on the safety and health at work and safety of the operation of dedicated electrical equipment in mining, mining and explosives management activities
The Czech Mining Authority shall determine, pursuant to § 5 (3), § 6 (6) (a) and (b) and § 8a (8) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll. and Act No. 124 / 2000 Coll., and under § 38 (1) of Act No. 18 / 2004 Coll., on the Recognition of Professional Qualifications and Other Eligibility of Nationals of the Member States of the European Union and certain Members of other States and on the amendment of certain laws (Act on the Recognition of Professional Qualifications), as amended by Act No. 189 / 2008 Coll.

BASIC PROVISIONS
§ 1
Subject matter
(1) The Order provides for:
(a) dedicated electrical equipment and their classification in classes and groups;
(b) requirements to ensure safety and health at work on dedicated electrical equipment1) and their operation and safety of the operation of such equipment ("safety of work and operation") used
1. in mining activity 2),
2. in the course of a mining activity (3);
3. when handling explosives,
4. in workplaces with the activities referred to in points 1, 2 or 3 related, such as substations, compressor stations, service stations, control, measuring and security centres and construction sites;
(c) the conditions laid down for the competence of design, assembly, repair, revision, testing and operation of dedicated electrical equipment and their necessary technical equipment and for the competence of the employees of organisations and other natural persons when they are performing or operating work on dedicated electrical equipment;
(d) more detailed requirements for workplace, technical equipment and working environment.
(2) This decree does not apply to:
(a) conformity assessment of products before they are placed on the market or put into service for which the technical requirements to be met by such products are laid down by another legislation4);
(b) electrical equipment of road and special vehicles admitted to use on the road (5), including their inseparable equipment;
(c) railway vehicles on rail (6);
(d) electrical equipment for mobile devices (7), wheeled, rolling and belt vehicles, in particular lorries, dredges, loaders and bulldozers, unless they require the connection of a power plant to an electrical network or to an electrical centre.
§ 2
Definition of terms
(1) For the purposes of this decree:
(a) professional qualifications
1. completed education in the field of education of group 26 "Electronics, telecommunications and computing" 8),
2. completed education in another field which meets the requirements of electrical education; or
3. completed professional qualifications obtained 9) in the field of qualification "Electronics, telecommunications and computing" published in the National Qualifications System;
(b) professional qualifications (10) acquired in the field of qualification "Electronics, telecommunications and computing" published in the National Qualifications System;
(c) works on dedicated electrical equipment for installation, repair, maintenance, inspection, revision and testing of dedicated electrical equipment, as well as all work for the provision of workplaces and measurement of portable equipment;
(d) by securing the workstation of the operation carried out on a dedicated electrical device under voltage to secure the workstation for the safe performance of that device or in the vicinity of live parts under voltage; from the time the workstation is secured, work on this device shall be considered to be work on an electrical device without voltage;
(e) the operation and operation of the dedicated electrical equipment, such as control, switching, regulation, management of the technological line, monitoring of its operation and data of permanently placed devices, synchronising and exchanging threaded and instrument fuses;
(f) a competent expert, a competent natural person who ensures that the organisation is properly carried out on dedicated electrical equipment and its operation and the safe operation of such equipment;
(g) authorising officer for a mine, a quarry, a racetrack, and for activities for which this function is not required, a statutory authority or an undertaking natural person;
(h) accompanying documentation of a set of documents in the Czech language supplied by the manufacturer, importer, person authorised by the manufacturer or importer, or distributor, where appropriate, allowing safe installation, operation, repair, maintenance, inspection, revision and testing, as well as the exchange of individual parts;
(i) the inspection of the operation to verify that the dedicated electrical equipment in question complies with the operating conditions, is installed and operated in accordance with the accompanying and operational documentation and is not visibly damaged by the operation of the electrical equipment in question, in such a way as to jeopardise the safety of work and operation;
(j) a written document as part of the operational documentation to which the organisation defines the requirements, time limits, procedures, rules and records in the operating book for the inspection and maintenance of class A dedicated electrical equipment, including preventive maintenance, and specifies the deadlines for periodic revisions;
(k) by checking a summary of the operations in which the technical condition of the dedicated electrical equipment in terms of safety of work and operation is determined by inspection, measurement and functional test.
(2) If the term is used in this decree
(a) the organisation is an organisation under the Mining, Explosive and State Mining Act and, if it employs natural persons to perform dependent work, it is an employer;
(b) an employer, it is an employer under the Labour Code.
(3) A person trained, electrotechnician, chief electrical technician, revision technician, coordinating and supervising person is understood as a natural person in this decree.

EXTENDED ELECTRIC DEVICES, THEIR CLAIMS AND GROUPS AND COMPETITIVENESS FOR MONITORING, CORRECTION, REVIEW AND TESTS FOR EXTENDED ELECTRIC DEVICES
§ 3
Classification of reserved electrical equipment into classes and groups
(1) Reserved electrical equipment shall be classified in Class A or Class B according to the degree of hazard to the safety of work and operation.
(2) The reserved class A electrical equipment is:
(a) electrical equipment for the production, conversion, transmission, distribution and collection of electricity;
(b) electrical equipment in spaces and environments (hereinafter referred to as "the environment") with a risk of explosion of gases, vapours, fog, aerosols or dust, or an exposure to explosion and fire of explosives;
(c) equipment intended to protect against effects
1. atmospheric electricity;
2. static electricity in an environment with a risk of explosion of gases, vapours, fog, aerosols or dust, or in an environment with a risk of explosion and fire of explosives;
except for electrical equipment referred to in paragraphs 4 and 6.
(3) Reserved class electrical equipment A is, for the purposes of this Decree, classified in descending order according to the degree of danger to safety and operation in categories A1, A2, A3 and A4 in accordance with Part A of Annex 1 to this Decree.
(4) The reserved class B electrical equipment is:
(a) electric hand tools, electronic apparatus and electrical appliances of a similar nature, up to a voltage of 400 V, unless intended for fixed connection to the electrical network;
(b) extension line and removable supply to 400 V voltage.
(5) For the purposes of this decree, Class B electrical equipment reserved shall be classified, in descending order of the degree of hazard to the safety of work and operation, in categories B1, B2, B3 and B4 as set out in Part B of Annex 1 thereto.
(6) The reserved electrical equipment is not:
(a) electrical equipment and installations with a current or voltage not exceeding safe values under the laws and regulations to ensure safety of work and operation11), unless it is intended for use in an explosive explosion, vapour, mist, aerosols or dust hazard environment;
(b) electrical equipment with its own source of electricity, unless it requires a connection to the electrical network, including detachable accessories intended to charge its source, if it is not permanently connected to the electrical network;
(c) medical electrical apparatus and measuring instruments;
(d) life-saving apparatus, breathing apparatus and artificial pulmonary ventilation apparatus and their accessories, control and test apparatus and rescue technica12);
(e) dielectric protective and working equipment, equipment and tools for working on a dedicated electrical device (hereinafter referred to as the "device.")
§ 4
Professional competence requirements for operators and work on dedicated electrical equipment
(1) The installation, repair, service, inspection and testing of dedicated electrical equipment can only be performed
(a) a legal person through competent natural persons (13);
(b) an undertaking natural person himself, if he is competent or through a competent natural person; or
(c) a competent natural person.
(2) Specially qualified for the installation, repair, revision and testing of a class A dedicated electrical equipment is a legal or business natural person authorised to the required extent in accordance with Annex 2 to this Regulation, issued by the Circular Mining Office.
§ 5
Approval for the installation, repair, revision and testing of class A dedicated electrical equipment
(1) The organisation requesting the district mining office to issue an authorisation for the installation, repair, revision and testing of reserved electrical equipment shall demonstrate that:
(a) it has the necessary technical equipment and facilities for the installation, repair, revision and testing of dedicated electrical equipment;
(b) has at least one responsible professional person who is the head of an electrical technician in accordance with Article 8 (2) or a revision technician in accordance with Article 9 (2) with a certificate of adequate scope issued in accordance with Article 10 (4);
(c) be able to ensure, by its own activity or in a contractual manner, that the work which is necessary or part of the work which it requests to be carried out is carried out.
(2) Upon compliance with the conditions set out in paragraph 1, the organisation shall receive from the Circuit Mining Authority an authorisation for the installation, repair, revision and testing of dedicated electrical equipment with the scope set out in Annex 2 to this Decree, which shall be valid for 5 years after its issue.
(3) The organisation shall notify any changes related to the fulfilment of the terms of the authorisation issued referred to in paragraph 1 within 15 days of their establishment to the district mining office which issued it.
(4) Approval for assembly, repair, revision and testing is not required for an organisation which:
(a) operates only dedicated class B electrical equipment; or
(b) it has the installation, repair or revision and the tests provided by the contractor with the appropriate scope of approval.
(5) Authorisations for mining and mining activities (14), as well as for the design of objects and equipment which form part of these activities, under another legislative provision (15), are not required if the organisation exclusively performs assembly, repair or revision and testing of dedicated electrical equipment, or the design of installation of dedicated electrical equipment pursuant to § 13 (2) and (3).

REQUIREMENTS FOR PERSONS 'ELECTRIC EQUIPMENT AND WORKING PERFORMANCE
§ 6
Person instructed
(1) The person instructed is the person who was an electrical technician, a leading electrical technician or a revision technician properly in the previous 3 years
(a) trained on legislation and other regulations to ensure safety of work and operation for activities on and near dedicated electrical equipment;
(b) trained in the areas of potential sources and causes of risk in and near dedicated electrical installations;
(c) alerted to the potential threat to a dedicated electrical device;
(d) the procedures for the provision of first aid for electric shock, taking into account the nature and extent of the work on dedicated electrical equipment to be carried out and this knowledge has been verified.

(2) The content and duration of the training, familiarity and verification referred to in paragraph 1 shall be determined by the responsible expert or authorising officer.
(3) The organisation shall issue to the person instructed a document signed by the responsible expert or authorising officer for the training, notification, familiarity and knowledge verification. The document shall specify the scope of the instruction, including the specification of the workplace on which the trained person is to operate. A copy of the document shall be kept by the organisation for at least 3 years. This is without prejudice to the obligation to keep documentation in case of other legislation16).
§ 7
Electrical technician
(1) Electrical technician is a person experienced in electrical engineering with:
(a) the professional qualifications referred to in Article 2 (1) (a); or
(b) the professional qualifications referred to in Article 2 (1) (b), subject to compliance with the requirements laid down in paragraph 7, which have the required experience as referred to in paragraph 2, and which, after having been trained, has complied with, in the course of the verification of proficiency in the performance of electrical engineering activities in organisations of the scope of the panel (hereinafter referred to as the "examination"), which shall be repeated within 3 years of the previous examination.
which has the required experience referred to in paragraph 2 and which, after having been trained, has complied with the verification of competence in the performance of electrical engineering activities in organisations designated before the Commission ("the examination '), which shall be repeated within 3 years of the previous examination.
(2) The required practice shall be determined by the responsible expert or authorising officer in accordance with an assessment of the risks of the various activities carried out by the electrical technician. For a candidate who does not have the professional qualifications obtained by completing at least the Bachelor's study programme, the period of experience under the supervision of an electrical technician who has experience of at least 2 years shall be:
(a) professional qualifications of at least 12 months;
(b) professional qualifications of at least 6 months;
(c) professional qualifications within the scope of secondary education with a graduate examination of at least 3 months.
(3) The examination and re-examination shall be preceded by training of at least 8 teaching hours, the content of which shall be determined by the responsible expert or authorising officer taking into account the nature and extent of the activities on dedicated electrical equipment to be carried out by the electrical technician; shall not be entrusted with other tasks during training. For training, the organisation shall ensure appropriate conditions with appropriate equipment, qualified persons according to § 7 to 9 or designer of electrical installations (hereinafter referred to as the "designer") and experienced instructors from other disciplines.
(4) The examination of the candidate for the competence of an electrical technician or of his re-examination shall be carried out by a three-member examination panel appointed by the authorising officer or by a responsible expert whose chairman shall have the expertise of an electrical technician, a revision technician or a designer, and at least one member shall have the competence to work on a dedicated electrical equipment. The Commission shall obtain a copy of the examination, including a copy thereof, in Annex 3 to this Regulation. The date and place of the examination or re-examination shall be notified by the organisation to the District Mining Office at least 4 weeks before it takes place; that period may be shortened by the District Mining Authority upon request.
(5) On the basis of the successful examination referred to in paragraph 4, the organisation shall issue to the electrotechnician a document signed by the responsible expert or authorising officer, the copy of which shall be kept by the organisation for at least 3 years. The document shall state:
(a) the name and, where appropriate, the names and surnames of the electrical equipment;
(b) the date and place of birth;
(c) achieved education in electrical engineering;
(d) date of examination;
(e) the period of experience on dedicated electrical equipment up to 1 kV AC or 1,5 kV DC and above 1 kV AC or 1,5 kV DC;
(f) the scope of the dedicated electrical equipment as specified in Parts A and B of Annex 2 to this Regulation, corresponding checking,
(g) for an electrical technician with professional qualifications, a list of specific works on dedicated electrical equipment corresponding to checking;
(h) the date of issue of the document.
(6) If an electrical technician is to carry out this activity in another organisation, that organisation
(a) recognise previous electrical competence; or
(b) ensure that it is trained and checked in accordance with paragraphs 3 and 4.
(7) On the basis of a risk assessment, the responsible professional person is entitled to provide for specific work on dedicated electrical equipment that the professional qualifications referred to in Article 2 (1) (a) of the professional qualifications referred to in Article 2 (1) (b) may be replaced. In such a case, the responsible professional person shall issue a written document in accordance with the model in Annex 4 to this Order specifying precisely the scope of the work taking into account the professional qualifications obtained. The written document shall be valid only in the organisation in which it was issued.
(8) An organisation of an electrical engineering with a professional qualification as referred to in Article 2 (1) (b) and (7) shall not:
(a) performance of foreman's work on dedicated electrical equipment
1. above 1 kV AC or 1,5 kV DC,
2. in an environment with a risk of explosion of gases, vapours, fog, aerosols or dust, or in an environment with a risk of explosion and fire of explosives;
(b) the exercise of the activities of the coordinating persons pursuant to Articles 16 (3) and 22 (9);
(c) the performance of the activity of the Head of Work pursuant to Article 22 (4) (a);
(d) the exercise of the activities of a supervised person pursuant to Article 22 (4) (b);
(e) issuing a security order (hereinafter referred to as the B command) pursuant to Article 22 (3).
§ 8
Head of electrical engineering
(1) The head of the electrical technician shall be a person experienced in electrical engineering and shall be competent to manage the installation, operation, revision, testing, inspection and operation of the dedicated electrical equipment.
(2) The head of electrical engineering may, on the basis of a written mandate by the authorising officer, carry out the activities of the responsible professional person.
(3) Head of electrical engineering
(a) has the professional qualifications referred to in Article 2 (1) (a);
(b) for certificates with a distinguishing mark C2, C3 and C4 as referred to in Annex 2 to this Decree, at least the secondary electrical education with a graduate examination shall be provided, unless other legislation provides for conditions other than 18);
(c) complies with the minimum period of professional experience referred to in paragraph 4; and
(d) has a valid certificate issued by the Circular Mining Office pursuant to Article 10 (4).
(4) The required period of professional experience shall be:
(a) for certificates with a distinguishing number of C4 as referred to in Annex 2 to this Decree for 5 years,
(b) for certificates with distinguishing marks C2 and C3 in accordance with Annex 2 to this Regulation for operational voltage
1. E3 2 years,
2. E2 3 years,
3.E1 4 years,
(c) for certificates with a distinguishing mark C1 as referred to in Annex 2 to this Regulation for operational voltage
1. E3 1 year,
2. E2 2 years,
3. E1 3 years.
(5) The professional practice of the applicant shall include an activity in the performance of the professional competence of electrical technicians in accordance with § 7 and a maximum of 1 year in the performance of the professional competence of the review technician in accordance with § 9 or the designer. In the cases referred to in paragraph 4 (a), (b) (3) and (c) (3), at least half of the required professional experience period shall be carried out on dedicated electrical equipment above 1 kV AC or 1,5 kV DC.
§ 9
Revision technician
(1) The Revision Technique is a person experienced in electrical engineering and is competent to carry out revisions and tests of class A reserved electrical equipment.
(2) A revision technician may, on the basis of a written mandate by the authorising officer or contract with the organisation, carry out the activities of the responsible expert for the proper conduct of the revisions and tests of class A reserved electrical equipment in the organisation.
(3) The Revision Technician has the professional qualifications referred to in § 2 (1) (a) in the range of at least secondary education with a graduate examination, fulfils the requirement for a minimum period of professional experience referred to in paragraph 4 and holds a valid certificate issued by the Circular Mining Office pursuant to § 10 (4).
(4) The required period of professional experience, following Annex 2 to this Decree, provides for a certificate with a distinguishing mark
(a) C4 6 years,
(b) C2 and C3 5 years,
(c) C1 4 years.
(5) The professional practice of the applicant shall include an activity in the performance of the professional competence of electrical technicians referred to in Section 7, the leading electrical technician referred to in Section 8, the current activity of the revision technician and a maximum of 2 years of professional experience in the performance of the professional competence of the designer, with at least half of the required period of professional experience being carried out on dedicated electrical equipment above 1 kV AC or 1,5 kV DC for the operating voltage E1 according to Part A of Annex 2 to this Decree.
§ 10
Verification of the professional competence of the head of electrical engineering and of the revision technique
(1) The professional competence of the head of electrical engineering and of the revision technician is examined by the district mining authority in accordance with § 41 (1) (h) of the Mining, Explosives and State Mining Administration Act by an examination to the extent set out in Annex 2 to this Decree.
(2) In order to verify professional competence, the applicant shall provide originals or officially certified copies of evidence of formal professional qualifications and evidence, where appropriate, showing overall experience on dedicated electrical equipment of the relevant scope as set out in Annex 2 to this Decree. If the documents are in a language other than the language of the case (19), they shall also provide an officially certified translation into the Czech language.
(3) The candidate's competence shall be assessed by the examination committee; its chairman is a natural person involved in the exercise of the powers of the Circular Mining Office - an official person appointed by the Chair of the Circular Mining Office. An external expert in electrical engineering with experience of at least 5 years may also be present on the test committee.
(4) A certificate shall be issued for the successful completion of the test referred to in paragraph 1. The certificate replaces the evidence of checking of electrical engineering pursuant to § 7 (5) and the certificate of competence of technical supervision for the performance of an electrotechnical activity issued by an organisation under another legislation20).
§ 11
Validity of the certificate of the head of electrical engineering and of the revision technique and the change in its scope
(1) The certificate of the head of electrical engineering and of the revision technician shall be valid for a period of 5 years from the date of issue. The validity of certificates for a further period of 5 years shall be extended on the basis of a successful examination. An application for renewal of a certificate shall be submitted 60 days before the expiry of the certificate.
(2) Where an application for extension of a valid certificate of additional scope pursuant to Part A or Part B of Annex 2 to this Regulation is submitted by the head of the electrical engineering or revision technician, a new certificate shall be issued on the basis of a further successful examination with extended content.
(3) The failure check may be repeated not more than twice within the specified time limit, but not earlier than 28 calendar days after the failure check.
(4) If a serious infringement to ensure safety of work and operation is detected in the exercise of the supreme supervision of the State Mining Administration, the holder of the certificate may be subjected to an examination outside the term of the repeated examination. The scope of the certificate may be amended or withdrawn.
(5) The change in the scope of the certificate of the head of electrical engineering and of the revision technician shall take place in accordance with Section 10.

ČÁST ČTVRTÁ

INSTALLATION OF ELECTRIC INSTALLATIONS FOR OPERATIONS AND THEIR OPERATIONS
§ 12
Essential requirements to ensure safety of work and operation of dedicated electrical equipment
(1) The work on the dedicated electrical equipment and its operation shall be managed by a leading electrical technician or, where appropriate, by other legislature (21), or, where specified by the organisation, by the management of the electrical equipment, who shall further entrust a person or persons who are at least competent in accordance with § 7, whose duties include ensuring the safety of the work and operation of the particular dedicated electrical equipment and define this obligation according to their place of performance.
(2) Reserved electrical equipment may be fitted, operated, maintained and repaired and subject to revisions, tests and checks only if it is ensured that the technical design, installation and location corresponding to the design, drawing, accompanying and operational documents22) persons are protected against the risk of injury and property from damage to the electrical current or voltage, and, where appropriate, from the effects of electricity, and from the non-electrical nature of the electrical equipment.
(3) Before indicating the class electrical equipment reserved A protocol on the determination of external influences as referred to in Annex 5 to this Regulation, assessed by the responsible expert and approved by the authorising officer, shall be drawn up for the work in question, provided that the determination of external influences is not part of the operational documentation.
(4) Reserved class electrical equipment A shall be subject to the initial revision and, where appropriate, to the periodic and, where appropriate, exceptional revisions by which the inspection referred to in Part A of Annex 6 to this Regulation and the examination involving testing and measurement in accordance with Part B of Annex 6 to this Regulation shall verify its safe condition and, at the same time, the safety of the downstream technical equipment, irrespective of its type. If any of the points of the inspection or test referred to in the first sentence are technically not feasible for a revised dedicated electrical equipment or is not justified for the purpose of verifying its safety, such inspection or test shall not be required; the imfeasibility or unjustifications of the inspection and testing shall be decided by the revision technician.
(5) After revision of the dedicated class electrical equipment A revision technician shall draw up a review report in accordance with Part C of Annex 7 to this Regulation on the basis of the necessary supporting documents in accordance with Part A of Annex 7 to this Regulation. The revision report shall demonstrate the assessment of the state of the dedicated electrical equipment at the time of the revision and compliance with the requirements imposed on it in terms of safety of work and operations in accordance with the laws and regulations (11) in force at the time of its entry into service, reconstruction or modernisation, unless otherwise provided for in this legislation.
(6) Reserved Class B electrical equipment is subject to regular checks within the time limits set out in Part B of Annex 8 to this Regulation, or exceptional checks where appropriate, by an electrical technician or at least by a person trained under the supervision of an electrical technician.
(7) A dedicated electrical device for which a condition of immediate danger to the safety of work or operation is detected shall be immediately disconnected from the power supply and secured against unwanted connection; If this is not possible, use should be avoided. Reserved electrical equipment is considered to be a threat to safety of work and operation.
(a) Class A,
1. operated at the workplace for which no protocol on the determination of external influences has been drawn up in accordance with Annex 5 to this Decree;
2. to which the operator does not provide a valid revision report with the result that the installation in question is capable of safe operation;
3. which is operated in breach of the rules of inspection, maintenance and revision referred to in Article 14 (3); or
4. to which the rules of inspection, maintenance and revision have not been issued,
(b) Class B,
1. which was not classified in the relevant group before use; or
2. to which the operator has not provided a valid certificate of inspection in accordance with Part C of Annex 9 to this Decree with the result of "good condition" or "satisfactory condition."
(8) The aid shall be kept in good condition and used in accordance with instructions and instructions. For the aids listed in Part C of Annex 8 to this Decree, periodic inspections and tests shall be carried out within the time limits set out in that Annex. If a satisfactory condition is detected by the test, the device shall be marked in a way resistant to damage so that it can be verified who and when the test has been carried out, otherwise the device shall be discarded. A successful test may be replaced by a test of the aid if the test is carried out at the time when the examination was to be carried out.
§ 13
Safety and operation requirements for dedicated electrical equipment when putting them into service
(1) The installation of Class A dedicated electrical equipment shall be carried out according to:
