DECLARATION
of 26 June 2018
amending Decree No 145 / 2016 Coll., on the reporting of electricity and heat from supported sources and implementing certain other provisions of the Act on Supported Energy Sources (Decree on the reporting of energy from supported sources)
The Ministry of Industry and Trade provides, pursuant to § 53 (1) (c), (d), (l), (m), (n), (o), (p), (q) and (r) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 310 / 2013 Coll., Act No. 90 / 2014 Coll. and Act No. 131 / 2015 Coll., ("Act '):
The Decree No. 145 / 2016 Coll., on the reporting of electricity and heat from supported sources and the implementation of certain other provisions of the Act on Supported Energy Sources (the Decree on the reporting of energy from supported sources) is amended as follows:
1. In Article 3 (6), the words "at the latest 'shall be deleted and the words" after the expiry of the time limit laid down for its transmission' shall be replaced by the words "after the transmission of the statement originally submitted '.
2. In Article 4 (2), the words "4 and 5 'are replaced by the words" 3 and 4'; the words "at the latest 'shall be deleted and the sentence" If the manufacturer does not transmit the data from the statement within the period referred to in the first sentence, the aid shall be charged within the immediately following accounting period following the transmission of the data.';
3. In Article 4 (3), the word "at the latest 'shall be deleted and at the end of the paragraph the sentence" If the producer using the joint combustion of a renewable resource and a secondary resource or a non-renewable resource does not transmit the data from the statement within the period referred to in the first sentence, the aid shall be charged within the following accounting period immediately following the transmission of the data.';
4. In Article 4 (4), the word "at the latest 'shall be deleted and at the end of the paragraph the sentence" If the electricity producer from high-efficiency cogeneration does not transmit the data from the statement within the time limit specified in the first sentence, the aid shall be charged within the following accounting period immediately following the transmission of the data.';
5. In Paragraph 4 (5), the words "after the expiry of the time limit laid down for its transmission 'shall be replaced by the words" after the transmission of the statement originally transmitted'.
6. In Article 5 (1), the word "at the latest 'shall be deleted and at the end of the paragraph the sentence" If the heat producer does not transmit the data from the statement within the period specified in the first sentence, the aid shall be charged within the immediately following accounting period following the transmission of the data.';
7. In Article 5 (2), the words "at the latest 'shall be deleted and the words" after the expiry of the time limit laid down for its transmission' shall be replaced by the words "after the transmission of the statement originally submitted '.
Efficacy
This decree shall take effect on the day of its publication.
