DECLARATION
of 11 April 2025
amending certain statutes implementing electoral laws
The Ministry of Interior provides for the Act of the Ministry of Foreign Affairs pursuant to § 92 paragraph 1 (a) of Act No. 247 / 1995 Coll., on the elections to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 204 / 2002 Coll., and in the Agreement with the Czech Statistical Office pursuant to § 92 paragraph 1 (c) (2) and (3) of Act No. 247 / 1995 Coll., on the Election of the President of the Czech Republic and on the amendment and amendment of certain laws (Act No. 204 / 2000 Coll.) and Act No. 230 / 2002 Coll., and under § 69 (b) (2) of Act No. 275 / 2012 Coll., on the Election of the President of the Czech Republic and on the amendment of certain Acts:

Decree No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on the Election to the Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 212 / 1996 Coll., the finding of the Constitutional Court published under No. 243 / 1999 Coll. and Act No. 204 / 2000 Coll., as amended by Decree No. 80 / 2002 Coll., Decree No. 188 / 2002 Coll., Decree No. 401 / 2002 Coll., Decree No. 442 / 2009 Coll., Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll., Decree No. 468 / 2008 Coll., Decree No. 321 / 2009 Coll., Decree No. 442 / 2009 Coll.
1. In Article 1 (3), the words "the residence of a voter who does not reside in the Czech Republic 'are replaced by the words" the address of the place in the district of the representative office where he resides'.
2. In Article 8, at the end of paragraph 2, the sentence "The representative office shall proceed in the same way in the handling of the forms of identification cards. 'is added.
3. In Article 8 (3), the words "served envelopes," shall be inserted after the word "envelopes,"
4. In Annex 1, Model 1b.:

5. In Annex 1, in model 2b., point 2, the words "resident 'are replaced by the words" resident'.
6. In Annex 1, in model 2b., point 3, the words "resident 'are replaced by the words" resident'.
7. In Annex No 1, in model 2b., in point 4, the words "written applications, supported by the original and, where appropriate, certified copies of documents confirming its identity, citizenship of the Czech Republic and residence in the territorial district of the local representative office 'are replaced by the words" an application stating the address of the place of residence in the local representative office where it resides' and the words "(Paragraph 6 (5) of the Election Act) 'are deleted.
8. In Annex 1, in model 2b., the following point 8 is inserted after point 7:
'8. A voter, who, at his request, is registered in a special electoral list with the local representative office, may also use the correspondence vote in the elections to the Chamber of Deputies of the Parliament of the Czech Republic.
A request for correspondence voting documents may be submitted by the voter from the date of the announcement of the elections to the Chamber of Deputies of the Parliament of the Czech Republic to the representative office, with which he is entered in a separate list of voters.
The application may be submitted:
1. in person or through a person who is proven to be in full power with an officially certified voter's signature within 2 days before the election date; or
2. up to 35 days before election date
- in writing, with the official signature of the voter,
- via the electorate data box, or
- through a public administration portal using an electronic identification device issued under a qualified electronic identification system at least at the level of the guarantee.
The application shall contain the name and surname of the voter, the date of birth and the address situated in the territory of the State which falls within the territory of the representative office to which correspondence documents are to be sent, or, where appropriate, an indication that the voter will take over the documents at the representative's office himself or through a person who will be demonstrated by full authority with the officially certified signature of the voter.
The voter shall print a ballot for correspondence voting from an electronic draft ballot available on the Ministry of Interior website. '
Point 8 is renumbered point 9.

Amendment to Decree No 294 / 2012 Coll.
Decree No. 294 / 2012 Coll., on the implementation of certain provisions of the Act on the Election of the President of the Republic, as amended by Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll., Decree No. 475 / 2017 Coll., Decree No. 185 / 2018 Coll., Decree No. 39 / 2019 Coll. and Decree No. 265 / 2019 Coll., are amended as follows:
1. In Paragraph 1 (2), the words ", delivered envelopes used 'shall be inserted after the words" envelopes'.
2. In Annex 5, the model form T / 1a for the record of the vote in the constituency shall read:

3. In Annex 5, the model form T / 1b for the record of the course and the outcome of the vote in the special constituency reads:

This Decree shall take effect on the day following that of its publication.
