DECLARATION
of 28 May 2013
amending Decree of the Ministry of Transport and Communications No. 315 / 2000 Coll., on the technical and rescue equipment of the sea yacht and the demonstration of competence for the management of the sea yacht
The Ministry of Transport provides pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on maritime navigation, as amended by Act No. 310 / 2008 Coll. and Act No. 261 / 2011 Coll., for implementation of § 49 (5) of the Act:
Decree No. 315 / 2000 Coll., on the technical and rescue equipment of a seagoing yacht and the demonstration of competence to conduct a seagoing yacht, is amended as follows:
1. In Paragraph 10 (1) (c), "12 'is replaced by" 16'.
2. in Sections 10 (1) (c), 13 (b) and 14 (b), "10" is replaced by "20."
3. In Paragraph 10 (1) (c), "4 degrees' is replaced by" 6 degrees';
4. Paragraph 11 (2) (d) is deleted.
Points (e) to (g) shall be renumbered (d) to (f).
5. in Paragraph 25 (2) (a), "1000" is replaced by "500."
6. in Paragraph 25 (2) (a), "2" is replaced by "5."
7. in Article 25 (2), point (c) is deleted;
Points (d) and (e) shall be renumbered (c) and (d).
8. In Annex 3, on page 3 of the model licence, the number "12 'is replaced by" 16' in both places.
9. In Annex 3, on page 4 of the model licence in the section "CERTIFICATE C - TRANSPORT OF WAILS ', in the Czech text, the number" 12' is replaced by "16 '," 10' by "20 'and" 4 degrees' by "6 degrees'.
10. In Annex 3, on page 4 of the model licence in the section "CERTIFICATE C - TRANSPORT YACHTS OF COLLECTION VESSELS ', the number" 12' is replaced by "16 '," 10' by "20 'and" 4' by "6 '.
Transitional provisions
1. A licence for the management of a seagoing yacht in the area of cruises authorised by C pursuant to § 10 (1) (c) of Decree No 315 / 2000 Coll., as effective before the date of entry into force of this Decree, shall be deemed to be a licence for the management of a seagoing yacht in the area of cruises authorised by C pursuant to § 10 (1) (c) of Decree No 315 / 2000 Coll., as effective after the date of entry into force of that decree.
2. If the holder of a licence to conduct a seagoing yacht with a C authorisation pursuant to § 10 (1) (c) of Decree No 315 / 2000 Coll., as effective before the date of entry into force of this Ordinance, has applied for the replacement of a licence, the Maritime Authority shall exchange that licence for a seagoing yacht with a C authorisation pursuant to § 10 (1) (c) of Decree No 315 / 2000 Coll., as effective after the date of entry into force of that Ordinance. The seagoing authority shall withdraw the licence that is exchanged before the licence is exchanged in accordance with the first sentence.
Efficacy
This Decree shall take effect on 15 June 2013.
