Budget Act 1954
of 10 March 1954
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
State budget objectives.
The State budget is the basic financial plan of the State. All the funds it provides for the implementation of the national economic development plan stem from the construction work of the working people. They should therefore be managed in such a way that the planned construction tasks are met, with the minimum cost, thereby ensuring the use of funds to further develop the production and growth of national income, to ensure security and to continuously increase the physical and cultural level of the working people and to support efforts to maintain peace.
§ 2.
Determination of the amount of the State budget.
(1) The total revenue of the state budget is estimated at CZK 87.803.121.000, the total expenditure is fixed at CZK 87.572,954.000, resulting in a surplus of CZK 230.167.000.
(2) The national budget shall contain the budgets of the national committees whose revenue and expenditure amount to CZK 14.880,517.000; In addition, the balance of the budget of the national committees, moving up to 1955, amounts to CZK 275,495.600.
(3) In order to balance the budgets of the national committees, the Government sets out the percentage shares in State revenue.
§ 3.
Government budget management.
(1) Expenditure incurred by economic and budgetary organisations, whether investment or non-investment, may be carried out only within the limits of the amounts planned in the State budget or in the financial plans for economic organisations.
(2) The Government may authorise the execution of the necessary expenditure, not covered by the State budget, provided that it provides for its reimbursement by way of higher revenue or by way of the removal of other, less urgent expenditure. However, in so doing, appropriations intended for investment, overhaul and personal expenditure may not be used to cover other expenditure.
(3) National Committees shall manage their balanced budgets.
§ 4.
Responsibility of the government and its members.
The government and each member of the government shall be responsible in the management of the State for ensuring that all planned tasks are met economically, that the revenue amounts of the State budget are at least attained and that the expenditure amounts are not exceeded, except in cases permitted under this law.
§ 5.
Timely use of appropriations.
(1) Budget appropriations may be used only by the end of 1954, only to cover expenditure due by the end of that year.
(2) The reimbursement of expenditure which they have and may impose on the budget for 1954 under the provisions of this law must not be deferred to the next year's budget.
(3) Referring money to cover commitments arising after 31 December 1954 or forming any other reserve for savings on appropriations is not permitted.
§ 6.
Detection of budgetary implications for legal and other measures.
For the draft laws, the laws of the Slovak National Council, the government regulations, the ministerial regulations and the regulations of the board of delegates (the mandates regulation), the government resolutions, the resolutions of the board of delegates, the decrees and all other measures of the central authorities, the consequences of their economic and financial consequences must be considered with the greatest responsibility. The implications of these measures for State budget expenditure or revenue should be quantified and the calculation added to the draft measure. If the nature of the proposed measure permits the introduction of new revenue, this new revenue must always be proposed.
§ 7.
Burden of state budgets for years to come.
(1) Any measure which exceeds the approved state budget in time and which, by its consequences, is burdensome or could be burdensome by state budgets in the years to come, such as the expansion of offices and public authorities, the establishment, after the extension of other facilities, the conclusion of new lease contracts, the issue of new periodical press and long-term orders, of new or higher costs for the Treasury, must be subject to prior approval if such measures would result in a new or higher cost.
(2) Such measures may be approved by the Central Authority or made in the field of its own competence if, under other regulations, the approval of the State Systemisation Commission is not required and if the expected cost does not exceed, on a case-by-case basis, the amount of CZK 50,000 per year and the total of all cases, the amount of CZK 800,000 per year. In other cases, approval of the Ministry of Finance is required.
(3) The resolution by which the national committee takes over a commitment burdensome to the budgets of the next year or subsequent years, or other exceptional economic measures, requires, in principle, the approval of the monitoring national committee (the Office). The guidelines of the Minister of Finance (Section 10) will provide for details.
§ 8.
Inadmissibility to set off claims against the State.
The debtor may not pay his obligation to the State by offsetting his claim on the State.
§ 9.
Provisional management of state management in 1955.
(1) The Government shall take appropriate measures for the State's management between 1 January 1955 and the publication of the budgetary act for 1955, but not later than 31 March 1955, unless the budgetary act for that year is declared before 1 January 1955, mutatis mutandis to the principles of the State Budget Rules for 1954.
(2) The revenue and expenditure for the duration of the provisional management of the State's management is to be definitively settled on the State budget for 1955, following the publication of the Budget Act for 1955.
§ 10.
Final provisions.
The Minister of Finance shall issue more detailed guidelines for the management and control of the State budget, in particular as regards the use of budgetary appropriations, the reimbursement of expenditure on new tasks imposed on the national committees, the tying of budgetary appropriations to cover the tasks that have been lost and the procedure for the reimbursement of expenditure on tasks not fully secured by the budget. In doing so, the Minister of Finance may allow a derogation from the provisions of Paragraph 5 (1).
§ 11.
Efficiency.
This Law shall take effect on 1 January 1954; by the Minister for Finance and other members of the Government.
