DECLARATION
of 29 April 2013
laying down the specialised competence of medical practitioners and medical examiners carrying out tests to confirm the irreversible death for the purpose of the collection of tissues or organs intended for transplantation (Ordinance on the specialised competence of doctors investigating and certifying death for transplantation)
The Ministry of Health provides pursuant to Section 10 (7) of Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organ and on the amendment of certain laws (Transplant Act), as amended by Act No. 44 / 2013 Coll.:
Specialised competence of doctors investigating the death of a potential donor by demonstrating irreversible blood-flow arrest
(1) Physicians investigating the death of a potential donor of tissues or organs intended for transplantation (hereinafter referred to as "potential donor") must have specialised competence in one of the fields of specialisation training by demonstrating irreversible pawning of blood circulation; a physician with specialised hygiene and epidemiology, clinical biochemistry, medical microbiology, radiology and imaging methods, or a dentist, is not entitled to demonstrate death by demonstrating irreversible arrest of blood circulation.
(2) If the expected tissue or organ should be collected before 2 hours after the detection of the possible donor's death, at least 1 of the doctors detecting death must be able to demonstrate irreversible arrest of blood circulation in at least 1 of the fields of anaesthesia and intensive medicine or surgery or internal medicine.
(3) If death is detected by demonstrating irreversible arrest of a possible donor's blood stream, which is a child, at least 1 of the doctors investigating the death of a child by the age of 18 must have specialised competence in the field of anesthesiology and intensive medicine, or
(a) if the child is lost by the 27th day of life,
1. specialised competence in the field of paediatric medicine or pediatrics; or
2. specific competence or specialised competence in neonatology; or
(b) if the child goes from 28 days of life to 18 years of age,
1. specialised competence in the field of paediatric medicine or pediatrics; or
2. specific competence or specialised competence in the field of neonatology, if the death of a child under the care of a neonatology hospital is ascertained.
Specialised competence of doctors investigating the death of a potential donor by demonstrating irreversible loss of brain function including brain stem
(1) At least 1 of the doctors investigating the death of a potential donor by demonstrating irreversible loss of function throughout the brain, including the brain stem (brain death), must have specialised competence in at least 1 of the fields of anaesthesia and intensive medicine, neurology or neurosurgery.
(2) Where death is ascertained by proving the death of a possible donor's brain, which is a child up to the age of 18, at least 1 of the doctors investigating the death of the child must have specialised competence in the field of anaesthesiology and intensive medicine, neurology or neurosurgery or specialised competence, specific competence or specialised competence in the field of paediatric neurology; or
(a) if the child is lost by the 27th day of life,
1. specialised competence in the field of paediatric medicine or pediatrics; or
2. specific competence or specialised competence in neonatology; or
(b) if the child goes from 28 days of life to 18 years of age,
1. specialised competence in the field of paediatric medicine or pediatrics; or
2. specific competence or specialised competence in the field of neonatology, if the death of a child under the care of a neonatology hospital is ascertained.
Specialised competence of physicians conducting examinations confirming the irreversible death of a possible donor brain
(1) A physician conducting an examination confirming the irreversible death of a possible donor by means of angiography of the cerebral arteries must have specific professional or specific expertise in radiology and imaging methods.
(2) A physician conducting an examination confirming the irreversible death of a possible donor's brain by means of a computer tomographic angiography must have specialised competence in radiology and imaging methods.
(3) A physician performing an examination confirming the irreversible death of the brain of a possible donor using brain perfusion scintigraphy must have a specialised competence in nuclear medicine.
(4) A doctor conducting an examination confirming the irreversible death of a possible donor by means of transcranial Doppler sonography must have:
(a) specialised competence in radiology and imaging methods, neurology, neurosurgery or anesthesiology and intensive medicine; or
(b) specialised competence, specific competence or specialised competence in the field of paediatric neurology, or specific professional or specialised competence in the field of intensive medicine
and demonstrated at least three years of experience in the continuous implementation and interpretation of the results of the Doppler examinations.
(5) A physician conducting examination to confirm the irreversible death of a possible donor by means of auditory stem-evoked potential must have:
(a) specialised competence in neurology or otorinolaryngology; or
(b) specialised competence, specific competence or specialised competence in the field of paediatric neurology
and demonstrated at least three years of experience in the continuous implementation and interpretation of the results of the evaluation of evoked potential.
Repeal
Decree No 479 / 2002 Coll., which provides for the competence of doctors investigating death and doctors carrying out tests to confirm irreversible death for the purpose of the collection of tissues or organs intended for transplantation, is hereby repealed.
Efficacy
This decree shall take effect on the day of its publication.
