DECLARATION
of 11 June 2019
amending Decree No. 101 / 1995 Coll., published by the Order on the Health of Persons in the Operation of Railways and Rail Transport, as amended
The Ministry of Transport provides, pursuant to § 66 paragraphs 1 and 2 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 319 / 2016 Coll., for implementation of § 45 paragraph 3, § 46d paragraph 2 and § 46f paragraph 3:
Decree No. 101 / 1995 Coll., published by the Order on the Health of Persons in the Operation of Railways and Rail Transport, as amended by Decree No. 455 / 2000 Coll., Decree No. 194 / 2005 Coll., Decree No. 305 / 2007 Coll., Decree No. 16 / 2012 Coll., Decree No. 33 / 2013 Coll. and Decree No. 129 / 2017 Coll., is amended as follows:
1. In the introductory sentence, "and § 48 (1)," is replaced by ", § 46d (2) and § 46f (3) a."
2. In the introductory sentence, the words "and in agreement with the Ministry of the Interior pursuant to Paragraph 66 (3) 'are deleted.
3. At the end of the introductory sentence, the words "as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 319 / 2016 Coll. 'are added.
(4) Paragraph 3, including footnotes 1 and 2, shall be deleted.
5. in Article 4 (1) (a) (2), the part of the sentence after the semicolon, including the semicolon, is deleted;
6. In Article 4 (1) (b), the part of the sentence after the semicolon, including the semicolon, is deleted.
7. In Paragraph 4 (1), the comma at the end of point (c) is replaced by a dot and point (d) is deleted.
8. in Article 5 (2) (b), the words "indicative testing for the presence of psychoactive substances" shall be inserted after the words "glycemia."
9. In Article 6 (1), the comma at the end of point (b) is replaced by a dot and point (c) is deleted.
10. in Article 6 (2), the first sentence is deleted;
11. in Article 6, paragraph 4 is deleted;
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
12. in Article 6 (4), the words "otherwise provided" shall be replaced by the words "a shorter period of validity";
13. in Article 6, paragraph 5 is deleted;
14. Article 7, including footnotes 8 and 9, shall be deleted.
15. in Annex 1 (A.) (1) (c):
"(c) diabetes mellitus if it causes such health complications which are dangerous to traffic on the track, in particular:
1. a second and other hypoglycaemia which occurs within 12 months of the first hypoglycaemia and which must be managed by another person, or
2. a second and other hypoglycaemia which occurs within 12 months of the first hypoglycaemia and which the applicant is unable to recognise ("non-recognition syndrome"). "
16. in Annex 1 (A.) (1) (v):
"(v) visual acuity in a better eye of less than 1,0 and in a worse eye of less than 0,5, even using corrective lenses,"
17. In Annex 1 (A.) (1), the following points (w) and (x) are inserted after point (v):
"(w) intolerance to corrective lenses if necessary to achieve visual acuity,
(x) achieving the minimum visual acuity referred to in (v) using glasses with a force exceeding the spherical equivalent of + 5 / -8 dioptrie, ';
Point (w) shall be renumbered as point (y).
18. In Annex 1, Part A. (2), the following point (q) is inserted after point (p):
"(q) conditions related to diabetes mellitus, namely:
1. condition within 12 months of the first hypoglycaemia requiring the help of the other person,
2. Severe organ complications,
3. Treatment of medicines that carry the risk of causing hypoglycaemia and there has been no hypoglycaemia requiring the assistance of another person in the previous 12 months, there are no medical complications associated with diabetes mellitus and the applicant
is aware of the hypoglycaemia or its warning symptoms,
ii. is able to demonstrate regular measurement of glycemia, which is performed at least twice daily at the time of driving; and
iii. proves that it understands the risks posed by hypoglycaemia; the method of demonstration shall be recorded by the doctor in the medical file of the person under assessment; ';
Point (q) shall be renumbered as point (r).
19. in Annex 1 (B) (1) (r):
"(r) visual acuity in a better eye of less than 1,0 and in a worse eye of less than 0,5 using corrective lenses,"
20. in Annex 1, Part B. (1), the following points (s) and (t) are inserted after point (r):
"(s) intolerance to corrective lenses if necessary to achieve visual acuity;
(t) reaching the minimum visual acuity referred to in (r) using glasses with a force exceeding the spherical equivalent of + 5 / -8 dioptriae, ';
Point (s) shall be renumbered as point (u).
21. in Annex No 1, Part B. (2) (d), "5 / 15 or 6 / 18" is replaced by "0,5."
22. In Annex 1, Part C. and D., including the headings:
"C. Conditions of medical fitness of applicants for a licence to drive a railway vehicle and persons driving a railway vehicle on a trams track, trolleybus track and applications for a licence to drive a cableway track and persons driving a cableway track at entry preventive medical examinations
1. Defects, conditions and diseases that make medical incapacity conditional on
(a) the diseases referred to in point 1 (a) - (s) of Part A of this Annex;
(b) binocular visual acuity, even using corrective lenses, of less than 0,5;
(c) visual acuity in a better eye of less than 0,8 and in a worse eye of less than 0,1, even using corrective lenses;
(d) intolerance to corrective lenses if necessary to achieve visual acuity;
(e) achieving the minimum visual acuity referred to in (b) or (c) using glasses with a force exceeding the spherical equivalent + 8 dioptrias;
(f) a horizontal field of vision of both eyes of less than 160 degrees, at the same time a range of less than 70 degrees to the left and right,
(g) a vertical field of view of less than 30 degrees upwards and downwards;
(h) changes in the central field of vision up to 30 degrees;
(i) diplopia;
(j) severe disturbance of contrast sensitivity;
(k) hearing loss above 30% (according to Fowler); the applicant or persons driving a railway vehicle with a hearing loss of more than 30% may be recognised as being fit to drive a railway vehicle if they are able to understand speech within a distance of at least 5 m, including by means of a medical device;
(l) body height less than 150 cm.
2. Defects, conditions and illnesses which require expert assessment and for which the positive assessment conclusion is subject to expert judgement
(a) all diseases listed in Part A (2) of this Annex, unless otherwise specified below;
(b) binocular visual acuity less than 0,7 using corrective lenses;
(c) visual acuity of less than 1,0 at complete functional loss of vision on one eye or in the case of use of only one eye, for example in the case of diplopia, and this condition lasts for more than 6 months;
(d) change in the field of vision;
(e) eye and eye adnex diseases, if they cause a reduction in visual acuity or change the range of visual field referred to in (b), (c) or (d);
(f) severe colour disorder,
(g) visual disturbance;
(h) visual disturbance in the dark,
(i) a body height of less than 160 cm, provided that the driver drives a vehicle with special technical equipment enabling the vehicle to be safely operated.
D. Conditions of medical fitness of persons driving a railway vehicle on a tram, trolleybus and cableway tracks during regular and exceptional preventive medical examinations
1. Defects, conditions and diseases that make medical incapacity conditional on
(a) all diseases referred to in point 1 (a) - (o) of Part B of this Annex;
(b) binocular visual acuity, even using corrective lenses, of less than 0,5;
(c) visual acuity in a better eye of less than 0,8 and in a worse eye of less than 0,1, even using corrective lenses;
(d) intolerance to corrective lenses if necessary to achieve visual acuity;
(e) achieving the minimum visual acuity referred to in (b) or (c) using glasses with a force exceeding the spherical equivalent + 8 dioptrias;
(f) a horizontal field of vision of both eyes of less than 160 degrees, at the same time a range of less than 70 degrees to the left and right,
(g) a vertical field of view of less than 30 degrees upwards and downwards;
(h) changes in the central field of vision up to 30 degrees;
(i) diplopia;
(j) severe disturbance of contrast sensitivity;
(k) hearing loss above 30% (according to Fowler); persons driving a railway vehicle with a hearing loss of more than 30% may be recognised as fit to drive a railway vehicle if they are able to understand speech at least up to 5 m, including by means of a medical device.
2. Defects, conditions and illnesses which require expert assessment and for which the positive assessment conclusion is subject to expert judgement
(a) the diseases listed in Part A (2) of this Annex, unless otherwise specified below;
(b) diseases referred to in point 1 (i) - (l) of Part A of this Annex, hemoralopia;
(c) hypertension, except for uncomplicated or non-serious conditions where the medical assessor has carried out a professional examination;
(d) pupil reaction disorder;
(e) severe colour disorder,
(f) visual disturbance;
(g) visual disturbance in the dark,
(h) hearing disorders which prevent speech from communicating over a distance of less than 5 m by each ear or, in an audiometric examination, total hearing loss greater than 20% (according to Fowler). "
23. In Annex No 2, Part A. (1) (b), "5 / 15 or 6 / 18 'is replaced by" 0,5' and "5 / 10 or 6 / 12 'is replaced by" 0,3'.
24. In Annex 2, Part A. (1) (b), the part of the sentence after the second semicolon, including the semicolon, is deleted.
25. In Annex No 2, Part B. (1) (b), "5 / 15 or 6 / 18 'is replaced by" 0,5'.
26. In Annex No 2, Part B, point 1 (b), the part of the sentence after the second semicolon, including the semicolon, is deleted.
27. In Annex No 2, Part B. (2) (d), "5 / 15 or 6 / 18 'is replaced by" 0,5'.
28. In Annex No 2, Part C., point 1 (b), "5 / 15 or 6 / 18 'is replaced by" 0,5' and "5 / 10 or 6 / 12 'is replaced by" 0,3'.
29. In Annex 2, Part C, point 1 (b), the part of the sentence after the second semicolon, including the semicolon, is deleted.
30. In Annex No 2, Part C., point 2 (d), "5 / 15 or 6 / 18 'is replaced by" 0,5'.
31. in Annex 2 (D. 1 (b), "5 / 15 or 6 / 18" is replaced by "0,5."
32. In Annex No 2 (D) (2) (d), "5 / 15 or 6 / 18 'is replaced by" 0,5'.
Efficacy
This Regulation shall enter into force on 1 July 2019.
