DECLARATION
of 5 May 2009
amending Decree No 291 / 2003 Coll., on the prohibition of the administration of certain substances to animals whose products are intended for human consumption and on the monitoring (monitoring) of the presence of unauthorised substances, residues and contaminants for which animal products could be harmful to human health, in animals and in their products, as amended
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll. and Act No. 182 / 2008 Coll., ("the Act ') for the implementation of Sections 19 (3) and (5) (a) and Article 34 (5) (a) of the Act:
Čl. I
Decree No 291 / 2003 Coll., concerning the prohibition on the administration of certain substances to animals whose products are intended for human consumption and the monitoring (monitoring) of the presence of unauthorised substances, residues and contaminants for which animal products could be harmful to human health, animals and their products, as amended by Decree No 232 / 2005 Coll. and Decree No 375 / 2006 Coll., are amended as follows:
1. In Article 1, the words "This decree (1)) shall incorporate the relevant provisions of the European Communities (1a) 'shall be replaced by the words" This decree shall incorporate the relevant provisions of the European Communities (1)';

Council Directive 96 / 23 / EC of 29 April 1996 on measures to monitor certain substances and residues thereof in live animals and animal products and repealing Directives 85 / 358 / EEC and 86 / 469 / EEC and Decisions 89 / 187 / EEC and 91 / 664 / EEC. 2. In Article 2 (g), the words ", navicular syndrome (podotrochlosis) and laminitis' and the words" which are kept for purposes other than meat production 'are deleted.
3. in Article 3 (a):
"(a) put into circulation thyrostatic substances, stilbenes, stilbene derivatives, their salts and esters, 17- beta-estradiol and its esters and beta agonists for the purpose of their administration to animals whose meat or other products are intended for human consumption, not for the purposes referred to in Article 5 (1) (b) and (c),"
4. In Article 4 (2), "§ 5, 6 or 6a 'is replaced by" § 5 or 6';
5. in Article 5 (1) (b), the words "and pet animals" shall be deleted;
Article 6 (6a) is deleted.
7. In Article 7 (1), "Sections 5, 6 and 6a 'is replaced by" Sections 5 and 6'.
8. in § 8 (1) and in § 9 (2) (d), "§ 5, 6 and 6a" is replaced by "§ 5 or 6."
9. In Article 11 (2), the words "whose meat or other products are intended for human consumption 'shall be inserted after the words" all species'.
10. in Article 11 (3) (a):
"(a) farmed animals and aquatic animals to which they have been submitted:
1. thyrostatic substances, stilbenes, stilbene derivatives, their salts and esters, 17- beta-estradiol and its esters or preparations containing these substances,
2. beta-agonists and substances having an estrogen, androgenic or gestagenic effect, or preparations containing these substances, unless such substances or preparations have been submitted in accordance with the requirements laid down in Sections 5, 6 and 8 and in the absence of compliance with the established withdrawal periods, corresponding to international recommendations, ';

Efficacy
This decree shall take effect on the day of its publication.
