DECLARATION

of 23 May 2023

amending Decree No. 16 / 2006 Coll., implementing certain provisions of the Organic Agriculture Act, as amended by Decree No. 80 / 2012 Coll.

The Ministry of Agriculture provides pursuant to Article 35 of Act No. 242 / 2000 Coll., on Organic Agriculture and amending Act No. 368 / 1992 Coll., on Administrative Charges, as amended, as amended, as amended by Act No. 320 / 2002 Coll., Act No. 553 / 2005 Coll., Act No. 344 / 2011 Coll. and Act No. 247 / 2022 Coll., ("the Act ') for implementation of Sections 4 (1), 14 (2) and 23 of the Act:

Decree No. 16 / 2006 Coll., implementing certain provisions of the Organic Agriculture Act, as amended by Decree No. 80 / 2012 Coll., is amended as follows:

1. footnote 2 shall read:

"(2) Regulation (EU) 2018 / 848 of the European Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation (EC) No 834 / 2007, as amended. ';

2. footnote 3 is deleted, including the footnote reference.

3. In Section 2, the words "rabbits, poultry, fish and central European ecotypes of honey bees' are replaced by the words" jelenovite4), rabbits, poultry, fish, aquaculture animals, honey bees and insects intended for human consumption or for the production of processed animal protein '.

"(4) Paragraph 2 (1) (w) of Act No 154 / 2000 Coll., on the Breeding, Breeding and Registration of Animals and on the Amendment of Certain Related Laws (Breeding Act), as amended."

4. Article 3 shall be deleted, including the title;

„§ 4

Insect breeding

(Paragraph 14 (2) of the Law)

(1) Insects intended for human consumption or for the production of processed animal protein may only be kept in substrates derived from organic production. The use of substrates and feed of animal origin is prohibited.

(2) Insects intended for human consumption or for the production of processed animal protein must be placed in a box or container without access to the open space in order to avoid leakage.

(3) For the purpose of breeding, breeding of non-organic insects may be supplemented for the purpose of genetic regeneration of populations. The weight of non-organic breeding insects for each species shall not exceed 0,5% of the total weight of organic production per species and calendar year.

(4) Insects not derived from organic production shall be considered organic if, for the transitional period referred to in paragraph 5, it has been kept separate from other insects. The transitional period shall begin not earlier than after the inclusion of insects in the insect production unit.

(5) A transitional period is provided for insects intended for human consumption or for the production of processed animal protein per generation from egg to egg.

(6) Construction elements of the breeding establishment

(a) must be made of materials which insects cannot use as a food source; or

(b) they must consist exclusively of materials which insects may use as a food source and which satisfy the feed requirements applicable in organic farming. "

6. In Section 6, the text "paragraph 2 'is deleted.

7. In Article 6, the text "No 2 'is deleted.

8. Annex No 1 is deleted.

Annex No 2 to date shall be renumbered as an Annex.

9. the Annex shall read as follows:
