DECLARATION
of 9 May 2013
on energy specialists
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry") provides pursuant to Section 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 177 / 2006 Coll., Act No. 165 / 2012 Coll. and Act No. 318 / 2012 Coll., for implementation of Sections 10 (9) and 10a (7):
§ 1
Subject matter
(1) This decree specifies the content and scope of the professional examination, the content and scope of continuous training and checking of energy specialists authorised to:
(a) processing of energy audit and energy assessment;
(b) the processing of the licence;
(c) the carrying out of checks on operated boilers and thermal energy distribution; or
(d) carrying out control of air-conditioning systems.
(2) The Decree lays down the rules and proceedings of the Examination Committee and of organisations organising the ongoing training of energy specialists. At the same time, a model application for authorisation and a model application for continuous training as set out in Annex 1 to this Decree shall be established.
(3) The Decree lays down the formalities for keeping records of the energy specialist on the activities carried out.
(4) The Decree sets out the data held in the Energy Consumption Monitoring System.
§ 2
Expert examination and checking
(1) The technical examination or checking shall be carried out in the Czech language.
(2) The examination shall always have a written and oral part. The written part is carried out in the form of a test and its successful composition is a condition for the oral part of the examination. The oral part shall be conducted in the form of a debate on the basis of three applicants of winning thematic test circuits. The review shall take the form of a debate on the basis of supporting documents, which shall be reports on boiler checks and heat distribution, reports on air-conditioning systems controls, energy audits, energy assessments or certificates to be determined by the State Energy Inspection.
(3) The thematic test circuits for the oral part of the expert examination for the individual activities of an energy specialist referred to in Article 1 (1) are listed in Annex 2 to this Decree. The oral part of the expert examination shall examine the physicologically technical, economic and environmental knowledge of the energy of buildings and technical systems related to the different areas of activity of the energy specialist referred to in Article 1 (1) and resulting from the legislation governing energy management.
(4) The results of the oral part of the professional examination shall be assessed by grade satisfactory or not satisfactory, in such a way that:
(a) the applicant has complied, where the applicant has demonstrated knowledge in at least two winning thematic headings;
(b) the applicant has failed to comply if the applicant has not demonstrated knowledge in at least two headings.
(5) The written part of the technical examination shall examine the knowledge related to the various activities of the energy specialist referred to in Article 1 (1), namely the knowledge of legislation, Czech technical standards and technical documents, including technical standardisation information, as well as basic physical technical, economic and environmental knowledge. The written part of the professional examination shall consist of 50 questions for each of the activities of an energy specialist referred to in Article 1 (1).
(6) The test result is assessed by a degree of compliance or failure to comply with the correct responses obtained, expressed as a percentage, by:
(a) an applicant for an authorisation pursuant to Article 1 (1) (a) who has fulfilled:
1. less than seventy-five percent, failed;
2. seventy-five and more percent, satisfied,
(b) an applicant for an authorisation pursuant to Article 1 (1) (b) to (d) who has completed:
1. less than seventy percent, failed;
2.70% and more, he did.
(7) A report on the outcome of the technical examination or checking shall be obtained from the technical examination or checking. The report shall include an evaluation of both the written and oral part of the professional examination or an evaluation of the debate in the event of examination and determination of whether the applicant or the energy specialist has passed or failed the expert examination. The model of the report on the result of the technical examination or examination is set out in Annex 3 to this Regulation.
(8) The maximum duration of the written part of the professional examination is 3 hours. The maximum duration of the oral part of the professional examination and examination shall be 1 hour.
(9) The date and place of the professional examination or examination shall be notified by the State Energy Inspection in writing to the applicant or the energy specialist at least 15 days before the professional examination or examination.
§ 3
Continuous education
(1) Continuous training is carried out in the Czech language.
(2) The content of continuous training is given by the thematic headings listed in Annex 4 to this Decree.
(3) The written expert test shall consist of a maximum of 50 questions for each of the activities of the energy specialist referred to in Article 1 (1).
(4) The results of the written expert test shall be assessed by a degree of compliance or failure to comply with the correct responses obtained, expressed as a percentage, by:
(a) an energy specialist authorised under Paragraph 1 (1) (a) who has completed:
1. less than seventy-five percent, failed;
2. seventy-five and more percent, satisfied,
(b) an energy specialist authorised under § 1 (1) (b) to (d) who has completed:
1. less than seventy percent, failed;
2.70% and more, he did.
(5) A report on the outcome of continuing education shall be drawn up. The protocol shall include a written expert test with its evaluation and determination of whether or not the energy specialist has complied. The model of the protocol on the outcome of continuous training is set out in Annex 5 to this decree.
(6) The maximum duration of the written expert test is 3 hours.
(7) The term and place of continuous training shall be chosen by an energy specialist from an offer published by the Ministry in a way which allows remote access, by means of a record of the activities carried out.
§ 4
Test Panel
(1) The examination committee shall have at least 11 members, one of whom shall be appointed chairman and at least 2 vice-chairmen shall be appointed. The examination committee shall be composed of representatives of the Ministry, universities and professional organisations.
(2) The Board of Appeal shall be chaired by the President of the Commission, and, if he is not present or has appointed a Vice-President, the Vice-President of the Commission.
(3) The members of the Examination Board, including the President and Vice-Presidents, are appointed and removed by the Central Director of the State Energy Inspection.
(4) The Central Director of the State Energy Inspection will appoint and remove the Secretary of the Examination Board from the civil servants assigned to the State Service in the State Energy Inspection. The Secretary shall provide organisational and administrative work related to the deliberations of the Examination Board and shall participate in its deliberations.
(5) The Secretary shall convene the Examination Committee at least once every two months or at the request of the Ministry.
(6) The examination committee shall be quorum in the presence of at least 7 members, one of whom shall be chairman or vice-chairman, and provided that the absolute majority of the members of the examination panel are representatives of the Ministry and experts from universities. The results of the expert examination and examination shall be decided by a majority of the members present.
(7) The Chairman or Vice-Chair of the Examination Board shall notify the applicant of the outcome of the expert examination or examination on the day of its performance.
(8) The report on the outcome of the expert examination or examination shall be signed by all members of the examination committee present.
(9) Minutes shall be taken of the examination committee's deliberations. This entry also includes individual protocols on the result of expert tests of applicants and checks of energy specialists. The minutes shall be drawn up by the Secretary and signed by the President or the Vice-President.
§ 5
Organisation responsible for organising ongoing training
(1) The organisation organising continuous education is a university technical school entrusted with the Ministry.
(2) Continuous training shall take place at least once every 2 months or at the request of the Ministry.
(3) The report on the outcome of continuous training shall be signed by the authorised representative of the organisation and by a member of the examination committee or by another person appointed by the Ministry.
(4) On-going training shall be recorded by the organisation. The minutes also include individual protocols for continuing training of energy specialists.
§ 6
Scope of data transmitted to the Ministry's register on the activities carried out by energy specialists
The data transmitted by the energy specialist to the Ministry's records are set out in Annex 6 to this decree.
§ 6a
Data maintained in the Energy Monitoring System
The data held in the Energy Consumption Monitoring System are set out in Annex 7 to this Decree.
§ 7
Efficacy
This Decree shall take effect on 1 June 2013.

B. Circles of test questions on details of the preparation of the energy performance certificate of buildings
1. Act No. 406 / 2000 Coll., on Energy Management, as amended, implementing legislation on the energy performance of buildings including related technical standards and technical standardisation information.
2. Obligations and details relating to reducing the energy performance of buildings and buildings with almost zero energy consumption.
3. Obligations and details relating to the processing of the energy performance certificate of buildings. Details of the calculation of the partial energy delivered and the calculation of the heat transfer coefficient.
4. Definition of the energy performance of buildings. Energy performance indicators of the building, method of setting benchmarks. Binding compliance with energy performance indicators.
5. Energy performance requirements, details of building energy performance requirements set at cost-optimal level. Details of the calculation of total energy needs to ensure typical use of the building, auxiliary energy, supplied energy, renewable and non-renewable primary energy.
