GOVERNMENT REGULATION
of 17 April 2024
amending Government Regulation No. 163 / 2002 Coll., laying down technical requirements for selected construction products, as amended
The Government orders pursuant to § 22 paragraph 1 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 205 / 2002 Coll., Act No. 34 / 2011 Coll. and Act No. 526 / 2020 Coll., ("the Act ') to implement § 11a (2), § 12 and 13 of the Act:
Government Regulation No. 163 / 2002 Coll., laying down technical requirements for selected construction products, as amended by Government Regulation No. 312 / 2005 Coll. and Government Regulation No. 215 / 2016 Coll., is amended as follows:
1. In Paragraph 2 (1), the last sentence is deleted.
2. In Article 2, paragraphs 3 to 5 are added:
"(3) On the basis of conformity assessment, the manufacturer or importer shall issue a declaration of conformity pursuant to Article 13 and attach a Czech mark of conformity to the product; the manufacturer or importer does not need to attach a Czech mark of conformity in the case of conformity assessment in the case of unit production pursuant to Section 9. The model of the Czech conformity mark is set out in Annex 4 to this Regulation.
(4) The Czech mark of conformity shall be affixed visibly, legibly and indelibly to the product. Where this is not possible or justified due to the nature of the product, it shall be attached to the packaging or accompanying documentation.
(5) If the Czech conformity mark is increased or reduced, the relative proportions between its individual elements shall be respected. The height of the Czech conformity mark shall not be less than 10 mm. ';
3. in Article 13 (1), the following point (f) is inserted after point (e):
"(f) a complete set of declared technical characteristics of the product which may affect at least one of the essential requirements for the construction works listed in Annex 1 to this Regulation; These characteristics shall be given within the range of the initial type test and shall be expressed by class, level, limit value or description so that the construction can be properly designed and carried out, ';
Points (f) to (h) shall be renumbered as points (g) to (i).
4. In Article 13 (1) (h), the words "meet the characteristics of the product 'are replaced by the words" meets the declared characteristics of the product, satisfying' and after the word "which 'is inserted" permanently'.
5. In Paragraph 13a (1), the words "or other 'are replaced by the words", other' and the words "or in Turkey 'are inserted after the words" the space'.
6. In Article 13a (2), "and Article 10 'is replaced by", 10 and 13';
7. The following Annex 4 is added, including the title:
"Annex No 4

Note: The pattern is displayed on an auxiliary grid which is not part of the Czech conformity mark and serves for the needs of its proportional enlargement or reduction. "
Transitional provisions
1. Products placed on the market before the date of application of this Regulation shall be subject to effective legislation at the time of placing on the market.
2. Documents issued or acquired in conformity assessment before the date of entry into force of this Regulation may be used for the purpose of issuing a declaration of conformity pursuant to Government Regulation No. 163 / 2002 Coll., as effective from the date of entry into force of this Regulation.
3. The declaration of conformity for which the conformity assessment procedure was carried out pursuant to Article 7 of Decree No. 163 / 2002 Coll., as effective before the date of entry into force of this Regulation, issued before the date of application of this Regulation shall remain valid for the period specified therein.
4. A declaration of conformity for which the conformity assessment procedure has been carried out pursuant to paragraphs 5 to 6, 8 or 9 of Decree No. 163 / 2002 Coll., as effective before the date of entry into force of this Regulation, issued before the date of application of this Regulation shall remain in force until the facts in which the declaration of conformity was issued have changed, but for a maximum period of 3 years from the date of entry into force of this Regulation.
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Regulation shall take effect on 1 January 2025.
