DECLARATION
Ministry of Industry and Trade
of 15 June 1995
on the details of granting state authorisation for business in the energy sector
The Ministry of Industry and Trade pursuant to § 45 (6) of Act No 222 / 1994 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on State Energy Inspection ("the Act ') provides:
Types of State Authorisation
State authorisation ("authorisation ') shall be granted to natural or legal persons for the following activities in the energy sector:
(a) electricity generation (group 11);
(b) gas production (group 21);
(c) heat production (group 31);
(d) electricity distribution (group 12),
(e) gas distribution (group 22),
(f) heat distribution (group 32).
Request for authorisation
(1) An application for authorisation ("the application") shall be submitted to the Ministry of Industry and Trade ("the Ministry") on the prescribed form for each type of authorization separately.
(2) The application form, the model of which is annexed to No 1 of this Order, shall be obtained by the applicant at the Ministry or Territorial Inspectorate of State Energy Inspection ("inspections").
(3) Where a responsible representative is appointed, an application for authorisation shall be attached to the application. The model of the application form is set out in Annex No 2 to this Order. In addition, a list of establishments on the form, the model of which is annexed to No 3 of this Order, and the basic information on the scope of the electricity, gas and heat engineering business on the forms, the models of which are Annexes 4a, 4b and 4c to this Decree, must be attached.
(4) An application for divorce in groups 12, 22 and 32 pursuant to Article 1 must be accompanied by a map indicating the boundaries of the place where the authorised activity is carried out on a scale of:
| a) pro rozvod elektřiny | 1 : 200 000, |
| b) pro rozvod | 1 : 200 000, |
| c) pro rozvod tepla | 1 : 5000 nebo 1 : 10 000. |
(5) The map shall be accompanied by a list of the cadastral numbers located on the perimeter of the territory defined for the performance of the authorised activity; If the limits of the place of activity of the authorised activity cannot be defined concurrently, the numbers of the cadastres or parcels on which the sampling facilities to which the authorisation holder provides energy shall be indicated.
Granting, termination and revocation of authorization
(1) The Ministry shall publish, no later than 30 days after the end of that period in the Trade Journal, the award, termination and revocation of the authorisation during the past six months.
(2) In the event that the authorisation holder cannot start carrying out the authorised activity within the time limit set in the authorisation decision, he shall notify the Ministry without delay, stating the reasons for the authorisation.
(3) The holder shall apply for the revocation of the authorisation under Article 8 (4) of the Act on the prescribed form, which is annexed to No 5 of this Order.
Efficacy
This decree shall take effect on the day of its publication.
