on the operation of associated production by single agricultural cooperatives
The Ministry of Agriculture, Forestry and Water Management provides in the agreement with the participating central authorities pursuant to § 14 (2) and § 61 of Act No. 49 / 1959 Coll., on Uniform Agricultural Cooperatives:
Preliminary provisions
In accordance with the needs of the development of agricultural and forestry production and the national economy, in accordance with the provisions of this Decree, single agricultural cooperatives ("cooperatives') - particularly in mountain and submountain areas and in the border - may, in order to make better use of their means of production, their own or local material resources and the full application of the work of members, operate, in particular at a time of vegetation, associated production. This production must not jeopardise the development of the cooperative's own agricultural activity.
Species of associated production
(1) The associated production under this Decree means:
(a) approximation, balancing and removal of timber and bark from the forest, *) aid for planting and other activities in the forestry sector,
(b) mining or processing of sand, gravel, stone, limestone, clay, reed, willow and birch;
(c) the manufacture of articles of straw, lard, willow and March wreaths, horsehair, bristles and other raw materials, mainly from local sources, the manufacture of agricultural tools, portable wooden troughs, horse harness and their parts, as well as the production of grown flowers and the manufacture of wreaths;
(d) the maintenance of buildings and assistance in their construction for other cooperatives, state goods or other socialist organisations;
(e) production of construction materials in wages for the investment construction of socialist organisations;
(f) the performance of services or works for socialist organisations and for the population, such as auxiliary work in sugar factories, distilleries, starch factories, canning plants, land works (drilling line for water, electric cables, local regulatory work, etc.),
(g) transport services by own means of transport for other socialist organisations and for the population;
(h) the production of articles, products or services and works for socialist organisations other than those referred to in (a) to (g), which the district national committee shall recognise after a responsible assessment of their economic necessity and effectiveness, as appropriate, to operate in the context of associated production.
Paragraph 4 (2) and (3) are without prejudice.
(2) According to this decree, the production or, where applicable, the work or services carried out by the cooperative for its own use shall not be regarded as related production.
Start of associated production
If the cooperative decides to operate as described in § 2, it shall:
1. indicate its type, scope and place of operation in its own statutes (in their supplement);
2. to ensure the production of articles or the execution of works or services by contracts, provided that, pursuant to Article 2 (1), their customers are socialist organisations.
The operation of the associated production may only be initiated by the cooperative on the date of approval of its own Statutes (their addendum) by the District National Committee containing the information referred to in point 1.*).
Procedure of national committees
(1) The Regional National Committee may authorise the cooperative to carry out associated production (Section 3) only if the following conditions are met:
(a) the operation of associated production must not jeopardise the development of the cooperative's own agricultural activity;
(b) the associated production helps to develop the agricultural and forestry production of the cooperative;
(c) the associated production contributes to a more stable and uniform application of the work and expertise of the members of the cooperative, in particular during the period of serenity;
(d) the associated production promotes the full use of basic means of production or the use of own or, where appropriate, local material resources, which would otherwise remain unused or the use of which would be more economical in the context of the associated production of the cooperative;
(e) the associated production helps to meet the needs of socialist organisations or, where appropriate, of the population, provided that such needs are not fully met by the production of the necessary products or by the provision of services and work by other socialist organisations;
(f) the supply of products, works or services of the cooperative will be carried out for socialist organisations only on the basis of contracts;
(g) the misuse of this activity to cover private business is excluded.
(2) If the cooperative intends to process surplus fruit, vegetables, grapes, etc., in the associated production, the district national committee may only approve such activity after the prior approval of the Ministry of Agriculture, Forestry and Water provided in the agreement with the Ministry of Food Industry and the Central Administration of the Purchase of Agricultural Products.
(3) The District National Committee shall ensure that, in all cases where a special permit (e.g. production permit, mining permit) is required for the operation of the associated production, the cooperative shall obtain such authorisation from the competent authorities. Without such authorisation, the District National Committee may not authorise associated production.
(4) The Regional National Committee is constantly keeping an overview of cooperatives which are authorised to operate associated production on the basis of approved own statutes (supplements). It must be clear from the overview when the operation of this production was approved, the type of activity and its scope, the place where it will be operated and whether the cooperative is entitled to employ both persons in employment in this activity.
(5) The National Committees provide assistance to cooperatives in selecting, introducing and operating associated production.
Activity of agricultural production administrations
(1) The District National Committee in the procedure for the approval of the associated production of the cooperative (Section 3) cooperates closely with the production farm administration. It shall not approve the cooperative without its recommendation.
(2) In particular, within the scope of its competence * *, the agricultural production administration ensures that cooperatives only operate associated production if the conditions laid down in this Decree are given, and that cooperatives are included in the annual production plans and operate on the basis of contractual relations. Paragraph 4 (5) shall apply mutatis mutandis to production management.
Allocated production
(1) The cooperative may only operate associated production to the extent specified in the approved own statutes (supplement).
(2) Changes in the operation of associated production (e.g. extension of production, transfer of establishment) the cooperative must also include in its own statutes (supplement). Paragraph 3 applies mutatis mutandis.
(3) When operating associated production, cooperatives are required to comply with the regulations on safety and health at work, fire safety, sanitary, price, tax and other regulations concerning this activity.
Place of operation of the related production
(1) The associated production may be carried out by the cooperative in the district of the district in which it operates, in particular in the municipality where its establishments are located.
(2) In exceptional cases, cooperatives may, in the context of the associated production of work and services for socialist organisations outside the district in which they operate, be allowed to do so by the Regional National Committee in whose district this activity is to be carried out.
(1) Only members of the cooperative may work in the associated production - unless otherwise specified below.
(2) The cooperative may, with the agreement of the Regional National Committee, after the recommendation of the production of agricultural management, employ in the associated production - if the activities referred to in § 2 (1) (b) to (h) - persons in employment only if they are specialists (marksman, blacksmith, colar, etc.) needed to carry on this activity and the cooperative has not been able to obtain them for its members.
(3) In the mountain and submountain areas and, where appropriate, in the border counties, the cooperative may, in exceptional cases and with the agreement of the district national committee, after the recommendation of the agricultural production administration, employ other persons than specialists in associated production (paragraph 2) if they are urgently needed to develop the work of the members of the cooperative during the period of vegetation and the cooperative has not been able to obtain them for its members. However, the District National Committee may not give its consent, according to the previous sentence, to the employment of persons employed in associated production, in which only such persons should work predominantly and permanently without a wider participation of the members of the cooperative.
(4) The District National Committee shall ensure that, in the proceedings referred to in the preceding paragraphs, speculators or freeloaders do not enter the cooperative's employment and that former exploiters or persons convicted of the theft of property in socialist property or for speculation do not work at the heads of the associated production.
Treatment of the necessary material
The necessary material for the operation of the associated production, which the cooperative cannot procure from its own resources, purchases at retail (sales) prices without the right to trade reductions. When buying in retail trade, the cooperative shall comply with the applicable rules. *)
Prices
(1) The sale of products and the provision of works or services in the context of the associated production of the cooperative takes place at prices established in accordance with the relevant regulations. * *) The District National Committee is constantly monitoring and ensuring compliance with the established prices.
(2) The co-operative operating associated production shall proceed with invoicing in accordance with the applicable regulations * * and shall be required to keep the relevant price lists of products (works or services) in the accessible location of the establishment. The invoices issued by the cooperative for its activities in the associated production shall also include a reference to the relevant price list and, where appropriate, to the area of the Regional National Committee and price fixing.
Remuneration for work
(1) The members of the cooperative working in the associated production are remunerated for work according to the same principles as the other cooperatives, i.e. either in labour units or in basic remuneration in cash, if the cooperative imposed cash remuneration and premiums.
(2) If the cooperative carries out approximation, balance and removal of timber and bark from the forest in the context of the associated production, it rewards the cooperative performing these works either by paying a fixed basic remuneration and cash premiums regardless of the system of remuneration established, or by paying the full value of the planned work unit (in kind the remuneration is paid in cash).
(3) Persons working in the associated production in employment shall be remunerated in accordance with the applicable wage rules for civil servants. For those professions which are not covered by those regulations, the remuneration of workers shall be carried out according to a tariff classification catalogue for continuous professions.
Final provisions
(1) Decree No 111 / 1961 Coll., on the operation of auxiliary and associated production in single agricultural cooperatives and on the execution of works and services by single agricultural cooperatives, is hereby repealed.
(2) The Ministry of Agriculture, Forestry and Water in an agreement with the central authorities involved may, in exceptional cases, allow exemptions from this decree.
Efficacy
This decree shall take effect on the day of its publication.
