GOVERNMENT REGULATION
of 2 March 2005
amending Government Regulation No 225 / 2004 Coll., on certain details of the implementation of selected market measures of the common organisation of the market in milk and milk products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., and under § 11c (7) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll.:
Government Regulation No 225 / 2004 Coll., on certain details of the implementation of selected market measures of the common organisation of the market in milk and milk products, is amended as follows:
1. In Article 3 (2), the words "or any storage place situated outside the applicant's premises' shall be inserted after the words" establishment ';
2. In Article 5 (1), the word "cold store 'is replaced by the word" freezer'.
3. in Article 5 (4), in the title and in points 1, 2 and 4 of Annex No 2, the word "refrigerating" shall be replaced by "freezing."
4. In Article 5 (7), "Czech table butter 'is replaced by" Czech cream butter' (8a) ';
Footnote 8a reads:
"8a) Decree No. 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended by Decree No. 124 / 2004 Coll. and Decree No. 78 / 2005 Coll. '.
5. the following Section 6a is inserted after Section 6, including the title and footnote 11a:
Aid for skimmed milk and skimmed-milk powder used as animal feed
The payment of the aid for skimmed milk and skimmed-milk powder used for animal feed shall be made by the Fund within 90 days of the date of receipt of the impeccable application for such aid (11a).

6. Article 7, including the title and footnotes 12, 12a, 12b and 12c, reads:
Aid for the sale of butter at reduced price
(1) The Fund grants aid to approved suppliers (12) for the sale of butter at a reduced price on the basis of a certificate issued by the Fund (hereinafter referred to as "voucher") 12a, to natural or legal persons or to the organisational components of the State, providing social or health services or performing educational or educational functions, operating exclusively within the territory of the Czech Republic (hereinafter referred to as "non-profit organisations").
(2) The request to issue a voucher 12b) is submitted by the Fund's non-profit organisation using the form issued by the Fund. The application shall be accompanied by the original or an officially certified copy of the extract from the commercial register, the instrument of incorporation, the contract establishing a legal person or any other document certifying the legal status of the applicant for the issue of the voucher.
(3) The application for aid for the sale of butter at a reduced price is submitted by the authorised supplier to the Fund on the basis of a form issued by the Fund, within the time limit laid down by European Community rules 12c). Applications may be lodged for a quantity of at least 3 tonnes of butter.
(4) A non-profit organisation that has been sold butter at a reduced price on the basis of aid for the sale of butter at a reduced price granted to an approved supplier (12) shall:
(a) accounting and other documents relating to butter so sold and subsequently used for at least 10 years after the end of the calendar year in which the butter was sold to it;
(b) the documents on the basis of which the Fund issued a reduced-price butter order for at least 5 years after the end of the calendar year in which the voucher was issued.

7. The following Sections 7a and 7b are inserted after Section 7, including the headings and footnotes 13 and 14:
Aid for the production of casein and caseinates from skimmed milk
The application for aid for the production of casein and caseinates from skimmed milk 13) shall be submitted by the authorised casein and caseinates producer of the Fund on the basis of a form issued by the Fund for the calendar month immediately elapsed.
Cost of sampling and laboratory analysis
Save as otherwise provided in the European Communities, the costs incurred in the context of sample sampling and laboratory analysis (14) shall be borne by the aid applicant.

8. In Annex 1, points 5 to 7 are added in Group A:
"5. Dried whey, packed in bags of 25 kg.
6. Dried milk, defatted with a fat content of up to 1,5% by weight, of a kind used as animal feed, packed in bags of 25 kg.
7. Casein, packed in bags of 25 kg. '
9. In Annex 1, in Group B, the following point 6 is added:
'6. Butteroil with a fat content by weight of more than 99,3%. '
Efficacy
This Regulation shall enter into force on 1 April 2005.
