Government Decree on the prohibition of flights between the Czech Republic and the Federal Republic of Yugoslavia

GOVERNMENT REGULATION
of 22 December 1999
prohibiting flights between the Czech Republic and the Federal Republic of Yugoslavia
The Government hereby orders pursuant to Article 1 of Act No. 304 / 1999 Coll., on measures relating to the Federal Republic of Yugoslavia:
This Regulation shall mean:
(a) by the Yugoslav air carrier:
1. a natural or legal person authorised to operate an aircraft having its registered office or principal place of business in the territory of the Federal Republic of Yugoslavia;
2. another person directly or indirectly controlled by the person referred to in point 1;
(b) any civil aircraft to be used for commercial or private purposes.
(1) Departure from the Czech Republic or landing in the Czech Republic is prohibited
(a) any aircraft registered in the Federal Republic of Yugoslavia, unless it is legally located in the territory of the Czech Republic on the date of application of this Regulation;
(b) any aircraft whose activities are controlled by the Yugoslav air carrier;
(c) any civil aircraft arriving from or departing from the Federal Republic of Yugoslavia, regardless of a possible stopover, except for the landing of returning aircraft of a Czech carrier, if it left the territory of the Federal Republic of Yugoslavia before the date of application of this Regulation.
(2) It is hereby suspended.
(a) all existing authorisations to provide scheduled air services between any point in the territory of the Czech Republic and any point in the territory of the Federal Republic of Yugoslavia; and
(b) all chartered flights still issued between any point in the territory of the Czech Republic and any point in the territory of the Federal Republic of Yugoslavia;
and no new shall be awarded.
(3) No new or renewed existing operating authorisations may be granted to allow any aircraft registered in the Federal Republic of Yugoslavia, or whose activities are controlled by the Yugoslav air carrier, to depart or to arrive in the Czech Republic.
(4) It shall be prohibited to participate in any activity which aims to circumvent the provisions of paragraphs 1 to 3.
Paragraph 2 shall not apply to emergency landing and subsequent departure.
(1) The Ministry of Transport and Communications may, with the approval of the Ministry of Foreign Affairs in individual cases, authorise an exemption from the provisions of Paragraph 2 (1) if it is established that the flight is to serve solely humanitarian purposes.
(2) The Ministry of Transport and Communications may, with the approval of the Ministry of Foreign Affairs, authorise a flight or group of flights between the territory of the Czech Republic and the territory of the Federal Republic of Yugoslavia if the aircraft to be used:
(a) is not registered in the Federal Republic of Yugoslavia and is operated by "Montenegro Airlines" or by another carrier which is not a Yugoslav air carrier; or
(b) is registered in the Federal Republic of Yugoslavia and is listed in the Annex to this Regulation either as an aircraft used by the Government of Montenegro or by the competent authorities designated by the United Nations Secretary-General for the Provinces of Kosovo for non-commercial purposes, or as an aircraft used by "Montenegro Airlines" for commercial purposes.
This Regulation shall enter into force on the day of its publication.
