DECLARATION
of 9 March 2021
amending Decree No. 408 / 2015 Coll., on Electricity Market Rules, as amended
Pursuant to Section 98a (2) (h) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 90 / 2014 Coll. and Act No. 131 / 2015 Coll., and under Section 53 (2) (g), (h), (j) and (k) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Laws, as amended by Act No. 131 / 2015 Coll.:
Decree No. 408 / 2015 Coll., on Rules of the Electricity Market, as amended by Decree No. 127 / 2017 Coll. and Decree No. 302 / 2020 Coll., is amended as follows:
1. in Article 2, point (e) is deleted;
Points (f) to (y) shall be renumbered as points (e) to (x).
2. in Sections 2 (q), 18 (4), 23 (6), 25, 26 (5), 41 (2), 42 (3), 54 (6) and 56 (4), the word "consumption" shall be replaced by the word "sampling."
3. In Paragraph 15 (1), a comma is inserted after the word "Supplier '.
4. In Article 15 (3), "Article 16 (2) 'is replaced by" Article 16a'.
5. Paragraph 16, including the title above the title, reads:
"Registration of transfer points and demand points, production sites, transmission systems and distribution systems
(1) The market operator shall establish and manage the code lists of demand points and transmission points and distribution systems necessary to identify individual demand points and transfer points and allocate to individual transmission or distribution system operators a number line from the sampling and transmission point code lists.
(2) The transmission or distribution system operator shall assign an 18-digit identification code and register the individual market operator
(a) the sampling points and the transfer points of the sampling point;
(b) transfer points of production, with the exception of those connected to customer demand points under Section 28 of the Energy Act;
(c) transfer points between systems;
(d) the measuring points between the supply type diagram regions; and
(e) aggregate sampling points pursuant to Article 16a (5).
(3) The backup power supply connection point (s) at one voltage level which cannot be used simultaneously with the main power supply line and which is indicated as a backup power supply (hereinafter referred to as the backup power supply line) shall be registered by the transmission or distribution system operator as a separate transfer point.
(4) The transmission system operator or distribution system operator shall, upon request, communicate to the client the identification code numbers of its sampling and transmission points.
(5) In the event of the termination of a demand or transfer point, the transmission or distribution system operator shall cancel the registration of the demand or transfer point in the market operator information system. In the event of the disappearance of a demand point with multiple transfer points, the transmission or distribution system operator shall cancel the registration of all transmission points of that demand point in the market operator information system. ';
6. The following Sections 16a to 16c are inserted after Section 16, including the headings and footnotes No 7 and 8:
Procedure for registration of the sampling point and the transfer point of the sampling point
(1) Where the sampling point has one transfer point, the transfer point identification code shall be the same as the sampling point identification code.
(2) Where the sampling point has multiple transfer points, the relevant transmission or distribution system operator shall assign and register an 18-digit identification code for each of the transfer points of that sampling point and establish an 18-digit identification code for one of those transfer points to which the sampling point will be identified. Where there are more than one transfer point, the market operator shall make available on request to market participants a list of the transfer point.
(3) If the sampling point is connected by means of a common home installation or by means of an electrical connection and a common home installation, the point of transmission shall be the point where the measuring device is located.
(4) The distribution system operator shall register the customer demand point to which the electricity plant is connected pursuant to Paragraph 28 (5) of the Energy Act as a demand point with a production label of up to and including 10 kW with a measurement according to another legislation7). If a customer operating a power plant pursuant to § 28 (5) of the Energy Act becomes the holder of a licence for the production of electricity, it shall proceed according to § 46 and the distribution system operator shall subsequently register the transfer point of the power plant in accordance with § 16b.
(5) Where the customer at the demand point is the same person as the electricity supplier and the distribution system operator providing the distribution system service to that demand point and, at the same time, for that demand point, the person responsible for the derogation at the point designated to cover the losses of the distribution system operator, the distribution system operator may register all such demand points and their transfer points as the aggregate demand point of that distribution system, according to the measurement type.
(6) The point of collection for which the rate of non-measured take-off has been agreed in accordance with the Authority's pricing decision is not registered in the market operator's information system.
Procedure for registration of the production site
(1) Where a production facility has one or more power supply points, the relevant transmission or distribution system operator shall assign and register an 18-digit identification code to each of the transmission points of that production.
(2) Where a production plant has one or more transmission or distribution system transfer points that serve only for the consumption of technological own consumption (hereinafter referred to as the "transmission point of the production plant for the TVS '), the relevant transmission or distribution system operator shall assign and register an 18-digit identification code for each of the transmission points of that production.
(3) Where a production plant has one or more transmission points for the collection of electricity not only for technological own consumption, the relevant transmission or distribution system operator shall assign and register an 18-digit identification code for the sampling point referred to in Article 16a.
System registration procedure and transmission point between systems
(1) The transmission or distribution system operator shall register with the market operator each electricity system operated by it. When registering a transmission system or distribution system, a market operator or a distribution system shall also be assigned an 18-digit code in the market operator's information system for a location intended to record losses of that system.
(2) The transmission system operator shall register with the market operator all transmission points connecting the transmission system to the foreign transmission system and all transmission points connecting the transmission system to the distribution system connected to it as individual transmission points at voltage levels.
(3) The distribution system operator shall register with the market operator all transmission points connecting the distribution system to another distribution system connected to it as individual transmission points at voltage levels, and all measurement points connecting the supply type diagram regions.
(4) If the distribution system operator operates a part of the distribution system not connected to the electricity system of the Czech Republic, it shall register with the market operator the transfer point connecting that part of the distribution system to the foreign electricity system. For the purposes of registration in the market operator system, the measurement type A or B shall be indicated.
(5) Where the distribution system is connected to a foreign distribution system which is not connected to the electricity system of the State in whose territory it is located, the distribution system operator shall register with the market operator a transfer point linking the distribution system to the foreign distribution system. For the purposes of registration in the market operator system, the measurement type A or B shall be indicated.

7. Article 17, including the title, reads:
Status
(1) The registered transfer point shall have active status unless the transmission or distribution system operator changes active status to suspended, inactive or without an electrometer in accordance with paragraph 2, 3 or 4.
(2) The transmission or distribution system operator shall change the status active at the transfer point of the demand point
(a) interrupted in the event of interruption of supply pursuant to § 24 (3) (c) (3) and (5), § 25 (3) (c) (3) and (4) or § 30 (1) (d) of the Energy Act;
(b) inactive in the case of inclusion of a sampling point in the sum of the data transfers; or
(c) without an electrometer in the case of non-installation of the sampling point by an electrometer, except in the cases referred to in (a).
(3) The transmission or distribution system operator shall change status to status at the transmission point of the supply facility
(a) interrupted in the event of interruption of supply pursuant to Articles 24 (3) (d) (3) and (4) and 25 (3) (d) (3) and (5) of the Energy Act; or
(b) without an electrometer in the case of non-installation of the transfer point by an electrometer.
(4) The transmission or distribution system operator shall change the status of the transmission point between systems active to the status without the electrometer in the event of non-setting of the transmission point between systems by the electrometer. The change in the transfer point status between systems shall not affect the sampling points and their transfer points and production points in those systems.
(5) The transmission or distribution system operator shall keep up-to-date the status of the transfer point. The transfer point for which active status is assigned shall include the market operator in the assessment of derogations and shall be transmitted to it data pursuant to § 19 to 22. The change of the transfer point status shall be registered by the transmission or distribution system operator in the market operator information system no later than 4 working days after the date of the change, with effect from the date of the change. The market operator shall inform the registered electricity market participants concerned accordingly. From the date of validity of the change in status referred to in paragraphs 2, 3 or 4, the transmission or distribution system operator shall not transmit the data on the collection and supply of electricity to the transfer point and the market operator shall remove all data transmitted pursuant to paragraphs 19 to 22 of this Article in its information system and shall not establish the values referred to in paragraph 2 of this Article. ';
8. Paragraph 18 (1) and (2) reads as follows:
"(1) The responsibility for the derogation shall relate to each point of demand, the point of transmission of electricity, the point of transmission or distribution system operator intended to record losses of that system or the aggregate point of demand referred to in Article 16a (5).
(2) The responsibility for the derogation at the sampling point and at the point designated to record the losses of the transmission or distribution system operator is always limited to one clearing entity. The responsibility for the derogation for the production plant may be held by two different clearing entities, with one clearing entity being responsible for the derogation at the production and transmission point of the production plant for the TVS and the other being responsible for the derogation at the transmission points of the power supply plant for the system. Where the electricity generation plant is connected to the customer's demand point under Paragraph 28 (5) of the Energy Act, the responsibility for the derogation may not be transferred to two clearing entities. '
9. Paragraph 18 (5) reads:
"(5) Where, at the point of demand, the point of transmission of electricity or the point of transmission or distribution system operator's loss account with transferred responsibility for the derogation ends the supply of electricity and does not follow up the new supply of electricity with responsibility for the derogation, or where the transfer of responsibility for the derogation to the clearing entity ends, the market operator shall inform the relevant transmission or distribution system operator and registered electricity market participants who are registered with the market operator by the transferred or their own responsibility for the derogation of that demand point, the point of transfer or the point of production or the point of loss of the transmission or distribution system operator. Furthermore, the market operator shall inform the supplier of the supply of electricity to the demand point, the transmission point of the production facility for the TVS or the point for recording the losses of the transmission or distribution system operator or the electricity from the relevant transfer point of the production plant under the contract provided for in Article 50 (1) of the Energy Act, no later than 30 calendar days before the date of termination of the responsibility for the derogation. The supplier shall inform the customer, the manufacturer or the transmission or distribution system operator of the termination of the supply with the transfer of responsibility for the derogation or the termination of the transfer of responsibility for the derogation at that point of demand, the transfer point of the production plant or the site designated for the registration of losses of the transmission or distribution system operator no later than 25 calendar days before the date of termination of the responsibility for the derogation. ';
10. In Article 18 (6), the words "and registered electricity market participant 'are replaced by the words" relevant suppliers and settlement entities' and the words "or transfer points' are replaced by the words" point, point of production or point of transfer to record the losses of the transmission or distribution system operator '.
11. the following Section 18a is inserted after Section 18:
(1) If the customer's demand point is not assigned to the settlement entity, the market operator shall not include such a demand point in the assessment of the deviations. Where a new clearing entity is not assigned to that settlement entity on the day following the end of the allocation of the settlement entity to the sampling point and the supplier does not have a settlement agreement with that sampling point, the supplier as a clearing entity does not meet the financial terms of the settlement of the derogations and the market operator cancels the allocation of the supplier to that sampling point in the market operator's information system. From that date, the supplier of the last instance shall start the delivery in accordance with Paragraph 59 (4). The market operator shall inform the market operator of the transmission system operator or relevant distribution system operator, the supplier concerned and the original clearing entity, through the information system.
(2) If the transfer point is not assigned to the clearing entity, the market operator shall not include such a transfer point in the assessment of derogations. If, on the day following the end of the assignment of the clearing entity to the transfer point of the production facility, a new clearing entity is not assigned to that location, the market operator shall cancel the assignment of the supplier to that transfer point of the production facility in the market operator information system. The market operator shall inform the market operator of the transmission system operator or relevant distribution system operator, the supplier concerned and the original clearing entity thereof through the information system. ';
12. In § 19 (1) (a) to (c), § 20 (4), § 21, § 24 (1), (3) and (4), § 26 (5), § 28 (2) and § 56 (4), the word "equipped" is replaced by "s."
13. in Paragraph 20 (1):
"(1) The distribution system operator shall transmit to the market operator every day within 11.00 hours for each business hour of the preceding day and for each distribution system operated by it.
(a) actual values
1. the supply and collection of electricity at individual transmission points of power generation plants with type A measurement;
2. electricity supplies and withdrawals at individual customer sampling points with type A measurement;
3. the supply and collection of electricity at individual transmission points between different regions of type diagrams or distribution systems with type A measurements;
4. the supply and collection of electricity at individual demand points with power generation pursuant to Section 28 (5) of the Energy Act with type A measurement;
5. electricity withdrawals for other sampling points not referred to in points 1 to 4 with type A measurements; and
(b) preliminary values for the supply and consumption of electricity at individual transmission points between different regions of type diagrams or distribution systems with type B measurements. ';
14. in Paragraph 20 (1):
"(1) The distribution system operator shall transmit to the market operator every day within 11.00 hours for each business hour of the preceding day and for each distribution system operated by it.
(a) actual values
1. the supply and collection of electricity at individual transmission points of power generation plants with type A measurement;
2. electricity supplies and withdrawals at individual customer demand points with type A measurement;
3. electricity supplies and withdrawals at individual measurement points between different regions of type diagrams or transmission points between distribution systems with type A measurement;
4. the supply and collection of electricity at the individual point of supply points with the production of electricity pursuant to Section 28 (5) of the Energy Act with type A measurement;
5. the supply and consumption of electricity not specified in points 1 to 4 with type A measurements; and
(b) preliminary values for the supply and consumption of electricity at individual measuring points between different regions of type diagrams or transmission points between distribution systems with type B measurement. ';
15. in Article 20 (3) and (4), the word "transfer" shall be deleted and the word "measurement" shall be inserted after the word "location";
16. in Article 20 (3) and (4), the words "transfer points between" shall be inserted after the words "diagrams or";
17. Paragraph 20 (5) reads:
"(5) The distribution system operator shall transmit to the market operator no later than 18.00 hours on the fifth working day following the end of the calendar month for each business hour preceding the month and for each distribution system operated by it.
(a) actual values
1. the supply and collection of electricity at each transfer point of the type B power generation plants;
2. electricity supplies and withdrawals at individual customer demand points with type B measurement;
3. the supply and collection of electricity at individual transmission points between different regions of type diagrams or distribution systems with type B measurement;
4. the supply and consumption of electricity at individual demand points with power generation pursuant to Article 28 (5) of the Energy Act with type B measurement;
5. electricity withdrawals for other sampling points not referred to in points 1 to 4 with type B measurements; and
(b) the actual value of the electricity supplies and withdrawals in the form of the sum delivered and the sum of the electricity collected during the preceding month;
1. at each transmission point, electricity production with type C measurement; and
2. at transfer points between distribution systems with type C measurement. ';
18. in Article 20 (5) (a):
"(a) actual values
1. the supply and collection of electricity at each transfer point of the type B power generation plants;
2. electricity supplies and withdrawals at individual customer demand points with type B measurement;
3. electricity supplies and withdrawals at individual measurement points between different regions of type diagrams or transmission points between distribution systems with type B measurement;
4. the supply and collection of electricity at the individual transfer points of the demand points with the production of electricity pursuant to Section 28 (5) of the Energy Act with the measurement type B,
5. the supply and collection of electricity not specified in points 1 to 4 with type B measurements a ';
19. in Paragraph 20 (6), the words "at the point of transmission" shall be inserted after the words "at the point of collection" and the words "at the point of collection" shall be replaced by the words "at the point of collection";
20. in Articles 21 (1), 23 (3) and 28 (2) (b), the text "or M" shall be deleted;
21. In Paragraph 21 (1), the words "transmission points of demand points, transmission points of production for TVS and" shall be inserted after the words "electricity generation"; the words "supply points for the system" shall be inserted.
22. In Article 21 (2), the words "transmission points of production for TVS and" shall be inserted after the words "individual" and the words "supply points for the system."
23. In Article 21 (3), the words "in the transmission points of production for TVS" shall be inserted after the words "in the system."
24. in Paragraph 22 (1):
"(1) The transmission of actual values of electricity supplies and withdrawals shall be subject to:
(a) the transfer point of the sampling point;
(b) to the point of transmission of each individual electricity plant;
(c) the transmission point of the transmission system operator or distribution system operator; or
(d) the measurement points between the supply type diagram regions. ';
25. in Articles 22 (2), 54 (5), 56 (4) and 60 (2), the text "A, B or M" is replaced by "A or B."

"(2) At each trading hour, the market operator shall determine the contracted amount of electricity to each entity for the obligation to supply electricity to the electricity system (hereinafter referred to as the" total contracted amount of electricity ') and the contracted amount of electricity to withdraw electricity from the electricity system (hereinafter referred to as "total contracted amount of electricity') in MWh, rounded to 3 decimal places, as a sum of:
(a) the agreed supply of electricity to the clearing entity in an organised short-term electricity market;
(b) the contracted amount of electricity for the obligation to supply electricity to the electricity system through bilateral transactions;
(c) agreed electricity withdrawals of the clearing entity in an organised short-term electricity market; and
(d) the contracted amount of electricity for the obligation to withdraw electricity from the electricity system through bilateral transactions;
determined on the basis of the data provided for in Sections 4 to 9. ';
38. Paragraph 27 (5) is deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
39. in Paragraph 30 (1), the third sentence is deleted;
40. In Paragraph 33, at the end of paragraph 2, the sentence "Where a change of supplier is made to a market operator later than 10.00, the application shall be supplemented by the following working day."
41. In Paragraph 33, the following paragraph 3 is inserted after paragraph 2:
"(3) A request for a change of supplier at the sampling point shall be understood as a request for a change of supplier at each transfer point of the sampling point. When the supplier changes at the transmission point of the TVS production facility, the supplier changes at each transmission point of the production site of the TVS. ';
Paragraphs 3 to 7 shall be renumbered paragraphs 4 to 8.
42. in Article 33 (4) (f), the words "sampling or transfer point code" shall be replaced by the words "sampling point code or production point for TVS."
43. Paragraph 33 (5) is deleted.
Paragraphs 6 to 8 shall become paragraphs 5 to 7.
44.Paragraph 33 (5) reads as follows:
"(5) The market operator shall make it possible to submit a request for a change of supplier for a demand point or a transfer point for a TVS production facility, even if the market operator's information system does not register the demand point with its transfer points or the production point for a TVS production facility. ';
45. in Articles 33 (6) and 35 (1), "3" is replaced by "4."
46. In Paragraph 34 (1), the word "point 'shall be inserted after the word" point'; the words "production centre for TVS 'shall be inserted after the word" production centre for TVS'; the sentence "Application for the conclusion or amendment of a service contract for the transmission or distribution system for the transmission point of the production plant for TVS shall be inserted after the word" production centre for TVS '; the sentence "Application for the conclusion or amendment of a service contract for the transmission or distribution system for the transmission point of the production plant for TVS shall be inserted;';
47. In Paragraph 34, the following paragraph 2 is inserted after paragraph 1:
"(2) The request for the conclusion of a contract for the provision of a transmission or distribution system service at a demand point shall mean the request for the conclusion of a contract for the provision of a transmission or distribution system at each demand point. ';
Paragraphs 2 to 7 shall be renumbered paragraphs 3 to 8.
48. in Article 34 (5) (b), the words "or the point of transfer of production for TVS" and the words "sampling or transfer points" shall be replaced by the words "production points or production points for TVS."
49. in Paragraph 34 (5) (d), the words "with a customer" shall be inserted after the word "connection."
50. in Article 34 (6) and (7), "4" is replaced by "5."
51. in Paragraph 35 (1), the sentence "If an application for a change to the type of contract is submitted to a market operator later than 10.00, the following working day shall be added after the first sentence."
52nd Paragraph 35 (1) (e) reads:
"(e) the identification code number of the sampling point or transfer point of the production facility for the TVS; and ';
53. Paragraph 35 (2) reads as follows:
"(2) A request for a change in the type of contract at the sampling point shall mean an application for a change in the type of contract at each transfer point of the sampling point. A request for a change in the type of contract at the transmission point of the TVS production facility shall mean an application for a change in the type of contract at each transmission point of the production site of the TVS. ';
54. in Article 35 (3), (4) and (5), the words "or 2" shall be deleted;
55. in Article 35 (5), the word "lodged" shall be inserted after the words "application for modification of the type of contract."
56. Paragraph 35 (6) reads:
"(6) The market operator shall immediately inform the existing supplier of the outcome of the assessment of the application for modification of the type of contract upon receipt of the information referred to in paragraph 5. In the event of the agreement of the transmission or distribution system operator with a change in the type of contract to which the supply of electricity is subject, the market operator shall register the change at the transmission point of the demand or transmission point of the production facility for the TVS from the required date of efficiency, as long as the supplier is registered at the demand point or the transmission point of the production facility for the market operator. Where there is a change in the type of contract for combined electricity supply services to the type of contract for the supply of electricity, the distribution system operator shall ensure, on the date of registration of the change in the type of contract, the termination of the supply of the distribution system service to the demand point or transmission point of the production facility for the TVS in accordance with the existing contract. ';
57. in Article 36 (3), "3 to 5" is replaced by "5 to 7."
58. In Paragraph 37 (1), the word "location 'shall be inserted after the word" point' and the words "production centre for TVS 'shall be inserted after the word" point'.
59. Paragraph 37 (5) reads as follows:
"(5) Upon notification of the registration of the change of supplier, the new supplier shall conclude a contract or an amendment to the contract for the provision of a transmission or distribution system service involving a demand point with its transfer points or a transfer point for the TVS production facility concerned by the change. The transmission or distribution system operator concerned shall, at the date of effective change of supplier, ensure the transmission or distribution of electricity to the demand point or the transmission point of the production facility for a TSO under a contract concluded in accordance with the first sentence and shall terminate the transmission or distribution of electricity to an existing supplier. In the event that the supply of electricity pursuant to Paragraph 56 (1) has been interrupted at the demand point or the transmission point of the production facility for the TVS, the transmission or distribution system operator shall, within 2 working days of the date of effective change of the supplier, ensure the transmission of electricity or the distribution of electricity to the demand point or the transfer point of the production site for the TVS electricity market participant under the contract concluded in accordance with the first sentence and shall terminate the transmission or distribution of electricity to the existing supplier on the date of effective change of the supplier. ';
60. Paragraph 38 (1) reads:
"(1) The market operator shall, at the date of effective change of the supplier, cancel each individual assignment of the transfer point of the demand point or the transfer point of the production point for the TVS to those suppliers whose supplies are assigned to the transfer point of the demand point or the transfer point of the production point for the TVS to the new supplier, and shall immediately inform the supplier concerned, the clearing entity concerned and the transmission or distribution system operator. ';
61. in Paragraph 38 (2), after the word "subtraction" the comma shall be replaced by a dot and the words "in the case of sampling or transfer points" shall be replaced by the words "in the case of a sampling point or a transfer point of a production facility for TVS."
62. In Paragraph 38 (3), "planned annual consumption 'is replaced by" planned annual collection'.
