DECLARATION
of 21 May 2013
amending Decree No. 364 / 2005 Coll., on the management of school and school documentation and school matrices and on the transmission of data from school and school documentation and school matrices (Ordinance on school and school documentation), as amended
The Ministry of Education, Youth and Sports provides pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll. and Act No. 472 / 2011 Coll.:
Decree No. 364 / 2005 Coll., on the management of school documentation and school matrices and on the transmission of data from school documentation and school matrices and from school matrices (Decree on school documentation and school establishments), as amended by Decree No. 389 / 2006 Coll., Decree No. 226 / 2007 Coll., Decree No. 208 / 2009 Coll. and Decree No. 29 / 2012 Coll., is amended as follows:
1. In Paragraph 3 (4), the words "and fax" are deleted.
2. in Annex 1, Article 1 (1) (a), the number "30" is replaced by "15."
3. In Annex 1, Article 1 (3), the words "to the Ministry, where the school is established by the Ministry, 'shall be inserted after the words" to note'.
4. In Annex 1, Article 5, at the end of the text referred to in paragraph 2, the words "and the information on the way in which pupils are integrated shall be transmitted in accordance with the Framework Training Programme for Basic Education, the Annexes governing the education of pupils with a minor mental disability 'shall be added.
5. In Annex No 2, Article 1 (1), the words "either on a paper form or 'are deleted.
6. Article 1 (3) of Annex 2 reads as follows:
"(3) Aggregated data from school matrices and school documentation shall be transmitted to the competent administrative authority in accordance with Part Two of this Annex by 10 October at the latest at the relevant date of 30 September of the current school year. The data referred to in Article 8a shall be transmitted no later than 10 June of the current school year at the relevant date of 31 May of the current school year. The data referred to in Article 13 shall be transmitted no later than 10 March at the relevant date of 28 February of the current school year. ';
7. In Annex No 2, Article 1 (4) (a), the words "16," and the words "on paper at the latest by 4 October or electronically 'are deleted.
8. In Annex No 2, Article 1 (4) (b), the words "on a paper form not later than 4 November or electronically 'shall be deleted.
9. Article 1 (5) of Annex 2 reads as follows:
"(5) The aggregated data referred to in Article 26 shall be transmitted by 15 calendar days after the end of the quarter. The relevant date shall be the last day of the calendar quarter. The data referred to in Article 26 (1) (b) shall be transmitted at the relevant date of 31 December, the data referred to in Article 26 (2) (b) shall be transmitted at the relevant date of 30 September. ';
10. in Annex 2, Article 2 (1) (a), "children, pupils and students" shall be replaced by "children and pupils."
11. in Annex 2 (1) (b):
"(b) the number of pupils who have successfully passed the examination at the end of the course for basic education or basic education, including pupils who have successfully completed the examination without prior training in these courses, the number of classes and pupils in classes for teaching the Czech language and the number of certificates issued;"
12. In Annex 2, Article 2, point (e) is replaced by the following at the end of paragraph 1:
"(e) library fund of the school library, users, borrowing services, library staff."
13. in Annex No 2, Article 2 (2) (d), the words "number of apprentices by species," shall be replaced by "spatial equipment."
14. In Annex 2, Article 2, the dot is replaced by a comma at the end of paragraph 2 and the following points (e) and (f) are added:
"(e) the number of courses for basic education and courses for basic education by type of school and the number of pupils in those courses;
(f) the number of classes with teaching assistants and pupils in those classes in primary and secondary schools. ';
15. In Annex 2, Article 3, paragraph 2 is deleted.
Paragraph 3 shall become paragraph 2.
16. In Annex 2, Article 3 (2), the words "or basic 'are deleted.
17. at the end of the text in point (a) of Article 4 (2) of Annex 2, the words "with classes with teacher's assistant" shall be added.
18. in Annex No 2, Article 4 (2) (b), the words "special classes and children therein" are replaced by the words "children in special classes."
19. In Annex No 2, Article 4 (2) (d), the words "foreigners who do not have access to education under the same conditions as nationals of the Czech Republic, according to the type of operation broken down into ordinary and special classes," are deleted.
20. In Annex 2, Article 4, the dot is replaced by a comma at the end of paragraph 2 and the following point (g) is added:
"(g) the number of children according to the municipality of permanent residence in the case of a school established by the association of municipalities."
21. In Annex 2, Article 6 (1), the words "classes' shall be inserted after the words" average numbers'.
22. In Annex 2, Article 8a (1), the last sentence is deleted.
23. In Annex 2, Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following point (f) is added:
"(f) the number of children according to the municipality of permanent residence in the case of a school established by a union of municipalities."
24. in Annex 2, Article 11 (2) (b):
"(b) number of pupils in the music field according to musical instruments,"
25. in Annex No 2, Article 11 (2), at the end of point (c), the comma shall be replaced by a dot and point (d) shall be deleted;
26. In Annex 2, Article 12, including the title, is deleted.
27. in Annex 2, Article 17 (2) (g), the words "education" shall be deleted;
28. In Annex 2, Article 18 (2), the words "by category 'are deleted.
29. Article 19 (2) of Annex 2 reads as follows:
"(2) Data for the current school year:
(a) registered diners by type of school and school establishment with regard to the age categories in total and broken down by type of diet, others regularly consumed by type of diet;
(b) boarders for whom ready-to-eat meals are taken to dispensals broken down by type of school and diet, other people for whom ready-to-eat meals are taken to dispensaries by type of diet;
(c) the number of meals issued and cooked for October of the relevant calendar year broken down into lunches, dinners and supplementary meals;
(d) the registration number of staff of school catering facilities;
(e) the number of registered boarders by school or school establishment attending; and
(f) the number of meals for which the food is to be weighed / imported according to the type of diet to be taken, indicating the school catering facilities concerned. ';
30. In Annex 2, Article 20, the words "and by school type 'shall be added at the end of the text in point (c).
31. In Annex 2, Article 21 (1), the words "clients who could not be investigated 'are deleted.
32. in Annex 2, point (a) of Article 22 is deleted;
Points (b) to (d) shall be renumbered as points (a) to (c).
33. In Annex 2, Article 22 (c), the words "and by education 'are deleted.
34. In Annex 2, Article 23 (1), the words "clients who could not be investigated 'are deleted.
35. In Annex 2, Article 23 (2), the words "and by education 'are deleted.
36. In Annex 2, Article 24 (2), the words "and by education 'are deleted.
37. In Annex 2, Article 25, including the title, is deleted.
38. In Annex No 2, the fourth part is added, including the headings and footnotes No 7:
TRANSMISSION OF AGREGATED DATA BY LEGAL PERSONS ACTING TO THE ACTIVITIES OF SCHOOL OR SCHOOL EQUIPMENT
Transmission of aggregated data from employee records and wage funds
(1) Data to be transmitted by legal persons engaged in the activities of a school or school establishment established by the Ministry, Region, Municipality, Municipality, Registered Church, Religious Organisation, other legal or natural person:
(a) the registered number of staff and the means of pay, broken down into pedagogic and non-teaching staff by category of staff and by type of activities of schools and educational establishments; and
(b) the registered number of employees in natural persons, the number of women on maternity leave, the number of employees on parental leave, the use of the reserve by type of activities of schools and school establishments.
(2) In addition to the information referred to in paragraph 1, the organisations paying the fee (7) shall:
(a) the registered number of employees by category and type of activities of schools and school establishments, wage resources (salaries and other payments for work carried out in total, by salary component, by source of funding) by category of staff and types of activities of schools and schools, the number of selected salary components awarded by type of activities of schools and school establishments, the registered number of employees and the wage resources excluded from the wage regulation limits, broken down into educational and non-teaching staff by type of activities of schools and educational establishments; and
(b) the registered number of staff by grade and grade, broken down into teaching and non-teaching staff.
7) § 109 (3) (d) and (e) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll. and Act No. 466 / 2011 Coll. '
Efficacy
This Decree shall take effect on 1 July 2013.
