Czech National Council
of 21 December 1992
on the Army of the Czech Republic and on amendments and additions to certain related laws
The Czech National Council decided on this law:
Czech Army
(1) Other budgetary organisations and contribution organisations existing at the date of the disappearance of the Czech and Slovak Federal Republic under the responsibility of the Federal Ministry of Defence in the Czech Republic are hereby established. Organisations set up under the first sentence may be changed or cancelled by the Ministry of Defence of the Czech Republic as the founder under generally binding legislation.
(2) State-owned enterprises established by the Federal Ministry of Defence based in the Czech Republic with the right to manage the property of the Czech and Slovak Federal Republic, which under the Constitutional Act on the division of assets of the Czech and Slovak Federal Republic between the Czech Republic and the Slovak Republic and its transition to the Czech Republic and the Slovak Republic are considered to be established by the Ministry of Defence of the Czech Republic.
The status of soldiers of the Czechoslovak army who, at the date of its demise, are members of the military services and facilities referred to in § 2 or members of the other budgetary organisations, contribution organisations and state enterprises referred to in § 3 shall not cease to exist and shall become members of the Czech Army in the reached military rank.
(1) Civil servants of the Federal Ministry of Defence become civil servants of the Ministry of Defence of the Czech Republic.
(2) Civil servants of the Czechoslovak army who are in employment with the military services and facilities referred to in § 2 and other budgetary organisations referred to in § 3 (1) become civil servants of the Army of the Czech Republic.
(3) Civil servants of the Czechoslovak army who are in employment with the contribution organisations referred to in § 3 (1) remain civil servants of these organisations.
Amendment and addition of Act of the Czech National Council No. 550 / 1991 Coll., on General Health Insurance, as amended
The Act of the Czech National Council No. 550 / 1991 Coll., on General Health Insurance, as amended by the Act of the Czech National Council No. 592 / 1992 Coll. and the Act of the Czech National Council No. 10 / 1993 Coll., is amended as follows:
1. In Paragraph 10, the following paragraph 2 is inserted after paragraph 1:
"(2) Active-duty soldiers and pupils of military schools who prepare for the service of an occupational soldier and are not active-duty soldiers are insured with the Military Health Insurance Agency. The basic health care is provided to them by the crew of the health care facility and, if not established, by another health facility with which the Military Insurance Office has concluded a health care contract. Follow-up outpatient or constitutional care is provided by a medical facility designated by a doctor who provided basic health care. Physicians may be elected only within the medical institution referred to in sentence two and three. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
2. In Article 10, paragraph 2, the words "compulsory military or 'shall be deleted.
Amendment and addition of Act of the Czech National Council No. 592 / 1992 Coll., on Insurance for General Health Insurance
The Act of the Czech National Council No. 592 / 1992 Coll., on Insurance for General Health Insurance, is amended as follows:
1. In Paragraph 5 (3), the words "if the insured person has chosen it 'are replaced by" where the insured person is insured'.
2. footnote 20 shall read:
"20) § 10 paragraphs 1 and 2 and § 11 (a) to (c) of the ČNR Act No. 550 / 1991 Coll., as amended by the ČNR Act No. 592 / 1992 Coll., the ČNR Act No. 10 / 1993 Coll. and the ČNR Act No. 15 / 1993 Coll."
3. In Paragraph 27 (1), the following sentence is added at the end: "The Military Health Insurance Corporation shall communicate the necessary information to keep the register of all its insured persons taking into account the manner in which the general health insurance register is kept and the need to protect classified information. '.
Common, transitional and final provisions
If, by 31 January 1993, an occupational soldier or a soldier on another duty applies for discharge, he shall be released at his own request in accordance with the provisions in force until 31 December 1992.2)
(1) The service of civil servants of the Czech Republic in the Army of the Slovak Republic is not considered to be a foreign military service until 31 March 1993. 3)
(2) A military oath carried out until 31 December 1992 by citizens of the Czech Republic under existing legislation is considered to be a military oath undertaken by the Czech Republic.
(3) The soldiers referred to in Section 14 are required to carry out a military oath within one month of the date of the grant of citizenship of the Czech Republic.
Citizens of the Slovak Republic who are soldiers in the occupation of the Army of the Czech Republic at the date of application of this Act may carry out this service until 31 March 1993. After that date, they may serve in the Army of the Czech Republic if they prove that they have applied for release from the Union of Citizenship of the Slovak Republic, until the date of processing of the application for citizenship of the Czech Republic, but no later than 31 December 1993.
Efficacy
This Law shall take effect on 1 January 1993.
