DECLARATION
of 16 January 2017
amending Decree No. 99 / 1995 Coll., on the Storage of Explosives, as amended
According to § 22 paragraph 6, § 29 paragraph 3 and § 30 paragraph 2 of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll., Act No. 315 / 2001 Coll., Act No. 376 / 2007 Coll. and Act No. 451 / 2016 Coll.:
Decree No. 99 / 1995 Coll., on the Storage of Explosives, as amended by Decree No. 342 / 2001 Coll. and Decree No. 200 / 2006 Coll., is amended as follows:
1. In the introductory sentence of the Decree, the words "§ 6 (6) (a), § 29 (4) and § 32 (7) 'are replaced by the words" § 22 (6), § 29 (3) and § 30 (2)' and the words "Czech National Council No. 542 / 1991 Coll. 'are replaced by the words" § 542 / 1991 Coll., Act No. 315 / 2001 Coll., Act No. 376 / 2007 Coll. and Act No. 451 / 2016 Coll.'.
2.
Subject matter
This decree provides
(a) explosive hazard classes, requirements for the design and securing of explosives warehouses on and under the surface, requirements for the design and securing of explosives warehouses at manufacturers and customers, requirements for safety of operation and health at work in explosives warehouses and requirements for the storage and storage of explosives,
(b) the conditions for the operation, location and execution of special explosives storage facilities;
(c) technical requirements for the location and execution of explosives storage. ';
footnotes 1 and 2 are deleted, including the footnotes.
3. In Section 3, the words "explosives (" warehouse "), in front of the explosive storage compartment, on the outside, shall be inserted after the word" warehouse "."
4. In Paragraph 4 (b), the word "calculated 'is replaced by the words" minimum leave'.
5. in Article 4 (e) and (f):
'(e) by intermediate storage, a warehouse intended for the storage of explosives to ensure the smooth production or processing of explosives, including the assembly of manufactured explosives series;
(f) joint storage of explosives in a single compartment for the storage of explosives, ';

Safety distance
The project documentation shall include the determination of the safety distance. This distance shall be calculated in accordance with Annex 2 to this Decree. The classification of explosives for the purpose of determining safety distances shall be carried out in accordance with Annex 1 to this Regulation. Where explosives of different hazard classes are stored in the warehouse as referred to in Annex 1 to this Regulation, the safety distance shall be determined according to the explosive of the highest class and group of hazards, taking into account the overall lining of the store. ';
7. In Article 6 (7), the words "an entrepreneur is obliged 'are replaced by the words" an organisation is obliged' and in Article 43 (2), the words "an entrepreneur is obliged 'are replaced by the words" an organisation is obliged'.
8. Paragraph 7 (3), including footnote 3, reads:
"(3) The warehouse door is built as resistant to burglary. This requirement shall be deemed to be met if the requirements of the Czech technical standard, which lays down requirements for door resistance against burglary (3), are met, corresponding to at least safety class 4.

9. Paragraph 8 (1), including footnote 4, reads:
"(1) The construction products of the reaction-to-fire class A1, A2 or B classified according to the legislation governing the technical conditions of construction fire protection 4 shall be used for the construction of walls, bulkheads, guarantees, doors, exhaust surfaces and roof structures. Construction products of wood can only be used with a treatment ensuring the reaction class to fire B classified under the legislation governing the technical conditions of fire protection building 4).

10.Paragraph 8 (7) reads:
"(7) Doors and frames can only be in design with opening out, without thresholds and tight throughout their perimeter. In the case of a store of black powder or explosives with a sensitivity similar to it, doors, frames, locks and fittings shall be carried out in such a way as to avoid sparks during friction or impact. ';
11. in Article 17, the sentences of the second and third shall be deleted;
12. in Articles 22 (d) and (l), 31 (2) and 33 (1), the words "explosives contained in other explosive articles" shall be replaced by "other explosives,"
13. in Articles 31 (1) (c) and 40 (7), the word "industrial" shall be deleted;
14. In Paragraph 37 (1), the second sentence is replaced by the following: "Construction products of wood may be used only with an adjustment ensuring the class of reaction to fire B classified under the legislation governing the technical conditions of construction fire protection 4. '.
15. in § 39 (1), § 42 (10), § 43 (3), (4) and (9) and § 44 (3), the word "entrepreneur" shall be replaced by "organisation"; in Article 43 (3), the word "entrepreneur 'is replaced by" organisation' and in Article 44 (2), the word "entrepreneur 'is replaced by" organisation';
16. in Paragraph 39 (5):
"(5) The warehouse in which the explosives are stored must be equipped with a functional device for measuring the temperature and humidity in the storage room."
17. in Paragraph 39 (7):
"(7) The keys to the warehouse, including spare keys, shall be stored only at the location specified in the operational documentation. The keys shall be secured against theft or unauthorised use and at any time accessible to the control authorities. The first and second sentences shall apply mutatis mutandis to other means of locking the warehouse. ';
18. in Article 41 (1) and (2):
"(1) Only explosives which, according to Annex 4 to this Decree, are compatible with each other may be stored together, unless otherwise provided for in this Decree.
(2) No storage with other explosives
(a) detonators or other igniters, except in the cases referred to in paragraphs 8 and 9;
(b) black powder or composition of a composition similar to that of black dust;
(c) explosives or explosive mixtures, except in the cases referred to in paragraph 4;
d. Liquid nitric acid esters;
(e) pyrotechnic alloys; or
(f) explosives containing chlorate or perchlorate. ';
19. in Paragraph 41 (5) and (9), the word "industrial" shall be deleted;
20. In Paragraph 41 (8), the word "industrial 'is deleted.
21. In Paragraph 42, paragraphs 1 and 7 are deleted.
Paragraphs 2 to 6 shall become paragraphs 1 to 5 and paragraphs 8 to 11 shall become paragraphs 6 to 9.
22. in Article 42 (4) and (5), the word "industrial" shall be deleted;
23. in Paragraph 42 (4) (a), the words "Annex 4, which forms part of this Order, otherwise" shall be deleted;
24. In Paragraph 43 (8), the words "reserved place 'are replaced by the words" designated place in the operational documentation'.
25. Paragraph 45 (2) is deleted and paragraph 1 is deleted.
26. In Annex No 1, in the title of the table, the words "CLASS OF EXPLOSIVES 'are deleted and in the table, the words" Type of explosive stored' are replaced by the words "Stored substance, mixture or article '.
27. In Annex 1, in order number 1 of the table, the words "or explosives not authorised for carriage in accordance with Annex A to the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) 'shall be inserted at the end of the text.
28. In Annex 1, the text in order number 8 of the table reads:
"Explosives free of charge, semi-plastic, plastic, emulsion explosives and solubility type explosives initialled by a detonator with an igniting force corresponding to REF. DET 313) '.
Footnote 13 reads:
"13) ČSN EN 13763-15 Explosives for civil use - Detonators and retarders - Part 15: Determination of equivalent initialisation force."
29. In Annex 1, the text in order number 18 of the table reads:
"DAP explosives and emulsion explosives which are not initiable by a detonator with an igniting force corresponding to the REF. DET 313) or other explosives not listed in the table meeting the criteria for classification in subsection 1.5 of Annex A to the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) '.
30. In Annex 1, in order number 21 of the table, the words ", picric acid containing water or a mixture of water with alcohol above 30% 'are deleted.
31. In Annex 1, the text in order number 28 of the table reads:
"Explosives of hazard class A which meet the conditions for classification in hazard class B by design or packaging, or other explosives in a table not listed, provided that they meet the criteria for classification in subsection 1.2 or 1.6 of Annex A to the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) '.
32. In Annex 1, the text in order number 38 of the table reads:
"Pyrotechnic compounds of Group 3, explosives of hazard classes A and B which, by design or packaging, fulfil the conditions for classification in hazard class C or other explosives in a table not listed if they meet the criteria for classification in subsection 1.3 of Annex A to the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) '.
33. In Annex 1, the text in order number 39 of the table reads:
"Explosives of hazard classes A, B and C which, by design or packaging, fulfil the conditions for classification in hazard class D or other explosives in a table not listed if they meet the criteria for classification in subsection 1.4 of Annex A to the Europe Agreement on the International Carriage of Dangerous Goods by Road (ADR) '.
34. In Annex 2, paragraph 5, the words "Coefficient values' are replaced by the words" Coefficient values'; in paragraph 8, the words "and ammunition above 60 mm 'are deleted; and in paragraph 13, the second sentence is deleted.
35. Annex 4 shall read as follows:
"Annex No 4 to Decree No 99 / 1995 Coll.

G Pyro-technical composition or product containing a pyrotechnic composition or product containing both an explosive and a lighting, ignition, combustion, tear-forming or smoke-forming substance (excluding products activated by water or products containing white phosphorus, phosphids, pyrophoric substances, flammable liquid or flammable gel or hypergols)
H Product containing explosive and white phosphorus
J Product containing explosive and flammable liquid or flammable gel

Transitional provisions
1. When changing the finished storage of explosives, maintenance work or the use of the explosives storage facility, the storage of explosives must comply with Decree No. 99 / 1995 Coll., as amended by that Order. When a part of an explosive warehouse or maintenance work on a part of an explosive warehouse is changed, the relevant part of the explosive warehouse shall be brought into conformity with Decree No 99 / 1995 Coll., on the storage of explosives, as amended by that Order.
2. Consent to derogate from the provisions of Decree No. 99 / 1995 Coll., on the storage of explosives, as effective before the date of entry into force of this Order, shall remain in force for the period stated therein.
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decision shall enter into force on 1 March 2017.
