Decree on the setting of fuel quality requirements for stationary sources in terms of air protection

laying down fuel quality requirements for stationary sources in terms of air protection
According to Article 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Act on Air Protection), as amended by Act No. 92 / 2004 Coll., Act No. 695 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 385 / 2005 Coll., Act No. 212 / 2006 Coll., Act No. 180 / 2007 Coll. and Act No. 25 / 2008 Coll., ("the Act ') for the implementation of Article 3 (11) of the Act:
§ 1
Subject matter
This decree (1) implements the relevant provisions of the European Community2) and sets out requirements for the quality of fuels for stationary sources in terms of air protection, deadlines for their achievement, requirements for the sampling of fuels, the verification and certification of fuel quality and the manner and date of reporting of sulphur content data in certain liquid fuels.
§ 2
Basic concepts
For the purposes of this decree:
(a) fuel-solid solid, liquid or gaseous material intended for combustion in stationary sources to release its energy content; the fuel under this Decree is not considered to be waste under any other legislation (3) except plant waste whose incineration does not fall within the scope of another legislation (4);
(b) by gas oil, any liquid fuel derived from oil other than marine palive5), listed under codes 2710 19 25, 2710 19 29, 2710 19 45 or 2710 19 49 of the Combined Nomenclature (6), or any liquid fuel other than marine palive5), from which less than 65% by volume including losses and 85% by volume including losses shall be distigated by the technical standard CSN EN ISO 3405 method up to 250 ° C,
(c) by heavy fuel oil, any liquid fuel derived from oil other than marine palive5) or gas oil referred to in (b) listed under codes 2710 19 51 to 2710 19 69 of the Combined Nomenclature (6) which, as a result of its distillation range, falls within the category of heavy fuel oils intended for use as fuel from which less than 65% by volume of losses are distils to 250 ° C according to the technical standard CSN EN ISO 3405; if distillation cannot be carried out according to this method, the product is considered to be heavy fuel oil,
(d) a specific sulphur content of the total sulphur content in the original state in relation to the calorific value of the spent fuel in the original state, expressed in g.MJ-1
§ 3
Solid fuel quality requirements
(1) The measured sulphur content of coal intended for combustion in small and medium-sized stationary sources must not exceed 0,50 g.MJ-1
(2) The specific sulphur content of brown coal and lignite intended for combustion in small and medium-sized stationary sources must not exceed 1,07 g.MJ-1, must not exceed 0,95 g.MJ-1 as from 1 January 2010 and must not exceed 0,75 g.MJ-1 as from 1 January 2014
(3) The measured sulphur content of coal briquettes intended for combustion in small and medium stationary sources must not exceed 0,50 g.MJ-1
(4) The minimum calorific value of solid fuels intended for combustion in small stationary sources must not be less than 12 MJ in the anhydrous state. Kg-1. The minimum calorific value of solid fuels for combustion in medium stationary sources shall not be less than 10 MJ.kg-1 in the anhydrous state
§ 4
Quality requirements for liquid fuels
(1) The maximum sulphur content of gas oil must not exceed 0,1% by weight.
(2) The maximum sulphur content of heavy fuel oil must not exceed 1% by weight. This requirement does not apply to heavy fuel oil incinerated
(a) in combustion sources for which another legal transcription is given (7), the emission limit for sulphur dioxide,
(b) in refineries, where the monthly average of emissions of sulphur dioxide from all sources in the refinery, except for particularly large combustion sources falling within point (a), irrespective of the type of fuel or combination of fuels used, does not exceed 1700 mg.m-3 and this condition is laid down in an authorisation issued under Article 17 of the Law or other legislation8),
(c) in other sources, where the emission limit for sulphur dioxide laid down for those sources in a permit issued under Article 17 of the Act or other legislation8) does not exceed 1700 mg.m-3 at an oxygen content in the flue gas of 3% vol. on dry gas.
(3) The maximum content of polychlorinated biphenyls in liquid fuel must not exceed 5 mg.kg.1
(4) The minimum calorific value of the liquid fuel intended for combustion in small and medium-sized stationary sources must not be less than 30 MJ.kg-1 in the anhydrous state
§ 5
Verification and certification of fuel quality
(1) The verification of the quality of the fuel shall be carried out in particular by analysis of the fuel sample taken. Compliance with the sampling and analysis procedures for specific sulphur content and calorific value for fuels in § 3 and the sulphur content, polychlorinated biphenyls and calorific values for fuels in accordance with § 4 shall be considered as meeting the fuel quality verification requirements of this Decree.
(2) A certificate of fuel quality, which is issued on the basis of a fuel quality verification by a person who, as the first party to the Czech Republic, transfers or offers fuel for distribution or transfers the owner's rights to such fuel, and which contains the data in the format set out in Annex 1 to this Decree, is declared to comply with the fuel quality requirements laid down in that decree. The certificate shall be issued for each first fuel delivery to each customer and thereafter for a change in fuel quality and further on request by the customer.
§ 6
Reporting of sulphur content data in certain liquid fuels
In the Czech Republic, the person who first transfers or offers to be handed over for distribution or use of heavy fuel oil or gas oil or first transfers ownership rights to such fuels shall report annually to the Ministry of the Environment the sulphur content of those fuels, no later than 31 March for the previous calendar year, in the format set out in Annex 2 to this Decree.
§ 7
Repeal
Decree No 357 / 2002 Coll., laying down fuel quality requirements in terms of air protection, is repealed.
§ 8
Efficacy
This Decree shall take effect on the 15th day following its publication.

1) It is issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
