DECLARATION
of 19 May 2015
on the establishment of protection zones for the natural health source of pelloid bearing Habbánka spa site Velichovka and the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
Establishment of protection zones
(Articles 21 (1), 22 (5) and 23 (3) of the Spa Act)
(1) For the protection of the natural medical source of the peloid bearing Habbánka (hereinafter referred to as "the source"), the district of Náhěděd shall be determined by the protection zones I and II.
(2) Level I protection zone consists of the territory on which the source is located. The territory consists of land parcels number 408 / 1, 408 / 2, 423 / 1, 423 / 2, 423 / 3, 423 / 4, 423 / 5, 423 / 6, 427 / 2, 430 / 6, 430 / 7, 436 / 8, 436 / 9, 457 / 1, 457 / 2, 457 / 3, 457 / 4, 457 / 5, 457 / 6, 457 / 7, 457 / 8, 457 / 9, 457 / 10, 458 / 1, 458 / 2, 458 / 3, 493 / 7, 493 / 8, 493 / 11, 658 / 1, 658 / 2, 658 / 3, 676 / 5 and 676 / 15.
(3) The definition of the protection zone I is graphically marked on the base map of the Czech Republic in the scale 1: 10 000, which is shown in Annex 1 to this decree, and on the base map of the Czech Republic in the scale 1: 50 000, which is shown in Annex 2 to this decree.
(4) The II-degree protection zone is located on the cadastral territory of the municipalities of Rožnov, Rtyna and Veličkovky and is graphically marked on the base map of the Czech Republic in the scale 1: 10 000, listed in Annex 1 to this order, and on the base map of the Czech Republic in the scale 1: 50 000, which is shown in Annex 2 to this order.
Definition of specific safeguard measures
(Articles 22 (5), 23 (3) and 24 (2) and (3) of the Spa Act)
(1) Part I of the protection zone at the place where the source is extracted must be fenced. This part of the first-degree protection zone is prohibited in accordance with the spa law.
(2) The following shall be prohibited in Level II protection zone:
(a) establish public burial sites;
(b) to build highways or long-distance pipelines;
(c) to build or operate petrol stations or oil boilers;
(d) to build or operate landfills of waste or storage areas of petroleum products, fertilisers and chemical products;
(e) carry out melioration work;
(f) to place field fertilizers or silage storage facilities;
(g) apply chemical plant protection products for which the quality or quantity of groundwater or source cannot be clearly excluded;
(h) discharge waste water or defective substances which may endanger the quality of surface or groundwater, into surface or groundwater waters or into the water stream, including their application to the surface of the terrain;
(i) to carry out work to drain or modify watercourses which could jeopardise the natural groundwater regime, except for the conduct of routine water flow management or land under water flow management;
(j) to build objects for agricultural production or to build or operate objects for industrial production or other objects in which it is a significant component of the technology of handling harmful substances which may endanger the quality of surface or groundwater;
(k) to export the contents of immediate pit, urine or manure of livestock to land;
(l) to set up camps, camps or other temporary accommodation facilities without ensuring the disposal of waste water into an immediate pit or public sewerage;
m) implement wells or heat pumps or build wells;
(n) carry out mining, mining or tearing operations; or
(o) use non-inert sprinkler materials for infrastructure maintenance.
Efficacy
This Decree shall take effect on 1 June 2015.
