DECLARATION
of 31 May 2024
on construction requirements
According to Article 333 (1) of Act No. 283 / 2021 Coll., the Ministry of Local Development provides for the construction law, as amended by Act No. 152 / 2023 Coll., ("the Act ') to be implemented by § 152 (1) of the Act:
INTRODUCTORY PROVISIONS
Subject matter
This decree provides for a detailed
(a) land delimitation requirements;
(b) requirements for the location of buildings; and
(c) technical requirements for buildings.
(1) The requirements contained in Parts Two to Four shall apply to all types of construction and equipment, unless otherwise specified in Part Five.
(2) If parts of the building serve different purposes, these parts are assessed separately.
Basic concepts
For the purposes of this decree:
(a) a universal standard apartment, the arrangement of which takes into account the needs of persons using compensatory walking aids in which all rooms meet the universal standard;
(b) a living room or part of a living room with a minimum area of 8 m2 which meets the requirements for housing and where the predominant residence of persons is envisaged;
(c) a residence room, or part of a residence room, which, by its disposition, fulfils the conditions for persons to be present;
(d) accommodation unit
1. a single room or a set of rooms which meet, and are intended for, the requirements for transitional accommodation by their technical design and equipment; or
2. accommodation unit in buildings for social services.
(e) building for the education and training of a parent school with the exception of the background of a school of the forest and a school of the forest, the construction of childcare facilities of the pre-school age, except for the area in which the childcare service is provided, the construction of a primary school, a primary school of art and language with the right of the national language examination, secondary school, conservatory, higher vocational school, educational institution for interest education, education and accommodation, educational establishment for the exercise of constitutional education or protective education, including facilities for children requiring immediate assistance;
(f) sanitary facilities indoor spaces and cabins of washrooms, showers, toilets and changing cabins;
(g) parking space for parking or unsetting of the vehicle;
(h) understand the area intended for the stay or movement of persons by plane, stairs or inclined ramp; Each step of the stairs and levelling step shall also be considered to be an area;
(i) free passage of the flue gas cavity through the flue gas route to the ambient air;
(j) the standard referred to in Annex 14 to this Decree,
(k) building for social services building a home for people with disabilities, a home for seniors, a home with special regime, a protected housing, a halfway house, a halfway house and a care facility.
For the purposes of this decree for the water works sector:
(a) waste water treatment plants and equipment for the treatment of waste water with mechanical, biological or other stages of treatment; dry cleaners are not considered to be equipment for gross pre-treatment of waste water, septic tanks, sinks and simple devices with mechanical function which are not regularly monitored and operated,
(b) by the design flow rate of water used for the design of the water works and its parts with the required periodicity;
(c) a design flood wave theoretical flood wave determined by the flow of water, volume and time course of the wave with a frequency corresponding to the periodicity of the design flow.
For the purposes of this decree for the field of construction for the performance of forest functions:
(a) construction for the performance of forest construction of forest roads, construction on other forest transport routes, construction of byproducts and drains, and construction for the treatment of forest land water regime;
(b) a reinforced road-based dedicated communication intended for the transport of forests and their links with other roads used for forest transport, for the implementation of rescue and disposal operations by the integrated rescue system and for the protection of the State;
(c) by paying for byproducts and drains of buildings for the prevention or reduction of flood damage or accelerated erosion in the water catchment areas, in byproducts and in drains;
(d) a sharp water flow with small water catchment areas, sudden and significant changes in flow and steep flow waves which deepen the bottom of the bristle, undercut the slope at the foot, form shore tanks and significantly and irregularly move the drains, temporarily store them in gravel benches and deposits at the bottom of the bristle, in the flooded area or carry them into the water flows of higher order and water tanks;
(e) tear down the natural terrain body, groove or pothole, created by excessive concentrated erosion by the activity of concentrated surface water effluent;
(f) other routes for forest transport, non-road routes, in particular road haulage and technology lines;
(g) construction of a water treatment system for forest land under another legislation.
For the purposes of this Decree for the field of construction for agriculture:
(a) construction for livestock, construction or assembly of structures for animals for breeding, fattening, work and other economic purposes;
(b) an accompanying building for livestock, a construction for the drying and storage of hay and straw, a construction for the storage of manure, a construction for the concentration of liquid waste and a construction for the preservation and storage of silage and silage;
(c) a manual storage of the construction, part of the construction or separate room intended for storage of plant protection products and aids with a maximum permissible weight of up to 1 000 kg.
REQUIREMENTS FOR DETERMINATION OF OBSERVATIONS
Parking spaces
(1) For the construction or use of the land, with the exception of those temporary for a maximum period of 1 year, parking spaces shall be designed and carried out in accordance with Annex 1 to this Decree.
(2) Parking spaces must be designed and carried out as part of the construction, as an operationally inseparable part of the construction or on the site of the construction, provided that the restrictions resulting from the protective measures provided for under other legislation1 do not prevent this.
(3) If parking spaces cannot be designed as part of the construction or on the building site, they must be designed and carried out on the property at a distance of up to 300 m. The distance shall be measured as the shortest link between the construction and the land on which the parking spaces will be designed and carried out.
(4) On short-term parking spaces, reserved parking spaces shall be designed and carried for vehicles marked with a parking pass identifying a person with a severe disability and reserved parking spaces for vehicles of persons accompanying a child in a pram at least as set out in Annex 1 to this Regulation. Reserved seats shall meet accessibility requirements.
(5) According to the type and purpose of civil engineering, there are parking places for bicycles.
Collision water management
(1) The construction must be designed and carried out in such a way as to meet the requirements for the management of precipitation waters and the capture of pollution of precipitation waters in accordance with the standard.
(2) The construction must be designed and carried out in such a way that the effluent does not endanger the site of the construction and surrounding area.
(3) The management of precipitation water must be designed and carried out with regard to the link of precipitation water with vegetation, if technically possible.
Public spaces
(1) The smallest width of the public area, which includes the infrastructure leading to the residential property, must be 12 m; in one-way operation, the minimum width shall be 10,5 m. The minimum width of the newly defined public area, which includes the infrastructure leading to the property of the family home, shall be 8 m; in one-way operation the minimum width shall be 6,5 m.
(2) An intention in the public area must be designed and carried out in such a way that it respects the natural and safe movement of pedestrians and does not interfere in the passage space along the guide line.
(3) If the planting strip is defined in the street space, it shall be at least 1 m wide.
(4) The spatial parameters of the technical infrastructure networks shall be designed and implemented in such a way as to respect the protection of trees, crops and vegetation areas. The design of the planting belt shall be designed and implemented in such a way as to respect the spatial layout of the technical infrastructure networks.
Land for housing and buildings for family recreation
(1) In addition to building for housing and buildings for family recreation, the building and facilities related to or contingent on the function of housing and family recreation may also be located on the property of the building for family recreation and the landscaping necessary for the proper and safe use of the land and buildings and their facilities.
(2) One building for business activities of up to 40 m2 of built-up area and 5 m of height with a maximum of 1 above-ground floor and 1 underground floor can be placed on the property of the family house; paragraph 1 shall be without prejudice to this.
REQUIREMENTS FOR CONSTRUCTION EMISSIONS
Location of the building with regard to the building line and the property border
(1) The construction is located in accordance with a construction line determined according to the prevailing nature of the installation and its relation to the public space.
(2) The location of the building shall not prevent the future installation of the adjacent plot or the existing installation of the adjacent plot. The construction must be located at least 2 m from the border of the property except the public area.
(3) Paragraph 2 shall not apply,
(a) if the construction is up to 2 m high,
(b) the construction of infrastructure, railways, waterways and air structures, technical and green infrastructure networks; or
(c) where such a method of installation is normal, it shall correspond to the nature of the territory or shall result from the method of parking.
(4) If the construction is located on the boundary of the plot, there must be no building openings in the wall of the building oriented towards the boundary of the plot; This does not apply to the location of the construction on the border with the public land. The construction must be located in such a way as to prevent precipitation and snow fall from the building to the adjacent plot.
(5) The construction line may, in accordance with the character of the installation, exceed the preset parts of the construction in such a way as to respect the nature of the territory and the quality of the environment.
(6) The preset parts of the construction must not jeopardise the use of public spaces. The height of their position above the ground and above the connecting part of the pavement in a width of 0,5 m shall be at least 4,95 m.
Technical infrastructure
(1) Technical infrastructure networks shall be located under the terrain in a built-up area and area.
(2) Paragraph 1 shall not apply to the location of an electrical power line with a voltage level of 110 kV or more and to overhead masts and public communications network equipment.
(3) Technical infrastructure networks for temporary construction of construction site facilities, replacement energy and public communications networks can be placed above the terrain as temporary construction.
(4) The spatial layout of the technical infrastructure networks shall be designed and carried out in such a way as to meet the horizontal driving distances, vertical crossing distances and the level of coverage so as to avoid the occurrence of safety or other risks.
(5) The piping and cable lines are placed in a housing at the point of crossing with unprepared boulders and placed at least 1.4 m below the surface of the bed bed; This does not apply in the case of an opinion of the water flow manager allowing another technical solution. If a groove is designed and made for the pipe or cable line at the crossing point with an unprepared bridle, it shall be filled with powder and, after compaction, fitted at the bottom and in the slopes of the bridle by fortification.
(6) The masts of electrical power overhead lines and overhead lines of electronic communications networks are designed and implemented at a distance of at least 6 m from the shore line of the chassis.
Fencing or other fencing of land
(1) Fences or other fences require land with construction,
(a) which may have an adverse effect on the environment2), in particular construction for the production of dirt, sewage treatment plant or rendering plant;
(b) where the free movement of persons or animals must be avoided;
(c) which must be protected against the effects of the action, in particular the construction for food production; or
(d) which must be protected against the entry of unauthorised persons.
(2) The fencing or other fencing of the plot shall not, by its parameters, restrict the view at the point of exit connecting the construction to the road communication including the crossroads and threaten the safety of persons, road users and animals.
(3) In flood areas, the type of fencing or fencing of the plot and the material used shall not impair the course of the flood, the parts of fencing of the plot shall be easily dismantled, without a solid suspicion and shall allow for the easy passage of flood flows.
Construction site
(1) The site is designed and implemented in such a way that its operation
(a) does not endanger the life and health of persons or animals;
(b) did not bother the surroundings above the limit values laid down by other legislation3);
(c) does not jeopardise road safety;
(d) does not pollute infrastructure, air and water; and
(e) allow access to adjacent buildings or land, technical infrastructure networks and fire facilities.
(2) The construction site and, where appropriate, its separate workplaces must be appropriately separated from adjacent land and buildings according to the type of construction. On the site of the building, which is a cultural monument, in conservation reserves or in conservation zones, in natural parks or specially protected areas, including their protection zones, only construction of construction sites which are not linked to the country can be established with a solid foundation.
(3) Pots adjacent to public spaces and pedestrian roads shall be secured against the fall of persons with reduced mobility or orientation. The lines over these excavations and bypassing routes shall meet the accessibility requirements.
Advertising equipment
Advertising equipment placed on
(a) the buildings must conform to their architectural character and must not interfere with the basic structure of the building and its significant details;
(b) the roof of the buildings shall not exceed the highest level of the roof and its total height shall not exceed 2 m; and
(c) fences or at a distance from fences equal to the height of the advertising equipment shall not exceed the fencing height by more than 20%.
TECHNICAL REQUIREMENTS FOR CONSTRUCTION
Technical requirements for construction
Requirements for mechanical resistance and stability of construction
Mechanical resistance and stability
The construction must be designed and constructed in such a way as to withstand foreseeable effects. Construction structures shall be designed and carried out in accordance with the standard.
Building
(1) The creation of the building must be designed and carried out in a manner consistent with the basic ratios established by the survey of the ground conditions at the site of the construction.
(2) The construction is established in such a way that its stability is not jeopardised and surrounding land and buildings are not threatened.
(3) Underground construction structures separating the interior space of the building from the surrounding environment or from the foundations, including gradients, shall be protected against adverse effects of groundwater, moisture or other adverse effects, taking into account the design parameters of the internal environment.
The floor level of the living room shall be at least 0,15 m above the highest level of adjacent treated terrain in the 5 m range from the perimeter wall of the building with a illuminating hole and 1 m from the perimeter wall of the building without a lighting aperture and at least 0,5 m above the ground water level, unless the room is protected from unwanted exposure by other means.
Health and environmental requirements
Ventilation
(1) The construction must have sufficient natural, forced or combined ventilation according to its purpose of use, unless otherwise provided in Annex 2 to this Decree.
(2) According to its purpose of use, the construction must ensure the quality of internal air with the possibility of regulation, unless Annex 2 to this Decree provides otherwise.
(3) The residential building room for education and education must be ventilated. Other ventilation requirements are laid down in another legislation. The central dressing room of children and pupils without natural ventilation must be ventilated under pressure with air exchange.
(4) The quantity of ventilation air using specific design values shall be determined in accordance with Annex 2 to this Regulation.
Lighting, fame and shielding
(1) The interior of the building shall be designed and constructed in such a way as to ensure its daily illumination according to the purpose of use of the construction. The daily lighting requirements for building living rooms for education and training are laid down in another legislation.
(2) The space of beds in a medical facility, the living room in the building for social services and construction for the purposes of the Prison Service of the Czech Republic must be designed and implemented in such a way as to ensure their electrical lighting.
(3) The living room in the building for social services and the nursery, with the exception of the facilities of the forest nursery school and the forest nursery school dispensary, must be designed and carried out in such a way as to ensure their notoriety.
(4) The construction is designed and carried out with regard to the eclipsing of the residential and residential rooms of the existing building affected by the proposed construction, with the exception of the living room in the housing and apartment building on the underground floor.
(5) The requirement in paragraph 4 shall not apply to construction works in the building gap. In construction in the building gap, the proposed shielding is compared with the shielding that would trigger the construction, the parameters of which would correspond to a complete continuous build-up of the same height level as the surrounding installation and possibly other criteria with regard to the construction line.
(6) When calculating daylight and combined lighting, notoriety and shielding, shielding shall be assessed according to the current state of the surrounding area and the changes in the territory, in particular under the terms of decisions or other measures issued under building law or other legislation or under a regulatory plan or zoning plan with elements of the regulatory plan if they are issued for that territory.
Noise and vibration protection
(1) The construction must be designed and carried out in such a way as to meet the hygiene limits of noise and vibrations laid down by other legislation4), 5).
(2) The built-in technical equipment and its manifolds causing noise and vibration must be designed and carried out in a building with living rooms and in a building for social services in such a way as to reduce the transmission of noise and vibration to the construction structure, in particular to the protected internal space of the building. The living room is designed and executed to ensure its protection from noise.
(3) The internal construction of buildings and the circumferential casing, including the aperture filler, shall be designed and carried out in such a way as to meet the requirements for the parameters of sound insulation protecting the interior of buildings from noise and vibration.
Thermal protection of buildings
(1) The building must be designed and implemented in such a way as to ensure:
(a) its thermal protection;
(b) the lowest internal surface temperature;
(c) total airflow of the envelope of the building,
(d) room thermal stability during the summer period;
(e) protection against:
1. penetration of water into the building and its structures;
2. the spreading of moisture in the structures and in the internal environment of the construction.
(2) The building must be further designed and constructed to avoid increasing the volume activity of radon.
Release of hazardous substances into water or soil
In the construction area where regular handling of soil and surface or groundwater quality substances is envisaged, floor structures and handling surfaces shall be secured against the penetration of these substances into the ground.
Limitation of the undesirable effects of outdoor lighting
The construction of non-public purpose communications, outdoor workplaces, outdoor sports grounds and advertising facilities with a total area of more than 8 m2 shall be designed and implemented in such a way as to ensure that the adverse effects of outdoor lighting are reduced. The first sentence shall be used mutatis mutandis to illuminate the facade of buildings.
Municipal waste
(1) The construction by type and purpose must be equipped with a room or a place for concentrating municipal waste located on the site of the construction. The room or location for the concentration of municipal waste shall correspond in terms of capacity to the purpose of the construction.
(2) In the case of a set of structures, a common unit may be established for the concentration of municipal waste at a distance of up to 300 m.
(3) The room or location for the concentration of municipal waste shall meet the accessibility requirements. This does not apply to the construction of a family house and to the construction for family recreation.
Safety and accessibility requirements
Lightning protection
(1) The protection of the building against lightning must be designed and implemented in:
(a) the manufacture and storage of explosive and flammable substances, liquids, gases, explosives, in the case of a munitions warehouse, including an open site, shelter and handling site (nimi6); and
(b) above-ground construction or, in the case of the above-ground parts of a dedicated gas technical installation, pursuant to the Act on ensuring further conditions of safety and health at work in connection with operations.
(2) In cases not covered by paragraph 1, lightning protection shall be designed and carried out where lightning could cause life or health risks to persons or animals, in particular in the case of buildings for housing and civil engineering, or where it could cause significant damage.
(3) The construction is designed and usually carried out by a ground ground ground grounding system.
(4) For the cases referred to in paragraphs 1 and 2, appropriate protective measures shall be proposed and carried out, in particular protection areas shall be designed and carried out on the basis of the actual physical dimensions of the metallic intake system. When designing and implementing lightning protection, it is necessary to assess and maintain sufficient distance or safe distance.
Protection against falling ice, snow and water
The construction must be designed and carried out in such a way that it does not jeopardise adjacent communication and the adjacent understands the areas of ice, snow and water.
Protection against floods and heavy precipitation
(1) In the flood area, outside the active zone,
(a) the construction of a building below the level of the level at the time of repeated flooding 100 years (Q100) is designed and carried out in such a way as to withstand the effects of water and ice during the flood and to allow smooth flow;
