DECLARATION
of 17 April 2025
amending Decree No. 92 / 2012 Coll., on the requirements for minimum technical and material equipment of medical facilities and home care contact centres, as amended
According to Section 120 of Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision of Health Services (Health Services Act), as amended by Act No. 65 / 2017 Coll., for the implementation of Section 11 (6) of the Health Services Act:
Čl. I
Decree No. 92 / 2012 Coll., on the requirements for minimum technical and material equipment of health care facilities and home care contact centres, as amended by Decree No. 284 / 2017 Coll., Decree No. 339 / 2022 Coll. and Decree No. 357 / 2024 Coll., is amended as follows:
1. In the title of the decree, the words "home care 'are deleted.
2. In Article 1, at the end of paragraph 2, the dot is replaced by a comma and the following point (j) is added:
"(j) mental health centres are set out in Annex 12 to this Decree."
3. In Article 1 (3), the words "and nursing care in social services facilities' shall be inserted after the words" care '.
4. In Annex No 4, Part II, the following point 4.5 is added:
"4.5. If long-term bed care is provided to children, each patient must have a separate room, equipped with a bed for his escort."
5. Point 5 of Part II of Annex 4 reads as follows:
"5. Social-health care
5.1. Part II, point 4 of this Annex shall apply mutatis mutandis to the requirements for the welfare ward.
5.2. If care is also provided to patients with severe spinal cord impairment, the equipment for medical devices referred to in point 4.2 of Part II of this Annex shall be added.
5.3. If social-health care is provided to children, each patient must have a separate room, equipped with a bed for his escort. "
6. In Annex 11, the words "and nursing care in social services facilities' shall be added at the end of the text of the title.
7. In Annex 11 (1), point (k) is deleted.
Points (l) and (m) shall be renumbered as points (k) and (l).
8. In Annex 11, point 4 is added:
"4. Contact point of nursing care in social services facilities
Point 1 of this Annex shall apply mutatis mutandis to the requirements for the installation of the nursing care contact centre in social services facilities. ';
9. The following Annex 12 is added:

"Annex No 12
Requirements for technical and physical equipment of mental health centres
1. The basic operating areas of the mental health centre are
(a) an office with a minimum area of 13 m2;
(b) an examination room with a minimum area of 10 m2;
(c) a room for group therapy with a minimum floor area of 15 m2, if it is a mental health centre for children, or a mental health centre for people with an additive disorder;
(d) a waiting room equipped with seat furniture with a minimum floor area of 7 m2; the waiting room may be common to several workplaces, in which case the minimum floor area shall be 10 m2; and
(e) patient toilet.
2. The patient toilet can be common to several workplaces and must have a hall equipped with a sink, unless the sink is located in the cabin.
3. The secondary operating areas of the mental health centre are
(a) sanitary facilities for staff; and
(b) storage facilities where cleaning and disinfection equipment and equipment are stored separately from other items so as to avoid contamination; storage spaces may be replaced by appropriate cabinets provided that the storage of the items is secured in such a way as to avoid contamination.
4. Mental health centre facilities:
(a) furniture for the work of health professionals and other professionals;
(b) a chair or a chair for the patient,
(c) tonometer,
(d) fonendoscope,
(e) the thermometer,
(f) personal weight;
(g) altimeter;
(h) assists for clinical-psychological examinations, in particular a set of standardised psychodiagnostic methods to assess personality, intelligence and memory and to assess the development level and family environment of children, depending on the focus of care on a defined group of patients;
(i) alkote and testers for the presence of narcotic drugs and psychotropic substances;
(j) a storage cabinet for medical devices, tools and aids;
(k) a cabinet, unless the medical file is kept exclusively in electronic form or a central file is set up;
(l) a medicine cabinet,
(m) a refrigerator for medicinal products equipped with a thermometer when the medicinal products or devices which require a temperature below room temperature are stored;
(n) a non-portable metal lockable box where narcotic or psychotropic substances or preparations containing 5),
(o) first-aid supplies and medicinal products, including cardiopulmonary resuscitation, i.e. resuscitation cloth or self-opening bag including mask, air ducts, gloves, bleeding build-up equipment and venous entry aids; and
(p) a biological material refrigerator equipped with a thermometer when the biological material is stored.
5. If care is provided at the centre of mental health for children, its equipment must be adapted to those patients. '
Čl. II
Transitional provision
The health service provider, which provided long-term bed care to children before the date of entry into force of this Decree, shall comply with the requirements set out in point 4.5 of Part II of Annex 4 to Decree No 92 / 2012 Coll., as effective from the date of entry into force of this Decree, no later than 31 December 2025.
Čl. III
Efficacy
This Decree shall take effect on the day following that of its publication.
