ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 26 February 2021
on the adoption of crisis measures
Following the Government Resolution No. 196 of 26 February 2021 by which the Government, pursuant to Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status in accordance with Article 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on emergency management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the crisis situation, the adoption of emergency measures within the meaning of § 5 (c) and § 6 (1) (b) of the Crisis Act.
In order to prevent the spread of COVID-19 disease within the framework of increased mobility of persons between counties and to strengthen the responsibility and prevention of persons in dealing with a crisis situation related to the occurrence of COVID-19 disease with effect from 1 March 2021 from 00: 00 until 21 March 2021 to 23: 59, the Government limits the free movement of persons within the Czech Republic by:
I. prohibits
1. all persons leave the territory of the district or capital city of Prague in whose territory they are resident or resident; the residence for the purposes of this measure shall also be considered to be its own holiday accommodation if the person is staying there on the date of entry into force of the measure and continuously thereafter, subject to the current residence of only members of one household in such holiday accommodation,
2. entry, movement and residence in the territory of the district or capital city of Prague to any person who does not have his permanent residence in the territory of that district or capital city of Prague;
II. provides for the following exceptions from the prohibitions referred to in point I.:
1. travel to work and to perform business or other similar activities and to perform the duties of a public official or constitutional officer;
2. the necessary journey to ensure the necessary needs of relatives and loved ones or needs for another person (e.g. volunteering, neighbourhood assistance), childcare, animal care, waste disposal,
3. the necessary travel to health care facilities or for the use of social services, including the provision of necessary accompanying relatives and loved ones, and veterinary care facilities;
4. travel to deal with urgent official matters, including ensuring the necessary accompanying of relatives and loved ones;
5. pursuit of the profession or activities used for reinsurance
(a) security, internal order and crisis management;
(b) health protection, health or social care, including volunteering;
(c) individual spiritual care and services,
(d) public transport and other infrastructure,
(e) services for residents, including supplies and delivery services;
(f) veterinary care;
6. participation in a funeral, of not more than 15 persons,
7. travel for participation in education, including practice and trials;
8. participation in a collective holiday event as referred to in point IX;
9. travel for the purposes of elections and meetings of legal entities in the municipality of their registered office under the conditions laid down in point X;
10. travel back to his place of residence or residence;
11. travel for travel from the Czech Republic;
III. Orders the residence and movement of persons in the district or capital city of Prague
1. the prohibition on the free movement of persons within the territory of the district or capital city of Prague from 21: 00 to 04: 59, except:
(a) travel to work and to perform business or other similar activities and to perform the duties of a public official or constitutional officer;
(b) the pursuit of the profession;
(c) the pursuit of reinsurance activities
(i) security, internal order and crisis management;
(ii) health protection, health or social care;
(iii) public transport and other infrastructure;
(iv) services for residents, including supplies and delivery services;
(d) urgent journeys, the execution of which is strictly necessary during night hours for the protection of life, health, property or other legally protected interests;
e) walking dogs up to 500 metres from the place of residence,
(f) participation in a mass action of leave as referred to in point VIII. of this crisis measure;
(g) travel back to his place of residence;
2. stay between 05: 00 and 20: 59 at the place of residence or residence except:
(a) the cases referred to in point II;
(b) necessary journeys for the purchase of goods and services or the provision of services in an essential number of persons;
(c) trips for outdoor or park stays and sports on outdoor sports grounds, provided that only members of one household are present together and within the territory of the municipality in which the person is resident or resident;
(d) residence in a private holiday accommodation, subject to the current residence of only members of one household in such a holiday accommodation and the possible movement of such persons for the purpose of staying in nature or parks and sports on outdoor sports grounds only in the territory of the municipality in which the holiday accommodation is situated;
(e) participation in a wedding or declaration of entry into a registered partnership, of not more than 15 persons, or visits to a cemetery;
3. limit contact to the extent necessary with persons other than household members;
4. to reside in public places of no more than 2 persons, with the exception of members of the household, accompanied by an escort as referred to in points II / 3 and 4, working for the same employer, persons jointly engaged in business or other similar activities, persons jointly engaged in activities which are required under the law and which are required to do so in a higher number of persons, children, pupils and students in the provision of education in schools or educational establishments, and to maintain a distance of at least 2 metres in contact with other persons where possible;
5. Employers shall benefit from distance work if, in view of the nature of their work and operating conditions, they are able to carry it out at the place of permanent residence or residence;
IV. Orders all persons who have reached at least 15 years of age who benefit from exemptions under:
1. Point II / 1 is required to demonstrate the justification for the use of this derogation by means of a written confirmation by the employer or by an authority which carries out the duties of a public official or constitutional officer or, where applicable, by a contract of employment or by an employment or similar card, if they contain the necessary information, or by a written document stating a particular reason for carrying out a business or other similar activity, including the place of activity and the contact details of the client or person to whom the activity is carried out;
2. points II / 2 to 11 are required to demonstrate the justification for making use of these exceptions by means of a written document or an affidavit stating a specific reason under points II / 2 to 9 and 11; the justification for using the derogation under point II / 11 must also be demonstrated by documents relating to travel from the Czech Republic;
V. prohibits the residence of foreigners in the territory of the Czech Republic if, after the effective date of this resolution, governments have arrived for a reason other than that referred to in point II or if they have arrived in contravention of the protection measure of the Ministry of Health;
VI. Limits the right to gather peacefully according to Act No. 84 / 1990 Coll., on the right of assembly, as amended, so that each participant is obliged to have a protective means of breathing (nose, mouth) which prevents the spread of droplets; and
1. the assembly, if not the assembly referred to in point (b), may take place only outside the internal premises of the buildings and may take part in a total of not more than 100 participants, in groups of not more than 20 participants and in the maintenance of intervals between groups of participants of at least 2 metres;
2. the assembly organised by the church or religious society in a church or other room intended for religious ceremonies may not attend more than 10% of the seating positions, the participants, with the exception of persons leading or providing the ceremony, shall, for most of the time, sit on seats, observe a minimum of 2 metres of spacing between the participants sitting in one row of seats, disinfect their hands before entering the inner space, do not receive a handshake when the room is greeted and there is no mass singing within the assembly, except when the singers or the congregation are separated from the other participants in the assembly in such a way as to prevent the spread of the droppings;
VII. strongly recommends staying at the place of permanent residence or residence only with members of their own household and persons who are cared for by the member of the household;
VIII. provides that the obligations set out in points I to III shall not apply to persons who, evidently through the territory of the Czech Republic or, where appropriate, the district or capital of Prague, merely transit, such as international or national transport workers. Persons transiting in this way shall be prohibited from stopping in the territory of the Czech Republic or in the district or capital of Prague if this is not strictly necessary;
IX. designates the Ministry of Health to establish binding hygienic-epidemiological conditions for mass actions otherwise prohibited as a result of this emergency measure, in respect of which it is permitted to take place for reasons which are of particular interest to the public or to significant sporting events or competitions;
X. limits the holding of elections by a legal entity and meetings by an authority of a legal entity, with the exception of the local authorities, so that where more than 10 persons participate in one place:
1. each person uses a medical facial mask (surgical mask) or a respirator or half-mask without an exhalation valve with a filter efficiency of at least FFP2, KN95 or N95 as a protective device of the airway;
2. persons are established in such a way that they comply with a minimum of 2 metres, except for household members;
3. each person shall, before commencing, submit to the meeting caller or other authorised person a confirmation of the negative result of an antigen test for the presence of SARS CoV-2 virus antigen or RT- PCR test for the presence of SARS CoV-2 virus carried out not more than 3 days ago;
4. that a maximum of 50 persons participate in the meeting, unless the meeting is necessary to fulfil the statutory obligations, including the choice of the institution;
XI. strongly recommends that children's playground operators, including municipalities, close the playground premises.
