on secondary schools
The Ministry of Education of the Czech Socialist Republic provides, pursuant to § 2 (2), § 63 and in agreement with the Ministry of Health of the Czech Socialist Republic pursuant to § 19 (5) (b), § 20 (3), § 21 (5), § 26 (3) and § 23 (4), § 26 (2), § 26a (4) and § 26b (4) of the Czech National Council Act No 77 / 1978 Coll., § 21 (3), § 22a (2), § 23 (2) and § 26b (4) respectively):
Čl. I
§ 1
Basic provisions
(1) This decree regulates the system of secondary school education and teaching, the establishment and abolition of secondary schools, the types of secondary vocational schools, the performance of compulsory secondary school education, the scope, conditions, duration and course of secondary school studies, the rules of pupils' conduct, their evaluation and classification, the duration and organisation of the study at work and the combined study, the organisation of the study of individual subjects and the postgraduate studies.
(2) The secondary vocational schools, gymnasium and secondary vocational schools (hereinafter referred to as "secondary schools") provide education and education in the fields of study and teaching listed in the Annex.
(3) Secondary schools are established and repealed 1) according to the network established by the Ministry of Education of the Czech Socialist Republic (hereinafter referred to as "Ministry of Education"), 2) and, as regards secondary schools, the Ministry of Health of the Czech Socialist Republic.2)
(4) The following types of secondary vocational schools are hereby established: secondary industrial school, secondary agricultural school, secondary forestry school, secondary fishing school, secondary medical school, secondary economic school, secondary hotel school, secondary school of social law, secondary library school, secondary teaching school, secondary artistic industrial school, secondary artistic craft school, secondary art school, secondary art school of art, conservatory, music and dance school.
(5) In order to develop the extraordinary talents and talents of pupils in the field of music, dance and sport, regional national committees may establish schools providing education and education which are otherwise acquired in the fifth to eighth grade of primary school and secondary schools.3)

ČÁST PRVNÍ

Compulsory secondary school education
§ 2
(1) Pupils who have been admitted to secondary school and do not have compulsory schooling completed shall complete compulsory schooling in secondary school.
(2) If a student who has not completed compulsory education does not start secondary school within three days of the beginning of the school year, the principal of the secondary school shall draw the written notice of the legal representative of the pupil, of the foster parent or of the citizen, or of the institution to which the pupil has been assigned to education by decision (hereinafter referred to as the "student representative ') to ensure that the student reaches secondary school regularly and on time. 4) If, within 10 days of the receipt of this notice, the student does not enter or is not excused by the student's representative, the Director of the secondary school shall notify the relevant national district committee without delay.
§ 3
The education of secondary school pupils who perform compulsory schooling and are for a long-term illness in home care or in health care institutions shall be provided by the Regional National Committee, which shall conduct the secondary school to which the pupil was admitted.

STUDY IN CENTRAL SCHOOL
Attendance to High School
§ 4
(1) It is the responsibility of the student to attend secondary school regularly and in a timely manner, according to the prescribed timetable, and to participate in teaching to all compulsory and optional subjects ("compulsory subjects") and to the optional subjects chosen by him.
(2) If a minor student is unable to attend the course for reasons known in advance, he / she shall ask the student's representative class teacher or master of vocational education to be released from the course; If a pupil is staying in a youth home, he shall inform the educator at the same time.
(3) If a minor is unable to attend a teaching for an unforeseen reason, the student's representative or, where appropriate, the educator, if the student is a resident in a youth home, shall, without undue delay, notify the class teacher or master of vocational education of the reason for his absence. A representative of a student staying in a youth home shall also inform the educator of the reason for his absence. When returning to school, a minor student is required to submit a note to the class teacher or master of vocational education signed by the student's representative, and if he is a student resident in a youth home, signed by his educator.
(4) Absence from teaching is excused only for serious reasons (pupil disease, family emergency, transport reasons, etc.). Absence for a disease that lasted up to two teaching days, is excused by a student's representative or tutor. If the absence lasts for more than two days, the pupil shall submit a certificate from the attending physician. 5) If a two-day absence for a pupil is repeated more frequently, the class teacher may require a doctor's certificate for each such absence.
(5) The absence of a pupil for pregnancy and maternity is as sorry as the absence for illness.
(6) An adult student shall apologize himself in the manner set out in paragraphs 2 to 4.
(7) If a pupil or one of the persons with whom he or she is living or in permanent contact has a communicable disease, the pupil shall notify the student and, if the minor is his or her representative and / or the tutor immediately to the principal of the school.
§ 5
(1) The principal of a secondary school may release a pupil, with the exception referred to in paragraph 2, from taking part in the course of compulsory education or from physical activities linked to the teaching of certain subjects, on the basis of the opinion of the competent doctor and, in the case of a person with altered capacity for work, on the basis of the opinion of the social security assessor. Releasing from physical education shall be carried out in accordance with specific regulations. 6)
(2) A pupil cannot be released for the whole or part of the school year from teaching a compulsory subject which is responsible for the training of a graduate such as workshop and operational exercises, vocational training, professional (artistic) practice, professional drawing, art preparation, design, professional modelling, modelling, professional modelling, practical training, practical exercises, laboratory exercises, in secondary education and physical education, music education and art education, in secondary medical schools of vocational training and training, in schools set up for the development of extraordinary talents and talents of pupils in the field of sport (§ 1 (5).
(3) If the nature of the teacher so permits, the principal of the secondary school may, on grounds of pregnancy or maternity, allow the pupil to prepare and perform the examinations within the time limits set by the principal of the secondary school. The principal of the secondary school shall grant such exceptions at the request of the pupil and, if the minor is a minor, after his / her representative has expressed his / her consent, taking into account the observations of the competent doctor or without the request of the competent doctor. Pupils may only take classes in subjects containing activities which are not prohibited by the special regulations (7).
(4) In special cases, if the nature of the teacher so permits, the principal of the secondary school shall, at the request of the pupil and if the minor is a minor, be allowed to prepare and carry out the examinations at the time specified by the principal of the secondary school, supported by a statement from the competent doctor to the affected or long-term student.
(5) At the request of the pupil and if he is a minor, the principal of the secondary school shall allow the student's representative to prepare and carry out the examinations according to the individual study plan, in agreement with the student. 8)
§ 6
Change in the field of study or teaching and transfer to another secondary school
(1) The change in the field of study or teaching in the first and second year of secondary schools9) is generally permitted by the Director of secondary school for the beginning of the school year. The condition for authorising a change is the medical fitness of a student to study and to pursue the profession to be prepared in a newly selected study or teaching field and the successful performance of the differences test from those compulsory subjects or from a teacher who has not been taught in the study or classroom in which the pupil is still studying. The content, scope and date of the differences examination shall be determined by the Director of the secondary school.
(2) The transfer to another secondary school (9) is authorised by the principal of the secondary school to which pupils apply in all the years of secondary school.
(3) A change in the field of study or teaching and transfer to another secondary school is permitted at the request of the pupil. A student's representative shall be required to make a request for a minor.
§ 7
Discontinuation
(1) The study may be interrupted by a pupil who has completed compulsory education. 10) if the student is a secondary vocational teacher, after consultation with the organisation for which he is preparing. At the end of the period of suspension, the student continues the year in which the study was interrupted. If the study has been interrupted after the successful completion of the year, the student shall start the following year after the study has ceased. If the period of suspension has elapsed during the school year, the principal of the secondary school shall allow the pupil to carry out additional examinations for the relevant period.
(2) Pregnancy and maternity are particularly serious personal reasons for discontinuation. The principal of a secondary school shall, on his own initiative, suspend his / her studies if practical teaching takes place in work and in workplaces prohibited by pregnant women and mothers until the end of the ninth month following childbirth under the special regulations (7), or if the practical teaching activities according to a medical assessment threaten the pregnancy of the pupil.
(3) If the reasons for the interruption of the study are omitted, the study may be terminated at the request of the pupil before the end of the period of interruption.
(4) A student's representative shall be required to comment on the application of a minor student in order to interrupt the study or to terminate the study before the expiry of the period.
§ 8
Progress to senior year and repetition
(1) A pupil who has benefited shall proceed to the upper grade. A pupil who has not benefited in the period of compulsory education shall repeat the year. 11)
(2) If the student has not benefited in a school year after completion of compulsory education, the Director of the secondary school may, at his request, authorise a repetition of the year; (11) a statement by his / her representative is required for the request of a minor pupil. The same year may be repeated only once.
§ 9
Leaving the study
(1) If a student who has completed compulsory education intends to leave his studies, 12) he shall inform the principal of the secondary school in writing; if the pupil is a minor, the representative of the pupil is part of the communication.
(2) The student ceases to be a secondary school pupil on the day following the date on which the communication on leaving the school was delivered to the Director of the secondary school. If a student is a secondary vocational teacher, the Director of a secondary vocational training course informs the organisation for which the student is preparing.
(3) If a student who has completed compulsory schooling does not attend classes for at least one week and is not excused, the principal of the secondary school shall invite the student in writing and, if he is a minor, the student's representative to prove the reason for the pupil's absence within a period to be determined by the Director of the secondary school; At the same time, he will point out that otherwise the student will be judged as leaving the study. If, within 10 days of receipt of the invitation, the pupil does not take up or is not substantiated by the reason for his absence at the school, the study shall be considered as having left the study on the first day following the deadline set by the principal of the secondary school for an apology; he ceases to be a student of the school on that day.

RULES OF ASSESSMENT AND GENERAL CLASSIFICATION
§ 10
Rules of conduct of pupils (school rules)
(1) Teachers have the following responsibilities:
(a) acquire knowledge and skills and acquire the habits needed to achieve secondary education or complete secondary education, prepare for creative work and professional activity in the profession, defend the socialist homeland and cultural life;
b) to adopt and follow the principles of socialist morality, to be disciplined, to follow the instructions of teaching staff, instructors and other school staff, and to comply with the rules of socialist coexistence in and outside the secondary school, so as to honor the school and self;
c) protect your health and the health of others, take care of cleanliness and order and assist in maintaining order in and around the school;
(d) be properly, clean and unequivocally dressed and dressed,
(e) to conserve school facilities, protect them from damage and handle textbooks and teaching tools economically;
(f) follow the hours of instruction, the extent of breaks and follow other instructions contained in the school's internal rules issued by the Director of the secondary school.
(2) The following shall be prohibited for pupils:
(a) smoking at school premises, students of daily studies and in school-organised activities;
(b) bring to school or to activities organised by an alcoholic beverage school and other harmful substances, or use them in school or in school-organised activities;
(c) bring to school or to activities organised by the school things dangerous to life and health and things that could distract other pupils from teaching.
§ 11
Education measures
(1) Education measures are commendations and other awards and measures to strengthen the discipline of pupils.
(2) Graduation or other valuation13) is awarded to pupils by a teacher, a principal of a secondary school or a body of government in education; they may also be awarded by a social organisation and, in the case of pupils in secondary vocational schools, by the organisation for which the pupil is preparing or by the authority which has set up the secondary vocational training centre. The praise is generally given before the assembly of classes or schools.
(3) According to the seriousness of the offence, pupils may be given some of the following measures: a warning of a class teacher, a reprieve of a class teacher, a reprieve of a school principal; for secondary school pupils who have completed compulsory schooling, suspension or suspension may also be imposed. The Director of the Secondary School shall decide on the suspension, and the Regional National Committee shall decide on the suspension, which shall conduct the school in a professional manner; if they are a student of a secondary vocational school, after discussion with the organisation for which the pupil is preparing. 14)
(4) In the decision on suspension from the studies referred to in paragraph 3, the Director of the secondary school shall set a probationary period of no more than one year. If the suspended pupil has been certified within the trial period, the exclusion shall be waived; If, within that period, the student commits another serious offence, the Director of the secondary school shall submit a proposal to the Regional National Committee, which shall be the head of the secondary school, to exclude the student from the study.
§ 12
Evaluation and classification of pupils
(1) The pupil's benefit in individual subjects is classified as follows:
1 - excellent
2 - commendable
3 - good
4 - Sufficient
5 - insufficient.
(2) The behaviour of the pupil is classified as follows:
1 - very good
2 - satisfactory
3 - less satisfactory
4 - unsatisfactory.
(3) The principal of the secondary school shall ensure that the benefit and behaviour of the student who is a minor is kept informed by his representative and, in the case of the pupil of the secondary vocational school, by the organisation for which the pupil is preparing.
(4) If the pupil cannot be tried and classified in due time in the first half for serious objective causes (e.g. long-term excused absence), the pupil is not classified for the first half. The Director of the secondary school shall fix a replacement term for its examination and classification, as a general rule, so that the classification can be completed no later than two months after the end of the first semester.
(5) If the pupil cannot be tried and classified in due time in the second half of the year for the reasons referred to in paragraph 4, the pupil shall be tested and classified for that period in the last week of August on the day appointed by the Director of the secondary school.
(6) If the student or the student's representative has doubts as to the accuracy of the classification at the end of the second semester, he may, within three days of the date on which he became aware of the result, ask the principal of the secondary school for a comical examination; If the teacher is the principal of the secondary school, the examination of the pupil by the Regional National Committee, which is the head of the secondary school, may be requested. A pupil may not be tested if, during the classification period, a pupil has already been medically tested from a subject whose classification is contested. The principal of the secondary school shall order a comical examination of the pupil on his own initiative if he finds that the teacher has grossly infringed the rules of evaluation and classification.
§ 13
Overall pupil rating
(1) The overall assessment of the pupil at the end of the first and second half expresses the results of its classification in compulsory subjects and the classification of its behaviour; does not include classification in optional teaching subjects.
(2) The overall assessment of the pupil at the end of the first and second half is expressed as follows:
a) served with honours
b) benefited very well
(c) benefit
(d) failed.
(3) The pupil has benefited from honours, if he does not benefit in any compulsory subject worse than commendable, the average benefit from compulsory subjects is not less than 1,5, his behaviour is very good and if he has the benefit of excellent vocational training in secondary vocational schools or of the main professional subject in the study groups 82 Arts, used art and handicrafts.
(4) The pupil has benefited very well, if he does not benefit worse than good in any compulsory subject, the average benefit of compulsory subjects is not lower than 2,00, his behaviour is very good and he does not benefit worse than the praiseworthy from vocational training in secondary vocational schools or from the main professional subject in the study fields of group 82 Arts, used art and handicraft art.
(5) The pupil has benefited if there is insufficient benefit in any compulsory subject.
(6) The pupil did not benefit from the benefit of a compulsory subject even after the correction test (§ 14).
§ 14
Corrective tests
(1) A pupil whose benefit is insufficient at the end of the second half of the second half of a maximum of two compulsory subjects may, with the agreement of the Director of the secondary school, take a corrective examination of those subjects. The final examination is not possible from vocational training in secondary vocational schools, from teaching subjects of art education, music education and physical education in secondary education schools and from the main professional subjects in the study fields of group 82 Arts, used art and handicraft art production.
(2) A pupil whose benefit at the end of the first half is insufficient from up to two compulsory subjects, which are taught only in the first half, may also take a corrective test.
(3) The term of the corrective examinations shall be determined by the Director of the secondary school in such a way that the corrective examinations are:
(a) they have been carried out in accordance with paragraph 1 by 31 August at the latest; a pupil who, for serious reasons, is unable to take the corrective test within the prescribed time limit may be authorised to take the corrective test by 15 September at the latest and a pupil who has been classified in the period referred to in § 12 (5) by 15 October,
(b) they have been carried out in accordance with paragraph 2 at the latest by the classification meeting for the second half of the year.
(4) A pupil who does not show up for a correction test without serious reasons shall be classified as insufficient in the subject of instruction for which he was to take a correction test.
§ 15
Comprehensive tests
(1) The pupil shall be classified on the basis of the results of the comic test in the following cases:
(a) if he performs a difference test;
(b) if tested within an alternate period,
(c) if the pupil or his representative so requests, or if the examination is carried out at the initiative of the principal of the secondary school,
(d) where he has carried out repair tests;
(e) in external examinations, in accordance with the individual study plan and in the study of individual subjects;
(f) in practical examinations in music and dance schools, in the conservatory and in professional examinations in the art fields of secondary vocational schools;
(g) if the tests referred to in Article 5 (3) to (5) are carried out,
(h) in the event of a pupil being released from school attendance.
(2) The Committee for Comprehensive Trials is at least three members. The Commission shall be composed of the President, who shall, as a general rule, be the principal of the secondary school or a teacher by whom he is the examiner, who shall, as a general rule, be the teacher teaching the pupil to the subject in question, and an associate who shall have an appointment for the same or related subject. The results of the examination shall be announced by the President publicly on the day of the examination.

Organisation of educational activities
§ 16
(1) In their educational activities, secondary schools provide theoretical teaching, practical teaching and non-vocational education differentiated by type of secondary school, field of study and field of study.
(2) In theoretical teaching, pupils acquire the knowledge, skills and habits they apply in practical activities. Theoretical teaching takes place continuously with practical teaching throughout the school period; It shall be carried out in accordance with the approved curriculum and curriculum.
(3) Theoretical teaching in daily studies shall also be organised in one or two time cycles if the continuous teaching is prevented by the dispersion of pupils from the headquarters of the secondary vocational school or by the nature of the study or teaching sector, e.g. assembly or seasonal work. For the rest of the school period, vocational training shall take place.
§ 17
Practical teaching
(1) Practical teaching shall be carried out according to approved teaching plans and syllables in the following main forms: vocational training, exercises, teaching experience and professional (artistic) practice.
(2) Practical training is carried out in schools, school establishments and institutions and organisations in the field of central bodies or national committees. 15) As regards the practical teaching of pupils in secondary schools and vocational schools, these bodies and organisations shall be designated by their superior body on a proposal from the Regional National Committee, which shall conduct the secondary school in question.
(3) Where practical training of pupils in higher education and vocational schools is carried out in institutions and organisations, the Regional National Committee shall conclude an agreement with the body or organisation in which practical training is to take place, specifying in particular:
(a) the type of activities to be carried out by pupils in practical training;
(b) place of practical training;
(c) the timetable for practical teaching, its duration and the date of its commencement;
(d) the number of pupils participating in practical training;
(e) working and hygiene conditions (accommodation and catering conditions, provision of equipment, tools and personal protective equipment),
(f) how pupils are remunerated for productive work;
(g) measures to ensure safety and health in practical training.

§ 18
Obligations of organisations in the provision and management of practical teaching
(1) The institutions and organisations in which practical teaching is carried out are required to create the necessary conditions for practical teaching, to provide specified teaching aids free of charge and to cover personal and material costs associated with practical teaching. 15)
(2) The institutions and organisations release for practical training proven, politically and professionally advanced workers who, by their personal characteristics and performance, may be a model for pupils (hereinafter referred to as "instructors").
(3) Instructors are remunerated for practical training activities under specific regulations. 17)
§ 19
School and vocational school care in practical training
(1) In practical teaching, the organisation provides, or provides, for pupils with a diet of 18) under the same conditions as other workers.
(2) Pupils who participate in practical teaching outside the school head office are paid for the fare to and from the place of practical teaching, from the resources of the national committee which is the head of the secondary school. Only proven fare per train in the second carriage class or bus is paid.
(3) Pupils who do not live at the place of practical instruction and who cannot be required to commute daily are obliged to provide free accommodation which complies with the hygiene requirements for mass accommodation. 19)
§ 20
Training of pupils in secondary vocational schools
(1) Vocational training is a basic subject of teaching for pupils in secondary vocational schools in which the objectives of their training are pursued. It is aimed at acquiring professional skills for the pursuit of the profession for which it prepares studies in the field of study or teaching. It shall be carried out in accordance with the curriculum in particular on productive work consisting of the manufacture of products, the performance of services or the performance of works of material value.
(2) Training training shall take place:
(a) in the preparatory period in groups led by the master of vocational education in secondary vocational schools or, where appropriate, in the centres of practical teaching or at the operational centres of organisations approved by the Director of the secondary vocational training centre; the size of the group is determined by the number of pupils in the relevant field of study or teaching per master of vocational education set out in Sections A and E of the Annex. Exemptions from the defined number of pupils in the group and from the organisation of vocational training may be authorised by the Ministry of Education on a case-by-case basis, at the request of the competent central authority,
(b) during the period of professional development, individually under the direct supervision of the designated pupil instructor at specified workplaces, generally by the organisation for which pupils are prepared, or at the workplaces of the secondary vocational training centres or practical training centres, which correspond with their equipment to the requirements of education and safe work and approved by the Director of the secondary vocational training centre or, as the case may be, the head of the training centre. The instructor shall perform direct supervision over a maximum of three pupils. The pedagogical activity of the instructor shall be managed and supervised by the pedagogical staff of the secondary vocational training centre designated by the instructor.
§ 21
Professional practice
(1) The professional practice of pupils of secondary vocational education who have completed compulsory education (20) aims to deepen the professional skills acquired in vocational training required for the pursuit of the relevant professional profession.
(2) The professional practice of pupils of secondary vocational schools is organised during a four-week period of school holidays, for the study and teaching fields for deep-sea mining of three weeks; It is carried out at the workplace of the organisations for which pupils are preparing, or in secondary vocational schools or in the centres of practical teaching. The organisation, secondary vocational training centre or practical training centre shall provide productive work involving activities which enhance the skills of pupils in vocational training.
(3) The professional practice of pupils in secondary education and vocational schools is carried out in institutions and organisations within the field of competence of central bodies or national committees. Its aim is to shape, deepen and consolidate the knowledge and skills of pupils, develop and strengthen their socialist awareness and work education and combine theoretical knowledge with the practical activities of pupils.
§ 22
Exercise
(1) Exercise shall be carried out as part of teaching subjects or as separate teaching subjects in schools or educational establishments, where appropriate in the institutions and organisations in the field of central bodies or national committees.
(2) In training, pupils verify and deepen theoretical knowledge, train and acquire skills in technological, technical, economic, graphic, artistic and other activities and in secondary health schools also in the provision of preventive care.
§ 23
Teaching practice of secondary vocational school pupils
(1) The teaching experience shall be organised in schools or educational establishments, or in bodies and organisations in the field of competence of central bodies or national committees.
(2) In teaching practice, pupils acquire basic skills and habits in working with tools, in controlling equipment, machinery and technical equipment and motor vehicles.
§ 24
Non-teaching education
(1) In organising non-secondary school education, the aim is to provide pupils with active rest, to develop their skills, talents and interests, to lead them to participate in social life of adequate age, to help them prepare for teaching and to contribute to the choice of profession.
(2) Self-education is carried out by educators and physical education instructors outside the secondary vocational education and training centres of practical education. Their number shall be as follows:
(a) for pupils receiving full-time care, including accommodation, 30 pupils shall be set at one educator; However, the number of educators in one youth home in the interests of continuous work in education outside teaching is not lower than three educators, regardless of the number of pupils accommodated,
(b) for non-accommodation pupils, up to 80 pupils shall be determined by one educator and for each starting number of 80 pupils by another educator;
(c) the physical education instructor shall be set at 100-200 students and for each starting number of 200 pupils another instructor; a physical education instructor shall not count against the number of educators.
§ 25
Breakdown of the period of study of secondary vocational pupils
(1) The period of study in the fields of study (21) and the period of study in the fields of study set out in the Annex is divided into the preparatory and professional development periods. 22) The preparatory period in the fields of study shall last for the period set out in Section A, for the period set out in Section E of the Annex. Other periods of study are periods of professional development.
(2) In the preparatory period, pupils, under the guidance of the Master of Vocational Education, acquire skills and habits, in particular on productive work, in accordance with the curriculum of vocational training.
(3) In particular, pupils shall exercise and improve the skills and habits acquired during the preparatory period, in accordance with the curriculum of vocational training. Practicing and improving skills and habits takes place on productive work under the guidance of instructors.

STUDIO IN EMPLOYMENT IN MULTIAD SCHOOL, COMBINED STUDIO AND STUDIO IN SINGLE SUBJECT MATTERS
§ 26
Organisation of employment studies in secondary schools
(1) Studies in secondary education may be organised in the study and teaching fields listed in the Annex; in secondary vocational schools set up by the Director-General of the Production Unit or by an authority which performs a similar function or, where appropriate, the Director of the Economic Organisation, shall be organised with the agreement of those authorities.
§ 27
Types of study and its length
(1) The study in the employment of secondary vocational teachers is addressed to workers who, without fulfilling the qualification requirement of education, perform an employment relationship corresponding to the chosen field of study or school; it shall be organised in the fields of study and teaching listed in Sections A, D and E of the Annex;
