DECLARATION
Czech Mining Office

authorising mining activities and activities carried out in a mining way, as well as the design of objects and equipment forming part of those activities
The Czech Mining Office provides pursuant to § 5 paragraph 2 of the Act of the Czech National Council No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by the Act of the Czech National Council No. 425 / 1990 Coll., Act of the Czech National Council No. 542 / 1991 Coll. and Act No. 169 / 1993 Coll.:
(1) Authorisations for mining and mining activities, as well as for the design and design of objects and equipment which are part of mining or mining activities (hereinafter referred to as "authorisations") may be issued to a legal or natural person who can demonstrate that he is competent by himself or through qualified staff (racing, racing, quarry, mining, mining, mining or main mining meter) to provide activities within the scope of the required authorisation.
(2) The local authority of the district mining office in whose jurisdiction (1) the legal or natural person has its registered office or place of business or residence shall be responsible for issuing the authorisation. If there is no such place on the territory of the Czech Republic, jurisdiction shall be governed by the place of intended activity to which authorisation is required.
(3) The authorisation may be exercised throughout the whole territory of the Czech Republic.
(1) The legal or natural person shall indicate in the application for authorisation:
(a) trade name, (2) name and surname, if any;
(b) registered office, place of business or place of permanent residence or residence, if not permanent residence in the Czech Republic, 3)
(c) identification number and date of birth, if any;
(d) the required subject matter of the activity;
(e) the name, surname, place of permanent residence or, where applicable, residence, if not permanent residence in the Czech Republic, and the date of birth of the factory mine or factory quarry or mining designer or main mining meter, including his certificate of competence for the performance of the activity (6).
(2) The application shall be accompanied by documents and, where appropriate, certified copies by which the legal or natural person proves the facts referred to in paragraph 1.
(3) The qualification and competence requirements are laid down in a specific regulation. 5)
(1) The authorisation shall specify:
(a) the trade name and, where appropriate, the name and surname;
(b) the registered office or, where applicable, the place of business or the place of permanent residence or, where applicable, the place of residence, unless it has permanent residence in the Czech Republic;
(c) identification number and date of birth, if any;
(d) the subject matter of the activity;
(e) the name, surname, place of permanent residence or residence, if any, if they do not have a permanent residence in the Czech Republic, and the date of birth of the factory mine or, where applicable, of the factory mine, of the quarry or of the mining designer or of the main mining meter, including his certificate of competence for the performance of the activity (6);
(f) the date of issue of the authorisation.
(2) The district mining office shall send a copy of the authorisation to the competent tax administrator and to the State Statistics Authority.
(1) The authorisation expires
(a) the expiry of the period of validity, if indicated in the authorisation;
(b) the disappearance of a legal person or the death of a natural person;
(c) the end of the period of validity of the certificate of eligibility for the activity or the termination of an employment relationship or of any other similar ratio of the race mine, or of the racetrack, racing, mining designer or main mining meter, unless the legal or, where appropriate, natural person has concluded a new similar relationship with the competent person at the end of the relationship (6). The Circular Mining Authority may authorise the pursuit of mining or mining activities, as well as the design of objects and equipment which are part of such activities, for a transitional period without such a responsible natural person, provided that this does not endanger the lives and health of people or cause significant damage to property.
(2) The legal or natural person shall notify the Circular Mining Office of any changes to the particulars and documents provided for in the application for authorisation and provide evidence thereof within 15 days of the date of the amendment. A copy of the amendment decision shall be sent by the District Mining Office to the authorities referred to in Article 3 (2).
Legal or natural persons who have been authorised before the date of application of this Order and who do not comply with its requirements may apply for a new authorisation under that Order within one year of that date, otherwise the authorisation shall cease to be valid.
This Decree shall take effect on 1 March 1995.
