DECLARATION
of 17 April 2025
amending Decree No. 99 / 2012 Coll., on Minimum Personnel Security Requirements for Health Services, as amended
The Ministry of Health provides, pursuant to Section 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended by Act No. 65 / 2017 Coll., for the implementation of Section 11 (4) of the Health Services Act:
Čl. I
Decree No. 99 / 2012 Coll., on minimum staff security requirements for health services, as amended by Decree No. 287 / 2013 Coll., Decree No. 285 / 2017 Coll., Decree No. 304 / 2019 Coll., Decree No. 357 / 2020 Coll., Decree No. 340 / 2022 Coll. and Decree No. 393 / 2023 Coll., is amended as follows:
1. in Article 1 (1) (h), the words "and nursing care in social services establishments" shall be inserted after the word "care."
2. In Paragraph 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (k) is added:
"(k) mental health centres are set out in Annex 11 to this decree."
3. In Annex 1, Part I, Section B, point 2.4:
"2.4. Physiotherapy
A physiotherapist fit to pursue a profession without professional supervision. ';
footnote 10 is deleted.
4. In Annex 3, Part In point 8, the words "and long-term bed care 'are replaced by the words", long-term bed care and welfare care' and the words "and II.4. 'are replaced by the words" to II.5'.
5. In Annex 3, Part In point 12, the words "childcare 'are replaced by the words" social-health care'.
6. In Annex 3, Part I, point 16 reads as follows:
"16. In addition, health care is provided by a nutritional therapist within the range of 0.1 per 30 beds. in the case of patients receiving acute bed care in the field of surgery, internal medicine, pediatrics or psychiatry, health care is provided by a nutritional therapist in a period of 0,3 per 30 beds. ';
7. In Annex 3, Part I, point 19 (b), the words "and II.5. 'are deleted.
8. In Annex 3, Part II, point 4.1 (c):
'(c) a general nurse or a practical nurse, a total of 6,0 days, of which at least 33% of the general nurse,'.
9. In Annex No 3, Part II, point 4.1 (d), the words ", nurse or masseur 'are replaced by the words" or caregiver'.
10. In Annex 3, Part II, point 4.1 (e), the words "or an ergotherapist without supervision 'are deleted and the word" a' is replaced by a comma.
11. In Annex 3, Part II, at the end of point 4.1, the dot is replaced by a comma and the following point (g) is added:
"(g) ergotherapy - availability."
12. In Annex 3, Part II, point 4.2, the words ", gerontopsychiatry or sexologist 'are replaced by" or gerontopsychiatry'.
13. Point 5 of Part II of Annex 3 reads as follows:
"5. SOCIAL-HEALTH STREET
5.1. Social-health care
(a) a doctor with specialised competence, specific professional competence or special specialised competence 0,2 time;
(b) a general nurse with specialised competence without supervision of 1,0 time;
(c) a general nurse or a practical nurse, a total of 6,0, of which at least 33% of the general nurse,
(d) a physical therapist without supervision of 0,2 time;
(e) clinical psychologist - availability
f) ergotherapy - availability.
5.2. Where social-health care is provided exclusively to patients with psychiatric illness, the staff shall be provided by the healthcare professionals referred to in points 5.1 (b) to 5.1 (e) and by a psychiatrist or a gerontopsychiatrist of 0,2 time. ';
14. At the end of the text of the title of Annex 8, the words "and nursing care in social services establishments' are added.
15. In Annex 8, point 1:
"1. nursing care
The home care provider must have at least one general nurse in the field of expertise
(a) a nurse for internal care;
(b) a nurse for surgical care,
(c) a nurse for care in geriatrics,
(d) intensive care nurse,
(e) nurse for wound healing,
(f) psychiatric care nurse,
(g) a nurse for home and hospital care; or
(h) a nurse with special competence with a focus on nursing care for a geriatric or gerontopsychiatric patient or a patient with functionally severe chronic disability.
Where domestic nursing care is provided to children under 3 years of age, such care shall be staffed by a nurse competent to pursue the profession without professional supervision. ';
16. Point 3 of Annex 8 reads as follows:
"3. palliative care
The home palliative care provider must have at least one general nurse in expertise
(a) a nurse for internal care;
(b) a nurse for surgical care,
(c) a nurse for care in geriatrics,
(d) intensive care nurse,
(e) nurse for wound healing,
(f) psychiatric care nurse,
(g) a nurse for home and hospital care; or
(h) a nurse with special competence with a focus on nursing care for a geriatric or gerontopsychiatric patient or a patient with functionally severe chronic disability.
Where home palliative care is provided to children under 3 years of age, such care shall be staffed by a nurse competent to pursue the profession without professional supervision. ';
17. In Annex 8, point 4 is added:
"4. nursing care in social services facilities
The staff security of nursing care in social services facilities must correspond to the total amount of nursing care needed to be provided to patients in social services facilities. A practical nurse may only participate in the provision of nursing care in social services provided that at least one general nurse is physically present in the exchange, in the case of the provision of care to children, a nurse, to provide immediate advice and assistance. However, the minimum requirements of points 4.1 to 4.3 must always be met.
4.1. Nursing care in social services accommodation
4.1.1. If it is weekly stationary, homes for elderly people, homes for disabled people, homes with special regime and accommodation facilities for relief services, nursing care must be staffed by a general nurse in the
(a) at least 6,5 time-limits when nursing care is provided in continuous operation; or
(b) at least 2,5 days, unless nursing care is provided in continuous operation.
4.1.2. At least one general nurse as referred to in point 4.1.1 shall be a professional nurse
(a) a nurse for internal care;
(b) a nurse for surgical care,
(c) a nurse for care in geriatrics,
(d) intensive care nurse,
(e) nurse for wound healing,
(f) psychiatric care nurse,
(g) a nurse for home and hospital care; or
(h) a nurse with special competence with a focus on nursing care for a geriatric or gerontopsychiatric patient or a patient with functionally severe chronic disability.
4.1.3. The requirements of point 4.1.1 shall not apply where the provision of residential social services of a Community nature is concerned; in that case, the requirements of paragraph 4.3 shall apply.
4.2. nursing care in outpatient social services
4.2.1. If the day-care centres, day-care centres and outpatient relief facilities are concerned, care must be staffed by a general nurse to the extent that the patient's health requires the provision of such nursing care.
4.2.2. At least one universal nurse of the provider must be a nurse of expertise
(a) a nurse for internal care;
(b) a nurse for surgical care,
(c) a nurse for care in geriatrics,
(d) intensive care nurse,
(e) nurse for wound healing,
(f) psychiatric care nurse,
(g) a nurse for home and hospital care; or
(h) a nurse with special competence with a focus on nursing care for a geriatric or gerontopsychiatric patient or a patient with functionally severe chronic disability.
4.3. nursing care in social services of a community character
If the provision of nursing care in social services of a community character is concerned, the provider must have at least one general nurse in the professional capacity
(a) a nurse for internal care;
(b) a nurse for surgical care,
(c) a nurse for care in geriatrics,
(d) intensive care nurse,
(e) nurse for wound healing,
(f) psychiatric care nurse,
(g) a nurse for home and hospital care; or
(h) a nurse with special competence with a focus on nursing care for a geriatric or gerontopsychiatric patient or a patient with functionally severe chronic disability. "
18. The following Annex 11 is added:

"Annex No 11
Personnel security requirements for mental health centres
1. Mental Health Center for Persons with Severe Mental Disorder
(a) psychiatrist, 0,5 time;
(b) a clinical psychologist, 0,5 time;
(c) a psychiatric nurse for 2.0 time.
The psychiatrist referred to in point (a) or the clinical psychologist referred to in point (b) shall also be a physician, a psychotherapist or a psychotherapist, in such a way that the cumulative amount of the medical attention of a psychotherapist or psychotherapist is at least 0,5.
2. Mental Health Center for Children
(a) a child and adult psychiatrist of 0,3 time;
(b) a paediatric clinical psychologist or a clinical psychologist of 0,3 time;
(c) a child nurse for a children's and adult psychiatry or a nurse for psychiatric care of 1.0 time.
A child and adult psychiatrist as referred to in point (a) or a child clinical psychologist or clinical psychologist as referred to in point (b) shall also be a doctor of a psychotherapist or psychotherapist in such a way that the cumulative amount of the medical attention of a psychotherapist or psychotherapist is at least 0,3.
3. Mental health center for seniors
(a) a gerontopsychiatrist or psychiatrist of 0,2 time;
(b) geriatr 0,2,
(c) clinical psychologist 0,2 time;
(d) a psychiatric care nurse of 1.0 time.
A Gerontopsychiatrist or a psychiatrist as referred to in (a) or a clinical psychologist as referred to in (c) must also be a physician, a psychotherapist or a psychotherapist, so that the cumulative amount of the medical attention of a psychotherapist or psychotherapist is at least 0,2.
4. Mental Health Center for Persons with Addictological Disorder
(a) psychiatrist, 0,5 time;
(b) clinical psychologist 0,2 time;
(c) adictologist 1,0 time;
(d) a psychiatric care nurse for 0.5 time.
5. Mental health centre for persons with ordered protective treatment
(a) psychiatrist of 1,0 time;
b) Clinical psychologist 1,0 time;
(c) a psychiatric nurse, one-and-a-half hours. ';
Čl. II
Transitional provision
The health service provider, who is entitled to provide health services in the form of bed or home care or palliative health care before the date of entry into force of this Decree, must comply with the requirements for the staff security of health services laid down in Decree No. 99 / 2012 Coll., as effective from the date of entry into force of this Decree, no later than 31 December 2026.

Efficacy
This Decree shall take effect on the day following that of its publication.
