DECLARATION
of 28 April 2010
amending Decree No 418 / 2003 Coll., establishing a more detailed definition of the heading and amount of the public health insurance funds of health insurance companies, the conditions for their creation, use, admissibility of transfers of funds and their management, the limit of the cost of the activities of health insurance companies covered by the resources of the basic fund, including the calculation procedure for this limit, as amended
The Ministry of Finance, after consulting the Ministry of Health, provides for Act No. 551 / 1991 Coll., on the General Health Insurance Company of the Czech Republic, as amended by Act No. 127 / 1998 Coll., and pursuant to Section 16 (6) of the Act No. 280 / 1992 Coll., on departmental, branch, corporate and other health insurance companies, as amended by Act No. 225 / 1999 Coll.:
Decree No. 418 / 2003 Coll., establishing a more detailed definition of the heading and amount of the public health insurance funds of health insurance companies, the conditions for their creation, use, admissibility of transfers of funds and their management, the limit on the cost of the activities of health insurance companies covered by the resources of the basic fund, including the procedure for calculating this limit, as amended by Decree No. 656 / 2004 Coll., Decree No. 519 / 2005 Coll. and Decree No. 356 / 2007 Coll., is amended as follows:
1. In Article 1, at the end of paragraph 1, the dot is replaced by a comma and the following points (k) to (o) are added:
"(k) reduced or cancelled premiums, periodic penalty payments, fines and premiums;
(l) reduced or cancelled other provisions other than those referred to in (k) relating to the basic fund;
(m) the reserves used, reduced or cancelled for final litigation referred to in paragraph 4 (m);
(n) used, reduced or cancelled other provisions not referred to in (m) relating to the basic fund;
(o) other notable items active in relation to the basic fund not referred to in (c). "
2. In the third sentence of Article 1 (3), the words "transfer of the amount of the reserve to a final court settlement into a special bank account 'are replaced by the words" value of the reserves in the basic fund'.
3. In Article 1 (4) (g), the words "and in the special bank account of reserves' are deleted.
4. In Paragraph 1, at the end of paragraph 4, the dot is replaced by a comma and the following points (n) to (p) are added:
"(n) the creation of other provisions not referred to in point (m) relating to the basic fund;
(o) making adjustments to premiums, periodic penalty payments, fines and premiums;
(p) the creation of other adjustments not referred to in point (o) relating to the basic fund. ';
5. In the first sentence of Paragraph 1 (7), the words "or provisions for final litigation 'shall be deleted.
6. In the first sentence of Paragraph 2 (5), the words "and the transfer of the amount of the reserve to a final legal proceedings into a special bank account 'shall be deleted.
7. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following points (k) to (m) are added:
"(k) the other provisions relating to the operational fund used, reduced or cancelled,
(l) reduced or cancelled other provisions relating to the operational fund;
(m) other notable items active in the operational fund. "
8. In Article 3, at the end of paragraph 4, the dot is replaced by a comma and the following points (l) to (n) are added:
"(l) the creation of other provisions relating to the operational fund;
(m) the creation of other adjustments relating to the operational fund;
(n) other arbitrary items passive in relation to the operational fund. "
9. In Article 4, at the end of paragraph 2, the dot is replaced by a comma and the following points (j) to (l) are added:
"(j) the other reserves used, reduced or cancelled in relation to the social fund;
(k) reduced or cancelled other provisions relating to the social fund;
(l) obvious items active in the social fund. "
10. In Article 4, at the end of paragraph 4, the dot is replaced by a comma and the following points (f) to (h) are added:
"(f) other reserves relating to the Social Fund shall be established,
(g) other provisions relating to the social fund shall be established;
(h) there shall be a speculative item passive relating to the social fund. "
11. in Article 5, at the end of paragraph 2, the dot is replaced by a comma and the following point (e) is added:
"(e) other provisions relating to the asset fund used, reduced or cancelled."
12. in Article 5, at the end of paragraph 3, the dot is replaced by a comma and the following point (e) is added:
"(e) the creation of other adjustments relating to the asset fund."
13. in Paragraph 7 (2), "koef." = - 0,58 / P x p + 3,71 + 0,58 / P x 50 "is replaced by" koef. "
Efficacy
This decree shall take effect on the day of its publication.
