on ensuring the technical security of classified information and certification of technical means
The National Security Office ("the Office ') provides, pursuant to Sections 50 (4) and 53 (3) of Act No. 148 / 1998 Coll., on the Protection of classified information and on the amendment of certain laws:
§ 1
Subject matter
This decree provides for the use of technical means in the protection of classified information, certification of technical means and the necessity of certificates.
§ 4
Certification of technical means
(1) Certification of technical means is a process of verifying the conformity of technical means intended to protect classified information with the Office's safety standards. The definition and different types of technical means are laid down in specific legislation. (1a)
(2) For the certification of a technical device, the applicant shall submit the following documents:
(a) an application for certification of a technical device bearing a list of documents;
(b) specification of technical means and user environment;
(c) an indication of the required category of technical means under Section 5 of this Decree;
(d) a declaration of the safety or conformity of the technical device;
(e) a declaration of the same composition and implementation of the technical means;
(f) an opinion issued by the designated organisation. (1b)
(3) With the documents referred to in paragraph 2, the applicant shall also provide the technical means to be certified if the Office so requests.
(4) The technical device certificate, the model of which is set out in the Annex, contains:
(a) the identification number of the technical device certificate;
(b) the unique type of identification of the device;
(c) details of the manufacturer of the technical device;
(d) details of the holder of the technical device certificate;
(e) the classification level for which the competence of a technical device has been approved pursuant to Article 5 of this Decree;
(f) the period of validity of the technical device certificate;
(g) the date of issue of the technical device certificate.
(5) The Office may be requested to issue a new certificate of technical means at least 30 days before its expiry.
§ 5
Classification of technical means
(1) Technical means are classified in the following categories according to the classification level of classified information used to protect them:
(a) "V" - technical means of protecting classified information of the classification grade "Reserved,"
(b) "D" - technical means of protecting classified information of the classification level "Confidential";
(c) "T" - technical means of protecting classified information of the classification level "Secret";
(d) "PT" - technical means of protecting classified information of the "Top Secret."
(2) A list of certified technical resources will be published in the Official Journal of the Office.
§ 6
The use of different categories of technical means in ensuring the protection of objects and secure areas within the scope of object security shall be laid down in a specific regulation. (1a)
§ 9
Efficacy
This decree shall take effect on the day of its publication.
