Regulation on remuneration of officials of national committees

the remuneration of officials of national committees.
The Government of the Czechoslovak Republic hereby orders pursuant to § 12 (2) of Act No. 235 / 1948 Coll., on the modification of certain ratios of members of the national committees and their components:
§ 1.
Material security of national committee officials.
(1) In order for the representatives of the people in the national committees to be able to perform the functions for which the people have been called without causing material damage to them, the People's Democratic Republic provided them with a claim by Law No 235 / 1948 Coll. to compensate for the actual expenses they incur in connection with the performance of their duties and a claim for compensation for the loss of earnings they incur in the performance of their duties.
(2) The chairmen, their representatives and the representatives of the national committees (hereinafter referred to as "officials of the national committees") are entitled to compensation for the loss of earnings in principle as remuneration for the performance of their duties, in which part of the work carried out for the benefit of the whole is assessed.
§ 2.
Annual amounts of rewards.
(1) The size groups of the national committees and the highest amounts of the total remuneration are determined as follows:

(2) The Ministry of the Interior, in agreement with the Ministry of Finance, provides for the highest remuneration for the performance of their duties to be granted to individual officials of national committees who are on full unpaid leave for the performance of their duties or who are otherwise prevented from exercising their duties in order to carry out their regular employment.
(3) In accordance with the amounts set out as remuneration for the performance of the duties referred to in paragraph 2, remuneration for the performance of the duties of those officials who have no or only partial unpaid leave for the performance of their duties shall then be set accordingly.
§ 3.
Remuneration of district council officials.
(1) The remuneration of officials of the District Councils is also included in the amounts of remuneration provided for by the Central and Single National Committees. The proposal for the remuneration of these officials is therefore part of the proposal for the remuneration of the officials of the relevant central or single national committee.
(2) If the remuneration of the officials of the District Councils were to run out more than one quarter of the total remuneration set out for the Central or Single National Committee, the Ministry of Interior, in agreement with the Ministry of Finance, would normally increase that sum.
§ 4.
Reward proceedings.
(1) The proposal for the remuneration of individual officials (hereinafter referred to as "the proposal") shall be drawn up by the national committee of which the officials are members.
(2) The proposal must also include a decision on which referees will be forced to perform their duties instead of their regular employment, which will only be sufficient with partial unpaid leave from their regular employment and who will finally be able to perform their duties alongside their regular employment. Similarly, it sets out a proposal on how much time they will be forced to devote to the performance of the duties of self-employed officials.
(3) The proposal will be discussed by the Board of the National Committee and submitted to the superior national committee for approval with the justification. The proposal for the remuneration of the officials of the Regional National Committees and the Central National Committee of the City of Prague is approved by the Ministry of Interior in agreement with the Ministry of Finance.
(4) When approving proposals, senior national committees (authorities) shall examine in particular:
(a) whether the tasks of the individual reports for the next period have been properly assessed and, accordingly, the employment of the experts is properly planned;
(b) whether the total of the proposed remuneration is not higher than planned for the size group to which the national committees belong;
(c) that there are no unjustified differences between the remuneration of national committees of the same size group.
(5) When approving the remuneration of officials of local national committees, the district national committees shall ensure that the remuneration of individual officials is not fixed on a flat-rate basis, regardless of the work actually carried out by the official of the local national committee.
(6) If it turns out that the proposal has been properly drawn up, but given the special circumstances, it is not possible to comply with the total of the remuneration set out for the size group, the Ministry of the Interior may, in agreement with the Ministry of Finance, allow the sum to be exceeded.
§ 5.
Extraordinary compensation for damage to earnings.
On a case-by-case basis, the officials of the local national committees may be granted compensation for the loss of time in respect of the loss of earnings, provided that such damage is significantly greater than the remuneration for the performance of their duties and that it is not a loss of time associated with participation in meetings of the local national committee and its constituents.
Final provisions.
§ 6.
Government Decree 304 / 1948 Coll., on the remuneration of members of national committees, is hereby repealed.
§ 7.
This Regulation shall enter into force on 1 January 1951; they shall be carried out by the Minister for the Interior in agreement with the Minister for Finance.
