on emission limits and other conditions for the operation of combustion stationary air pollution sources
The Government orders pursuant to § 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll. and Act No. 385 / 2005 Coll., hereinafter "the Act ':
Subject matter
(1) This Regulation (1) implements the relevant provisions of the European Community2) and regulates specific emission limits and conditions for the operation of combustion stationary sources of air pollution (hereinafter referred to as "combustion sources").
(2) This Regulation shall not apply to combustion sources:
(a) in which the gases are used for direct heating, drying, burning or other heat treatment of articles or materials, in particular heating furnaces or heat treatment furnaces;
(b) for additional combustion, intended for the treatment of waste gases by incineration, if they are not operated as independent combustion sources;
(c) for the regeneration of catalysts;
(d) for the processing of sulphate into sulphur;
(e) reactors used in the chemical industry;
(f) for heating coke-oven batteries;
(g) intended exclusively for the incineration of waste;
(h) blast furnace heaters;
(i) gas turbines located on platforms.
Basic concepts
For the purposes of this Regulation:
(a) the degree of desulphurisation of the sulphur mass ratio separated from the sulphur content of the combustion source in a given period of time to the sulphur content of the fuel introduced into the combustion source and burned in the same period of time;
(b) biomass product consisting wholly or partly of plant material originating in agriculture or forestry and which may be used as a fuel to obtain its energy content and the following waste used as fuel:
1. plant waste from agriculture or forestry;
2. plant waste from the food industry, provided that the heat produced is recovered;
3. plant waste from the production of fresh fibre and pulp paper, where co-incineration is carried out at the place of production and the heat generated is recovered;
4. waste cork,
5. wood waste, except wood waste, which may contain halogenated organic compounds or heavy metals as a result of treatment with wood-protection substances or coatings, including, in particular, wood waste of this type derived from construction and demolition wastes;
(c) a source for the combustion of several types of fuels, in which two or more types of fuels may be fired simultaneously or alternately;
(d) by gas turbine, any rotary machine that transforms kinetic energy into mechanical work, including primarily a compressor, a device in which the fuel to heat the working medium is oxidized, and a turbine.
Emission limits and conditions for their fulfilment
(1) The emission limits for particularly large combustion sources pursuant to Article 54 (7) of the Act, determined according to the rated heat output for sulphur dioxide, nitrogen oxides and solid pollutants, are set out in point A of Annex 1 to this Regulation. The emission limits for particularly large combustion sources pursuant to Section 54 (8) of the Act, determined according to the rated heat input of the source for sulphur dioxide, nitrogen oxides and solid pollutants, are set out in point B of Annex 1 to this Regulation. The emission limits for particularly large combustion sources pursuant to Section 54 (6) of the Act, determined according to the rated heat input of the source for sulphur dioxide, nitrogen oxides and solid pollutants, are set out in point C of Annex 1 to this Regulation.
(2) Paragraph 1 shall not apply to gas turbines if they are particularly large combustion sources pursuant to § 54 (7) and (8) of the Act. For these gas turbines, emission limits shall be determined according to the flue gas volume flow in Annex 5 to this Regulation.
(3) The emission limits for particularly large combustion sources established for carbon monoxide are set out in Annex 2 to this Regulation.
(4) Emission limits for solid pollutants, sulphur dioxide, nitrogen oxides and carbon monoxide for particularly large combustion sources under Paragraph 54 (6) of the Act are deemed to be met if no valid daily average exceeds the emission limits set out in Annexes 1 and 2 to this Regulation, while 95% of the applicable hourly averages or all valid half-hour averages do not exceed 200% of the emission limits set out in Annexes 1 and 2 to this Regulation.
(5) For particularly large combustion sources where the emission limits for sulphur dioxide set out in Annex 1 to this Regulation cannot be met due to fuel properties, the combustion source shall fulfil at least the desulphurisation level set out in Annex 3 to this Regulation. The required desulphurisation rates shall be considered to be met if the evaluation of the measurements made shows that all mean values of the desulphurisation rate for a given calendar month have reached the required degree.
(6) The emission limits for large and medium combustion sources established according to the rated heat output of the source for sulphur dioxide, nitrogen oxides, solid pollutants, organic substances and carbon monoxide are set out in Annex 4 to this Regulation. For stationary internal combustion piston engines, emission limits are set from 0,2 MW of rated heat output depending on their rated thermal input. For gas turbines, emission limits shall be determined according to the flue gas volume flow in Annex 5 to this Regulation.
(7) For multi-fuel sources, the emission limits shall be determined by the calculation set out in Annex 6 to this Regulation. Burning multiple types of fuels is not considered to be a flame stabilization.
Conditions for the operation of combustion sources burning wood, plywood, fibreboard or other glued wood
Wood pulp, plywood, fibreboard or other bonded wood which must not contain halogenated organic compounds or heavy metals as a result of treatment with wood protection substances or surface treatment may only be incinerated in a particularly large or large combustion source. Where these fuels are produced as by-product of production, they may also be burned in a medium combustion source equipped with automatic fuel dosing and automatic combustion process control. In such a case, the conditions of operation for a large combustion source shall apply to this medium combustion source.
Conditions for the operation of small combustion sources
A small combustion source shall be operated with the required fuel burning efficiency and with the permissible concentration of carbon monoxide in the flue gas set out in Annex 7 to this Regulation.
Transitional provisions
(1) For particularly large combustion sources pursuant to § 54 (7) and (8) of the Act, burning solid fuels whose rated thermal input is 400 MW or more and which will not be operating more than 2000 hours per year until 31 December 2015 and from 1 January 2016, with an annual number of hours calculated from a rolling average over 5 years, the sulphur dioxide emission limit shall be 800 mg.m- 3
(2) For particularly large combustion sources pursuant to § 54 (7) and (8) of the Act, burning solid fuels with a volatile fuel content of less than 10% which have been in operation for at least 12 months before 1 January 2001, the emission limit of 1200 mg.m- 3 shall apply until 1 January 2018 for nitrogen oxides.
(3) For particularly large combustion sources pursuant to Section 54 (8) of the Act, burning solid fuels whose nominal thermal input is 500 MW or higher and which will not be operational more than 1500 hours per year from 1 January 2016, the annual number of hours calculated from the rolling average over 5 years, the emission limit for nitrogen oxides is 450 mg.m- 3
Repeal
Government Regulation No 352 / 2002 Coll., setting emission limits and other conditions for the operation of combustion stationary sources of air pollution, is repealed.
Efficacy
This Regulation shall enter into force on 1 January 2008.

EMISSIONS LIMITS FOR THE EXTENSION RESOURCES FOR SODIUM OXIDE (SO2), DESIGN OXIDES (NOx) AND DILUTION SUBSTANCES (TZL)
A. Emission limits for particularly large combustion sources under Section 54 (7) of the Act, with the exception of gas turbines
1. The emission limits given in the table shall apply to individual combustion sources according to their rated heat output.
2. From 1 January 2008, at the same time as the obligation set out in point 1, combustion sources under Section 54 (7) of the Act must comply with the emission reduction plan for the combustion source as part of the National programme for reducing emissions of solid pollutants, sulphur dioxide, nitrogen oxides from existing particularly large combustion stationary sources under Section 54 (7) of the Act. This programme shall include air protection bodies established by emission ceilings based on the limits referred to in point B.
3. For solid fuels, emission limits are 6% relative to the reference oxygen content and for liquid and gaseous fuels emission limits are 3% relative to the reference oxygen content.
4. If the emission limit cannot be reached when domestic fuel is burned in fluidised boilers, the concentration must be reduced to at least 25% of the original value.

B. Emission limits for particularly large combustion sources pursuant to Paragraph 54 (8) of the Act, except gas turbines
1. The emission limits for combustion sources for which a building permit was issued from 1 July 1987 to 31 December 2002 relate to the total heat input of a particularly large combustion source.
2. For solid fuels, emission limits are 6% relative to the reference oxygen content and for liquid and gaseous fuels emission limits are 3% relative to the reference oxygen content.

C. Emission limits for particularly large combustion sources pursuant to § 54 (6) of the Act
(1) The emission limits for combustion sources to which a building permit has been issued since 1 January 2003 relate to the total heat input of a particularly large combustion source.
2. In addition to the emission limits set for gas turbines, emission limits are 6% for solid fuels and 3% for liquid and gaseous fuels.
3. The emission limit value of nitric oxide and nitrogen dioxide expressed as nitrogen dioxide in the combustion of gaseous fuels in gas turbines expressed by the limit mass concentration of nitrogen dioxide in dry flue gases with 15% oxygen on normal state conditions and dry gas is 75 mg / m3 in the following cases:
- gas turbines used for combined heat and electricity production with a total efficiency exceeding 75%
- gas turbines in combined cycle sources with an annual average overall electrical efficiency exceeding 55%;
- gas turbines for mechanical propulsion (gas turbines powered by compressors for gas supply to the public)
For gas turbines not falling within any of the above categories but having an efficiency greater than 35% (under the terms of the International Organisation for Standardisation of ISO), the emission limit of nitrogen dioxide (oxygen content 15%) is based on normal state conditions and dry gas 50 mg / m3 (35% in those cases where the emission limit is expressed as a percentage and determined as ISO conditions).

2) The reference oxygen content of 15% applies to gas turbines.

EMISSIONS LIMITS FOR GREAT AND MIDDLE COLLECTING RESOURCES FOR SIMULTIAL OXIDE (SO2), OXIDES OF DIOXIDES (NOX, EXPORTED AS NO2)
1. Emission limits for large and medium combustion sources by type of fuel fired and type of furnace
1.1. Emission limits for the combustion of solid fuels and solid fuels containing synthetic binders are related to the reference oxygen content 6%, for biomass combustion 11%, for the combustion of liquid and gaseous fuels at the reference oxygen content 3%.
1.2. The emission limits for each individual source refer to the heat output of a large or medium combustion source.
1.3. The degree of desulphurisation of 75%, if it is not possible to reach the emission limit when burning domestic fuel in fluidised boilers with a load additive, must be reduced to at least 25% of the original value.
1.4. The emission limits of fluidised boilers with a rated heat output of less than 5 MWt are the same as the emission limits of conventional boilers depending on the type of fuel fired.

(2) The sulphur content of the fuel shall not exceed the limit values contained in another legislation setting out fuel quality requirements in terms of air protection. In diesel fuel the sulphur content shall not exceed 0,05% by weight. In biogas, landfill, sludge and pyrolysis gas, the sulphur content shall not exceed 2200 mg.m-3 in conversion to the methane content, or 60 mg.MJ-1 in the fuel.

3. Emission limits for combustion sources - hot air heaters for heating
3.1. For the purposes of this Regulation, the following definitions apply: The source of air pollution is a set of all heat and air auxiliary sources which can be brought into a single design in accordance with Section 4 (7) of the Act.
3.2. Only natural gas and / or propane, butane or their mixtures, or unleaded liquid fuels with a sulphur content up to 0,05% by weight, shall be allowed to be incinerated, according to the type of fuel specified by the combustion source manufacturer, and / or unleaded liquid fuels with a sulphur content up to 0,05% by weight, in addition to the technical conditions laid down by the combustion source manufacturer.
3.3. The emission limits for air-conditioned space heaters shall correspond to the emission limits set for large and medium combustion sources in point 1 of this Annex, but shall refer to normal state conditions and dry gas at a reference oxygen content of 17% and shall be determined according to the combustion source category.
4. Emission limits for the configuration of combustion sources - gas turbines integrated with boilers and the conditions for their determination
4.1. If a combustion boiler is classified after the gas turbine without heating or heating the same fuel up to 20 per cent of the gas turbine thermal input, the same emission limits and reference conditions shall apply to this configuration as for gas turbines in Annex 5.
4.2. In the case where a combustion boiler with heating of another fuel or its thermal input exceeds the gas turbine heat input by using the same fuel, the emission limit and the reference oxygen content shall be determined by the weighted average of the limit values set out in Annex 5 and the limit values set out in point 1 of this Annex, according to the proportion of the gas turbine heat input and the heating boiler.
4.3. The heat input of the source is determined by calculation of calorific value and the amount of fuel consumed. For this purpose the minimum calorific value declared by its manufacturer shall be used. If not stated, the sum of the calorific values of the fuel components whose average content is determined by an accredited laboratory by analysing the fuel used shall be determined.

EMISSIONS LIMITS FOR GAS TURBINS
The emission limits given in the table apply to gas turbines which are particularly large combustion sources pursuant to § 54 (7) and (8) of the Act and to gas turbines which are large and medium-sized sources
Notes:
1) When burning coal suspensions and energy gases from private distribution networks; for the combustion of liquid fuels and heating gases from public distribution networks, the emission limit shall be the degree of darkness of the smoke according to the Bacharach scale, which shall not exceed level 4 at all operating conditions.
2) When burning coal suspensions and energy gases from private distribution networks; for the combustion of liquid fuels and heating gases from public distribution networks, the emission limit shall be the degree of darkness of the smoke according to the Bacharach scale, which shall not exceed the second degree of blackness during continuous operation and the third degree when driving.
3. Emission limit 650 mg.m-3 applies to gas turbines operated for less than 100 hours per year.

EMISSIONS LIMITS FOR RESOURCES FOR THE COLLECTION OF MORE FIELD SPECIES
1. For a source using at the same time two or more types of fuels, emission limits shall be determined as follows:
(a) first, by assigning an emission limit value corresponding to each individual fuel and pollutant, depending on the rated heat input of the source;
(b) secondly, by determining the weighted value of the emission limits of each type of fuel, by multiplying the individual emission limits by the heat input of each fuel and dividing this product by the sum of the heat input of all fuels,
(c) third, the weighted limit values for each fuel shall be added together.
2. For a multi-fuel source where residues from the distillation and processing of oil are used separately or with other types of fuel for own consumption, notwithstanding the provisions of point 1, the fuel rules with the highest emission limit shall apply if, during the operation of the source, the contribution of that fuel to the sum of the heat inputs supplied by all fuels is at least 50%. If the ratio of the standard fuel is less than 50%, the emission limit shall be determined on the basis of the relative share of the heat input secured by each fuel on the sum of the heat input of all fuels as follows:
(a) first, by assigning an emission limit value corresponding to each fuel and corresponding pollutant, depending on the rated heat input of the source;
(b) second, the emission limit value for the standard fuel (the fuel with the highest emission limit value and, in the case of two types of fuels with the same emission limit value, the higher thermal input fuel) is calculated; This value is obtained by multiplying the emission limit of the fuel in question by two and subtracting from this product the emission limit value of the fuel with the lowest emission limit,
(c) third, the weighted emission limit values for each fuel shall be determined by multiplying the calculated emission limit by the heat input of the standard fuel, and the other individual emission limit values shall be multiplied by the heat input supplied by each fuel and the result of the multiplication shall be divided by the sum of the heat input delivered by all fuels;
(d) fourth, the weighted emission limits for each fuel shall be added together.
3. As an alternative to point 2, the following average emission limits for sulphur dioxide (regardless of the fuel combination used) may be used:
(a) for resources put into service before 27 November 2003, including on average 1000 mg / m3 for all such resources within the refinery;
(b) for sources put into service after 27 November 2003, an average of 600 mg / m3 for all such sources within a refinery, excluding gas turbines.
4. The use of other types of fuel when driving and stabilising a source is not considered to be burning several types of fuel.

2. Carbon monoxide concentration limits
Each small combustion source (boiler) shall burn the fuel specified by the combustion source manufacturer in such a way that the calculated concentration of COref in the flue gas does not exceed the maximum permitted quantity according to the following table.
