§ 1
Subject matter
(1) This Regulation amends, following the directly applicable European Union Firearms Deactivation Regulation (1), the procedure for issuing a Firearms Deactivation Certificate, which includes all parts of the weapon which the directly applicable European Union Firearms Deactivation Regulation requires, in a state which allows such deactivation ("the complete firearm '), the marking of the degraded complete firearm and the change of the category of degraded complete firearms.
(2) The destruction of a non-complete firearm or a separate main firearm shall be carried out in accordance with another legal provision (2).
§ 2
Certificate of complete firearm degradation, marking of degraded complete firearm and changing category of degraded complete firearm
(1) Where a complete firearm has been degraded in accordance with the directly applicable European Union Firearms Deactivation Regulation and, on the basis of the findings of the Czech Firearms Testing Authority ("the certificate ') submitted by the holder of the arms licence, together with the competent police department of the Czech Republic (4), it has issued a certificate of deactivation of the complete firearm in accordance with the model set out in the directly applicable European Union Firearms Deactivation Regulation (hereinafter" the certificate') to the holder of the arms licence which has been degraded, to carry out a common unequivocal marking of all parts of the complete firearm according to the model set out in the directly applicable European Union Firearms Deactivation Regulation (hereinafter "the designation ').
(2) The certificate is issued by the Police of the Czech Republic on a form, a model of which is set out in Annex 1 to this Regulation. The certificate shall be deemed to be a certificate of destruction of the weapon or ammunition or of the cutting of the weapon or ammunition.
(3) The model designation is set out in Annex 2 to this Regulation. In the event of the destruction of a complete firearm as provided for in the directly applicable European Union Firearms Deactivation Code, the holder of the arms licence shall place a mark on that firearm together with the control deactivation mark assigned by the Czech Office for the Testing of Weapons and Fire5). The marking and the control mark shall be placed on the weapon in such a way that they are clearly visible and unremovable.
(4) The competent department of the Police Department of the Czech Republic will confirm the change of weapon category in the central weapons register.
§ 3
Final provision
This Regulation has been notified in accordance with the procedure laid down in Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services.
§ 4
Efficacy
This Regulation shall enter into force on the first day of the third calendar month following its publication.
