DECLARATION
of 18 April 2017
amending Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment, and amending Decree No. 101 / 1995 Coll., which gives rise to the Order on the health and professional competence of persons operating a railway vehicle, as amended, as amended by Decree No. 160 / 2015 Coll.
The Ministry of Transport provides pursuant to § 66 paragraphs 1 and 3 of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 181 / 2006 Coll., Act No. 191 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 134 / 2011 Coll., Act No. 64 / 2014 Coll. and Act No. 319 / 2016 Coll., to implement § 45 paragraph 3, § 46c (3), § 46e (5), § 46j (5) and § 48 paragraph 1:
Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment and amending the Decree of the Ministry of Transport No. 101 / 1995 Coll., which gives rise to the Order of Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended, as amended by Decree No. 160 / 2015 Coll., is amended as follows:
1. In Article 3, the following paragraph 8 is added:
"(8) The examination shall be completed no later than 1 year after completion of the training to obtain the relevant knowledge, skills and procedures. If the applicant does not pass the test within that period or for a third experiment, he shall be retrained to obtain the relevant knowledge, skills and procedures. ';
2. In Paragraph 5 (2), the sentence "At least 1 member of the Commission must hold a driver's licence 'is inserted after the first sentence.
3. In Article 6 (b), the word "local 'is inserted after the word" special'.
4. In Article 7 (a), the words "local runway 'shall be inserted after the words" cableway'.
5. In Article 8 (1), the words "local runway" shall be inserted at the beginning of point (a).
6. in Paragraph 10 (1) (b), the following point 1 is inserted:
"1st local runway (MI), '.
Points 1 to 6 shall become points 2 to 7.
7. In Paragraph 16 (2), the word "training 'is replaced by" professional practice'.
8. In Paragraph 16 (3), the word "training 'in the third sentence is replaced by" professional practice' and in the fourth sentence is replaced by "professional practice '.
9. In the title of Annex 4, the words "local runway 'shall be inserted after the words" vehicles on'.
10. Point 1.3 of Annex 4 reads as follows:
"1.3. Content and use of the local and tug track operating rules."
11. in Annex 4, point 1.6:
"1.6. Conditions for operation of the local and railway track - transports and stations, operation of switches and safety devices, signalling system, signal colours, signals, visibility of signals, braking distance '.
12. in Annex 4, point 1.7 reads:
"1.7. Conditions for the operation of railway services on the local and tractor track - control of the railway vehicle, train assembly and braking, train marking, train protection, train radio connection '.
13. in Annex 4, point 2.1 shall read:
"2.1. Basic terms."
Efficacy
This Decision shall enter into force on 1 May 2017.
