necessary 'are added.
5. In Article 4, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The latest communication referred to in paragraph 1 will be published and published by 1 July 2009."
6. in Article 8 (2), "31 December 2010 'is replaced by" 31 December 2012';
7. The Annex to the Act reads:

"Attachment to Act No. 107 / 2006 Coll.
Procedure for determining the monthly rental target values per m2 of floor area of the apartment and maximum monthly rental increments
The target value of the monthly rent for 1 m2 of floor space expressed in CZK / m2 is calculated according to the formula
CN = 1 / 12 * p * ZC,
where:
CN is the target value of the monthly rent per m2 of floor area,
ZC is the basic price per m2 of floor area,
p is the coefficient expressing the proportion of annual rent on the basic price of the apartment;
p has a value of:
(a) p = 0,026 for reduced-quality apartments located in the territory of Prague 1 as defined by the communication;
(b) p = 0,0325 for low-quality apartments situated in the territory of Prague 2 as defined by the communication;
(c) p = 0,041 for low-quality apartments located in the territory of Prague 6 as defined by the communication;
(d) p = 0,045 for all other apartments with reduced quality,
(e) p = 0,029 for other flats situated in the territory of Prague 1 as defined by the communication,
(f) p = 0,0365 for other flats situated in the territory of Prague 2 as defined by the communication,
(g) p = 0,046 for other flats situated in the territory of Prague 6 as defined by the communication,
(h) p = 0,05 for all other flats.
The maximum monthly rent increase expressed in% is calculated using the formula
MP = CN / AN4-k + 1-1 * 100
where:
MP is the maximum monthly rent increase expressed in%,
CN is the target value of the monthly rent per m2 of floor area expressed in CZK / m2,
AN is the actual value of the monthly rent for 1 m2 of floor space expressed in CZK / m2,
k is the annual coefficient within the scope of Part One of the Act:
For the period 1 January 2007 to 31 December 2010, where unilateral increases in rent end on 31 December 2010,
k = 1 for the period 1 January 2007 to 31 December 2007, k = 2 for the period 1 January 2008 to 31 December 2008, k = 3 for the period 1 January 2009 to 31 December 2009, k = 4 for the period 1 January 2010 to 31 December 2010.
For the period 1 January 2007 to 31 December 2012, in cases where unilateral increases in rent end on 31 December 2012,
k = 1 for the period from 1 January 2007 to 31 December 2007, k = 2 for the period from 1 January 2008 to 31 December 2008, k = 3 for the period from 1 January 2009 to 31 December 2009, k = 2 for the period from 1 January 2010 to 31 December 2010, k = 3 for the period from 1 January 2011 to 31 December 2011, k = 4 for the period from 1 January 2012 to 31 December 2012. '

Efficacy
This Act shall take effect on 1 June 2009.
