According to Article 19 (8) of Act No. 138 / 1973 Coll., on Water (Water Act), as amended by Act No. 14 / 1998 Coll., ("the Act '):

ČÁST PRVNÍ

PRINCIPLES FOR THE DETERMINATION AND CHANGES IN THE PROTECTION OF AQUATIC RESOURCES
§ 1
(1) The protection zones shall be established on the basis of a technical assessment of the state and needs of the protection of the quality, quality or health of the water source in relation to its hydrological water catchment area or hydrogeological area.
(2) The protection zones for the individual supply of drinking water to households are established and amended in accordance with the individual procedure, taking into account the principles for establishing and amending the protection zones for water resources set out in this Decree.
§ 2
The supporting documents for the decision to establish or amend protection zones shall include in particular:
(a) descriptive and technical data on the water source and the water collection thereof, taking into account whether the raw water parameters used for the treatment of drinking water comply with the requirements resulting from the relevant technical standard, 1) and their development, the permit to collect water from that water source;
(b) the characteristics of the territory of the proposed protection zones in relation to the hydrological catchment area or hydrogeological area of the water source, including:
1. geomorphological ratios;
2. meteorological and climatic conditions;
3. hydrographic and hydrological ratios;
4. pedological ratios,
5. geological and hydrogeological ratios,
6. data on protection zones of natural medical resources, (2) specially protected territories and other territories protected under specific regulations on the conservation of nature and landscape, (3) protected areas of natural water accumulation, (4) protected deposit areas, (5) protection zones of aquatic resources, protection zones for the protection of waterworks, (6) for example observation objects of groundwater and springs,
(c) an analysis of the risk of a risk to the fitness, quality or health of a water source, including information on:
1. threats to water resources due to natural circumstances;
2. the quantity and quality of groundwater and surface water which are close to the water source and may affect its quality, quality or health,
3. water sampling, water management, including water management permits, which may affect the natural hydrological ratios of the water source;
4. the characteristics of the installation and economic exploitation of the territory;
5. sources of pollution and the resulting effects on the quality or health of the water source, as well as on activities likely to jeopardise its viability, quality or health;
(d) a proposal for the establishment of protection zones and its justification containing:
1. the layout and description of the protection zones on a copy of the cadastral map, including the design of their marking in the field;
2. Partition numbers and type of land according to the property register for the territory of the protection zones, including the indication of their owners or persons with management law pursuant to special regulations; 7) where the proposal for the establishment of protection zones concerns only parts of the land registered in the property register as a parcel, as well as a geometric plan of those parcels to indicate the material burden on the part of the parcel, 8)
3. design and justification of specific protection measures (technical adaptations, prohibitions and restrictions on activities, restrictions on the use of real estate) in relation to individual properties;
4. a proposal to verify the effectiveness of water source protection with protection bands [water quality monitoring 1) and so on].
§ 3
(1) The first-degree protection zone shall be established as a continuous territory:
(a) in the case of water tanks listed in the Annex and for other tanks intended exclusively for the supply of drinking water for the whole area of the tank level at the maximum level of air, extended by a line of 50 m at a minimum width above the maximum enclosure of air along the whole tank, where appropriate, and to an appropriate extent along the selected tank inflows;
(b) in the case of other water-based tanks with a minimum distance within its limits at the tank level of 100 m from the sampling facility;
(c) for watercourses
1. by air on the shore of collection of at least 200 m above the point of collection upstream, downstream to the edge of the sifting object and 15 m wide, in the water stream comprising at least one half of its width at the point of collection;
2. without air on the shore of collection at least 200 m above the upstream point of collection, up to a distance of 50 m from the point of collection and a width of 15 m; in the water stream it shall comprise at least one third of its width at the point of collection;
(d) for groundwater sources with a minimum distance within 10 m of the sampling facility,
(e) in other cases individually, taking into account the principles set out in Paragraph 1 (1).
(2) The water-management authority may establish a first-degree protection zone to a extent less than that referred to in paragraph 1 (a) to (d) after consulting the Ministry of the Environment.
§ 4
(1) The second-degree protection zone is established outside the first-degree protection zone; may consist of one continuous or several separate territories within the hydrological catchment area or hydrogeological area.
(2) A second-degree protection zone may, where appropriate, be discussed and established gradually by the water authority.
(3) A second-degree protection zone shall not be established where the territory of the first-degree protection zone provides sufficient protection in the local circumstances of the quality, quality or health of the water source.
§ 5
(1) When establishing the boundaries of the protection zone, the water operator shall take into account the boundaries of individual parcels according to the cadastral property, where appropriate natural lines and artificial field borders.
(2) The boundaries of the protection zones are defined in accordance with the decision of the water operator to establish protection zones in visible locations by the signs indicating "protection zone x water source stages"; where a prohibition of entry is provided for by the water authority, the text "prohibited entry 'shall also be used. The second-degree protection zone is usually identified in the field only in places with increased risk of water source pollution and in areas where the border of the protection zone is crossed with communications. If the protection zone is running through the water level of the tank, the boards shall be placed on floating anchored buoys.
§ 6
(1) When deciding on the establishment or modification of protection zones, the water authority shall base its assessment of the conditions which may affect the quality, quality or health of the water source and of the results of the procedure.
(2) In the proceedings for the establishment or modification of protection zones, the water authority shall assess the activities covered by the prohibitions under Paragraph 19 (4) of the Act at all times:
(a) activities involving the manufacture, storage or handling of substances that threaten the quality or health of vod9) and substances that exhibit toxic, carcinogenic, mutagenic or teratogenic properties, 10) in particular organohalogen, organophosphorus, organophosphorus compounds, mercury and its compounds, cadmium and its compounds, mineral oils and hydrocarbons, cyanides, metals and their compounds, biocides and derivatives thereof, static fertilisers, substances affecting organoleptic properties of water, persistent compounds of silicon, non-organic compounds of phosphorus, and elemental phosphorus, fluorides, ammonia and nitrates;
(b) interventions which distort the soil layer and reduce the power of the covering layers, soil-distorting work, the use of explosives, mining, mining and operation of equipment which may affect the waterproof regime.
(3) In the decision to establish or modify protection zones, the water operator shall always provide for the protection zone first, if it is also laid down for the protection zone second degree, conditions for the protection of the salinity, quality or health of the water source, monitoring the effectiveness of the established method of protecting the water source, making the necessary technical adjustments in the protection zones and, after consultation with the authorities concerned, the activities covered by the prohibitions and restrictions on the use of the property within the meaning of Article 19 (4) of the Act.
