DECLARATION
Chief Arbiter of the Czechoslovak Socialist Republic
of 17 January 1962
amending the Decree on the conclusion of economic contracts on the new technology section
The main arbitrator of the Czechoslovak Socialist Republic, after consulting the participating ministers, provides, pursuant to Article 190 (1) of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Paragraph 5 of Decree No 225 / 1959 of the Ú. l., on the conclusion of economic contracts on the new technology section, is amended as follows:
1. Article 5 (1) reads as follows: "The subcontractor shall, at the request of the manufacturer or the investigator, conclude a subcontracting contract for the tasks included in the scientific and research work plans or in the plans for the development, adoption and introduction of the production of new industrial products and the adoption of new production technologies, if so indicated in the order. With regard to subcontracting strictly necessary, the subcontractor shall also have this obligation in cases:
(a) where the order has not been submitted in due time, except where the contract would have been concluded which, given the short duration of time, would appear to be impossible; in such cases, the foreign trade undertaking is obliged to apply the order without delay abroad and to comply with imports as possible on foreign markets;
(b) where the manufacturer (solver) requests delivery of quantities less than the minimum production quantity. "
2. Article 5 (3) reads as follows: "The subcontracting referred to in paragraph 1 shall be provided in the same way as supplies for centralised investment construction; The penalty is double."
This decree shall take effect on 1 February 1962.
